(QBĐT) - Regarding the resettlement land allocation for Ms. Nguyen Thi Chut (born in 1939) in Dong Son village, Cu Nam commune (Bo Trach), although the competent authorities have repeatedly directed the settlement, up to now, the matter is still "stuck in place". Why?
Content of the case
In 2003, many households in Dong Son village, Cu Nam commune had to relocate and resettle to implement the 500kV line 2 construction through the area, including the household of Ms. Nguyen Thi Chut. At that time, the affected households were not compensated for residential land for site clearance (GPMB), but were only supported with relocation costs, compensation for assets on the land and resettlement land in another location. Ms. Chut's household was subject to relocation and was supported by the project with more than 60 million VND. However, because the resettlement land did not ensure the ground level (no electricity line, low-lying), Ms. Chut's family did not agree to accept it. Because she was not granted new residential land, Ms. Chut returned to live anxiously in the old house, between the 500kV lines 1 and 2 until today.
Regarding this matter, since 2022, Mr. Pham Van Chien (son and authorized person of Mrs. Chut) has repeatedly sent petitions to the People's Committee of Cu Nam commune and Bo Trach district, but so far they have not been resolved. Quang Binh Newspaper, issue dated August 5, 2024, published an article "Bo Trach: Soon grant new resettlement land to Mrs. Nguyen Thi Chut in Cu Nam commune" reflecting the above situation. Working with us at that time, the leaders of the People's Committee of the commune and Bo Trach district both affirmed that they would arrange land funds to grant land to Mrs. Chut to ensure the rights of the family. The District People's Committee also set a deadline until the end of July 2024 for the functional department and the People's Committee of Cu Nam commune to resolve the matter. However, up to now, the matter is still "stuck in place".
Family has not agreed to compensation
Responding to this incident, Chairman of the People's Committee of Cu Nam Commune Nguyen Van Luong said that, based on the conclusions of the District People's Committee, in July 2024, the commune reviewed the land fund and worked with Mr. Pham Van Chien to select the location of the land plot, to request the competent authority to conduct site clearance and prepare a file to allocate residential land to the family. At the meeting, Mr. Chien agreed to choose land plot No. 36, map sheet No. 26, in Dong Son village (residential land planned in 2005). After a period of inspection, the family representative did not agree to accept it because it was not suitable.
After that, the Commune People's Committee continued to assign land officials and related departments to re-examine all residential land funds in the area, including the land fund that had been planned for auction in the period 2004-2017 remaining in the village. Through inspection and review, in Dong Son village, there was still land plot No. 274, map sheet No. 26, area 591.2m². In order to have a basis to request competent authorities to resolve and develop a plan to allocate land to the family, the Commune People's Committee provided a detailed plan for the construction of a rural residential area here. After Mr. Pham Van Chien agreed to receive the above land plot, the Commune People's Committee hired a consulting unit to extract cadastral measurements and submit them to the Department of Agriculture and Environment (NN-MT) for approval and registration of the land use plan for 2025, as a legal basis to request competent authorities to grant residential land to Ms. Nguyen Thi Chut in accordance with the law. However, although the land plot location has been registered in the 2025 land use plan, it has not been approved as a basis for site clearance.
Regarding the incident, on March 28, 2025, the People's Committee of Bo Trach district announced the conclusion of the district leaders, assigning the People's Committee of Cu Nam commune to coordinate with the Department of Agriculture and Environment to urgently work with Mr. Pham Van Chien to agree on a compensation plan for the exchange of land plots. If Mr. Chien agrees with the plan, the People's Committee of the commune will develop a plan to exchange land for Ms. Nguyen Thi Chut at land plot No. 1240. On that basis, the Department of Agriculture and Environment will appraise, advise the District People's Committee to approve and complete the procedures for land recovery and exchange for Ms. Nguyen Thi Chut in accordance with regulations. If the household does not agree with the compensation plan, the People's Committee of Cu Nam commune will request the household to continue waiting for the commune to select another location. |
On March 10, 2025, the People's Committee of Cu Nam Commune continued to work with Mr. Chien. Through discussion and explanation, the family agreed and unanimously requested to be assigned land plot No. 1240, area 294.8m², map sheet No. 22, belonging to the detailed planning project for the construction of rural residential areas in Dong Lon area. This land plot has been assigned by the Provincial People's Committee to change its land use purpose. Currently, the People's Committee of the Commune has completed the site clearance work and is proposing to determine the land price for the auction of land use rights in 2025.
According to the explanation of the Department of Agriculture and Environment of Bo Trach district, the reason for not handing over land plot No. 274, map sheet No. 26 according to the family's wishes is because this land plot has not been compensated, land clearance, land use purpose change, land allocation decision of the Provincial People's Committee has not been made, so the land allocation procedure cannot be carried out. Meanwhile, land plot No. 1240, map sheet No. 22 has completed land clearance and land allocation work and was allocated by the Provincial People's Committee in 2024. Therefore, the department has proposed the District People's Committee to assign the People's Committee of Cu Nam commune to urgently develop a plan to exchange land plot No. 1240, map sheet No. 22 and agreed with Ms. Nguyen Thi Chut. However, the local government noted the compensation plan, in case the exchanged land plot has a higher or lower land use right value.
Thus, according to the opinion of the Department of Agriculture and Environment of Bo Trach district, if land plot No. 1240, map sheet No. 22 is valued higher than Mrs. Chut's old land plot, then Mrs. Chut must compensate. Mr. Pham Van Chien was upset: "According to the opinion of the local government, my mother's old land plot (area of 1,434m²) is valued at just over 300 million VND, while land plot No. 1240, map sheet No. 22 is valued at over 900 million VND. That means to be granted this land plot, my mother must compensate up to 600 million VND, so where does my mother get the money to compensate? Meanwhile, according to previous regulations, when implementing the 500kV transmission line project, the District People's Committee must be responsible for supporting and allocating new residential land without collecting land use fees for relocated households".
