On June 28, 2024, at its 7th session, the 15th National Assembly passed the Law on the Capital City (Law No. 39/2024/QH15). The law takes effect from January 1, 2025 (with 5 provisions effective from July 1, 2025). The Hanoi People's Committee issued Plan No. 225/KH-UBND on July 22, 2024, regarding the implementation of the Law on the Capital City. To ensure timely and effective implementation of the plan, and to guarantee progress and quality, the Hanoi People's Committee requests that departments, agencies, and the People's Committees of districts, counties, and towns carry out several tasks.
Disseminating information about the Law on the Capital City in a manner appropriate to each sector and target group.
Regarding the dissemination, popularization, and training on the Law on the Capital City, the Hanoi People's Committee has assigned the Department of Justice to take the lead and coordinate with units under the Ministry of Justice and Hanoi City to develop materials for disseminating, popularizing, and training on the Law on the Capital City; the deadline for completion is before September 1, 2024. Specifically, the Department of Justice will advise on the selection of materials for the development and publication of a compilation of the draft Law on the Capital City, digitize it, and disseminate it through mass media.
Simultaneously, the Department of Justice will take the lead in coordinating with relevant units to develop a plan for organizing the dissemination, popularization, and training on the Law on the Capital City, tailored to each field, target group, and geographical area, and submit it to the Hanoi People's Committee for promulgation; the deadline for completion is before September 1, 2024.
In addition, the Department of Justice will take the lead and coordinate with other departments, agencies, and the People's Committees of districts, counties, and towns to organize the implementation of the plan for disseminating, publicizing, and training on the Law on the Capital City.
Propose policies and expedite the drafting of legal documents.
Regarding the drafting and promulgation of implementing documents for the Law on the Capital City, for documents under the authority of central agencies (Government, Prime Minister, Ministries, sectors...), the Department of Construction, the Department of Planning and Investment, the Department of Science and Technology, the Department of Finance, and the Department of Education and Training are assigned to proactively coordinate with the Ministries assigned to lead the drafting of detailed implementing regulations for the Law on the Capital City to ensure that the drafting of documents is completed within the timeframe stipulated in Decision No. 717/QD-TTg dated July 27, 2024, of the Prime Minister, which promulgates the List and assignment of agencies to lead the drafting of detailed implementing regulations for Laws and Resolutions passed by the 15th National Assembly at its 7th Session.
For documents under the authority of the People's Council and the People's Committee of Hanoi City, departments and agencies shall, based on their assigned tasks in the plan, proactively develop specific implementation plans; compile a list of legal documents under their assigned tasks, and send it to the City's Task Force for the Implementation of the Capital City Law for compilation and reporting to the People's Committee of Hanoi City for submission to the People's Council of Hanoi City for consideration and approval at its sessions. The deadline for completion is before August 15, 2024.
At the same time, the city also requested departments and agencies to proactively research and propose policies and promptly draft legal documents according to their assigned tasks, ensuring progress and quality. In addition, they should proactively review existing legal documents of the city according to their respective sectors and fields of responsibility to propose amendments, additions, and new issuances; update relevant contents of the Law on the Capital City, and submit them to the Department of Justice for compilation, advice, and reporting to the City People's Committee before October 1, 2024.
Launching a campaign to promote the implementation of the Law on the Capital City.
To implement the plan, the Hanoi People's Committee assigned the Department of Justice to take the lead, in coordination with the Office of the People's Committee and relevant units, in advising on the establishment and issuance of the operational plan of the City's Task Force and Support Team to direct and supervise the implementation of the plan. At the same time, it advised the Party Committee of the Hanoi People's Committee to submit to the Standing Committee of the City Party Committee and the Executive Committee of the City Party Committee a draft document of the Hanoi City Party Committee directing the implementation of the Law on the Capital City in the city.
The Department of Internal Affairs (City Emulation and Commendation Board) will preside over and coordinate with the Department of Justice and relevant units to advise the City People's Committee on issuing a plan to launch an emulation movement to implement the Law on the Capital City in the city; and propose timely commendations and honors for individuals, agencies, organizations, and units with outstanding achievements in the work of drafting and implementing the Law.
Regarding the conditions for ensuring the implementation of the Law on the Capital City, the Hanoi People's Committee assigned the Department of Justice to take the lead, in coordination with the Department of Finance and the Legal Affairs Committee of the Hanoi People's Council, in drafting a Resolution of the Hanoi People's Council on the funding for the implementation of the Law on the Capital City, to be submitted to the Hanoi People's Council for consideration and promulgation at the 18th session of the Hanoi People's Council in September 2024, following the simplified procedures...
