On June 28, 2024, at the 7th Session, the 15th National Assembly passed the Capital Law (Law No. 39/2024/QH15). The Law takes effect from January 1, 2025 (of which 5 contents take effect from July 1, 2025). The Hanoi People's Committee issued Plan No. 225/KH-UBND dated July 22, 2024 on the implementation of the Capital Law. In order for the plan to be implemented promptly and effectively, ensuring progress and quality, the Hanoi People's Committee requests departments, branches, sectors, People's Committees of districts, towns and cities to perform a number of tasks.

Propagating the Capital Law suitable for each field and subject

Regarding the work of propagating, disseminating and training the Law on the Capital, the City People's Committee assigned the Department of Justice to preside over and coordinate with units under the Ministry of Justice and Hanoi City to develop documents for propagating, disseminating and training the Law on the Capital; the completion time is before September 1, 2024. In particular, the Department of Justice will advise on the selection of documents to develop and publish the draft record of the Law on the Capital, digitize and disseminate it on mass media.

At the same time, the Department of Justice shall preside over and coordinate with relevant units to develop a plan to organize propaganda, dissemination and training on the Capital Law, suitable for each field, subject and locality, and submit it to the City People's Committee for promulgation; completion time is before September 1, 2024.

In addition, the Department of Justice presides over and coordinates with departments, branches, sectors, and People's Committees of districts, towns, and cities to organize and implement plans to propagate, disseminate, and train on the Capital Law.

Proposing policies, urgently drafting legal documents

Regarding the work of drafting and promulgating documents implementing the Law on the Capital, for documents under the authority of the Central agencies (Government, Prime Minister, Ministries, branches, etc.), the Department of Construction, Department of Planning and Investment, Department of Science and Technology, Department of Finance, Department of Education and Training are assigned to proactively coordinate with the assigned Ministries to preside over the drafting of documents detailing the implementation of the Law on the Capital to carry out the drafting of documents within the time limit prescribed in Decision No. 717/QD-TTg dated July 27, 2024 of the Prime Minister promulgating the List and assigning the agencies to preside over the drafting of documents detailing the implementation of Laws and Resolutions passed by the 15th National Assembly at the 7th Session.

For documents under the authority of the People's Council and the People's Committee, departments, branches and sectors shall, based on the assigned tasks in the plan, proactively develop specific implementation plans; make a list of legal documents under the assigned tasks, send them to the City's Capital Law Implementation Working Group for synthesis, report to the City People's Committee to submit to the City People's Council for consideration and approval at the City People's Council Sessions. The deadline for completion is before August 15, 2024.

At the same time, the City also requires departments, branches and sectors to proactively research, propose policies and promptly draft legal documents according to assigned content, ensuring progress and quality. In addition, proactively review current legal documents of the city according to the sectors and fields in charge to propose amendments, supplements and new issuances; update related contents of the Capital Law, send to the Department of Justice for synthesis, consultation and reporting to the City People's Committee before October 1, 2024.

Launching emulation movement to organize the implementation of the Capital Law

To implement the plan, the City People's Committee assigned the Department of Justice to preside over and coordinate with the Office of the City People's Committee and relevant units to advise on the establishment and promulgation of the working plan of the Working Group and the City's Support Group to direct and urge the implementation of the plan. At the same time, advise the Party Committee of the City People's Committee to submit to the Standing Committee of the City Party Committee and the Standing Committee of the City Party Committee a draft document of the Hanoi Party Committee directing the implementation of the Capital Law in the city.

The Department of Home Affairs (City Emulation and Reward Board) presides over and coordinates with the Department of Justice and relevant units to advise the City People's Committee to issue a plan to launch an emulation movement to implement the Capital Law in the city; propose timely rewards and honors for individuals, agencies, organizations and units with outstanding achievements in the work of building and implementing the Law.

Regarding the conditions for ensuring the implementation of the Capital Law, the City People's Committee assigned the Department of Justice to preside over and coordinate with the Department of Finance and the Legal Committee of the City People's Council to develop a Draft Resolution of the City People's Council on funding for the implementation of the Capital Law to submit to the City People's Council for consideration and promulgation at the 18th Session of the City People's Council in September 2024 according to the simplified procedures...
