Hanoi innovates procedures for establishing, adjusting and expanding the boundaries of high-tech zones

Continuing the 22nd session, on the afternoon of April 29, with the majority of delegates present in agreement, the Hanoi City People's Council passed a Resolution regulating the procedures for establishing, adjusting, and expanding the boundaries of high-tech zones and exercising some powers of the City's High-Tech Zone and Industrial Zone Management Board.

The Resolution consists of 7 chapters and 30 articles, clearly defining the scope of regulation, applicable subjects, procedures for establishing high-tech zones, etc. In particular, Article 10 stipulates the procedures for granting construction permits and adjusting construction permits.

Specifically, the project investor submits an application for a construction permit or construction permit adjustment in accordance with the provisions of the law on construction to the Management Board. Within 7 working days from the date of receipt of a complete application as prescribed, the Management Board shall conduct a field inspection and make a record of the current status and check the application for a construction permit in accordance with the provisions of the law on construction.

In case the dossier or documents are missing, not in accordance with regulations or not in accordance with reality, the Management Board shall notify the investor in writing once to supplement and complete the dossier. If the supplementary dossier does not meet the contents of the notice, within 3 working days, the Management Board shall notify the investor of the reason for not granting the construction permit.

If necessary, within 5 working days from the date of receipt of complete documents as prescribed, the Management Board shall send a document to seek opinions from state management agencies on areas related to construction works. Within 12 days from the date of receipt of documents as prescribed, the agencies consulted shall be responsible for responding in writing on the contents under their management functions.

Article 13 stipulates the order and procedures for approving investment policies. Specifically, investors submit a dossier requesting approval of investment policies according to regulations to the Management Board. Within 3 working days from the date of receiving a valid dossier, the Management Board shall send the dossier to the Department of Finance and relevant departments and branches for appraisal on the contents under the state management scope of that agency according to the provisions of the law on investment and relevant legal provisions and send it to the Management Board within 15 working days.

Article 21 stipulates the procedures for approving the use of foreign workers by contractors. Specifically, before recruiting foreign workers, contractors must submit documents to the Management Board, declaring the number, qualifications, professional capacity, and experience of foreign workers needed to perform the bidding package in Vietnam and requesting the recruitment of Vietnamese workers for the job positions expected to recruit foreign workers.

In case the contractor needs to adjust or supplement the declared number of employees, the investor must confirm the plan to adjust or supplement the contractor's labor needs. The management board shall consider and decide whether the contractor is allowed to recruit foreign employees for job positions that cannot be recruited by Vietnamese employees in case it is not possible to introduce or supply Vietnamese employees to the contractor.

Presenting the audit report, the Economic - Budget Committee of the City People's Council proposed to consider the regulation in Article 3 in the direction of "Hanoi High-Tech Park includes..." to distinguish it from the concept of "High-Tech Park" stipulated in the 2008 Law on High Technology, ensuring the special nature of the Capital.

Article 4 stipulates that the response time of relevant agencies to the dossier requesting the establishment of a high-tech zone is specifically defined as 10 working days. However, in order to ensure consistency and transparency in the time for reviewing and resolving administrative procedures, the Committee proposes to consider adding specific regulations on the time for the Appraisal Council to hold a meeting to appraise the dossier and the deadline for collecting opinions after the Management Board sends the dossier requesting the establishment of a high-tech zone to collect opinions from the members of the Appraisal Council.
