Four years without getting the house back

In early August 2024, Giao thong Newspaper reporters were present at Nghe An Province Ethnic Boarding High School (located in Ha Huy Tap Ward, Vinh City). According to records, the school is implementing the construction of a dormitory for students.

Even though he retired in 2009, teacher Nguyen Duc Canh still has not returned the dormitory to Ha Huy Tap High School.

However, while a row of multi-storey houses has been built, the project has not been able to be implemented at the back, adjacent to Kenh Bac Street. The reason is that there is still a household that has not returned the dormitory house previously borrowed from the school.

Nghe An Ethnic Boarding High School was established in 1984 and was granted land by the province at its current location. In 2005, the rooms of the two previous dormitories were demolished to build a cafeteria for students, leaving only three rooms. In 2006, after the cafeteria was completed, realizing that there were still many teachers in difficult circumstances, the school leaders held a meeting to consider allowing three teachers' households to live in the three remaining rooms.

In addition, there are two other teachers, Mr. Nguyen Van Ky and Ms. Sam Thi Son, who were lent the vacant land next door by the school to build houses.

In 2019, the school requested funding to build a dormitory for students. In the same year, the school worked with the households that borrowed the apartment building, requesting to move within one year as committed. At that time, one household had no opinion, the remaining households requested a three-year period to move.

However, by October 2023, the dormitory project was started, but 5 households still refused to hand over the premises. After hundreds of meetings and campaigns, 4 households have moved out, including Mr. Nguyen Van Ky's household.

Strangely, borrowed land is still granted red book

Not far away, the Board of Directors of Ha Huy Tap High School (Le Loi Ward, Vinh City) also fell into a situation of both laughter and tears because a former teacher of the school borrowed a dormitory but refused to return it. Like at boarding schools, the dormitory at Ha Huy Tap School has a very nice location, facing Nguyen Dinh Chieu Street.

In 2003, Ha Huy Tap High School built 11 dormitories on campus for teachers to use. Each room is about 40 square meters in area. Teacher Nguyen Duc Canh was assigned to the first room, adjacent to the fence next to Nguyen Dinh Chieu Street.

In 2009, Mr. Canh retired but was still given the opportunity by the school to continue living in this apartment building. Currently, the house covers nearly 100 square meters, of which the frontage on Nguyen Dinh Chieu Street is over 10 meters. Recently, the school wanted to build a parking lot for students, so they wanted to demolish this apartment building, but Mr. Canh has not yet handed it over.

This situation does not only occur in Vinh City but also in many other localities. A typical example is at Phu Son Primary School (Phu Son Commune, Tan Ky District), where the security guard lent 20 square meters of land in the campus. This land was then transferred to the security guard's son.

However, the current area of ​​the house, outbuildings and business kiosks has reached 156 square meters, not to mention the 61 square meters that were compensated in the previous canal and road project.

Or Do Luong 1 High School (Da Son Commune, Do Luong District) lent Mr. Nguyen Van Vinh a security booth at the side gate to sell sugarcane juice and guard the gate. The strange thing is that up to now, this land has been granted a red book covering 63 square meters. Moreover, in reality, this land plot has an area of ​​no less than 100 square meters.

Like the two cases in Vinh City, the land plots occupied by individuals in Tan Ky and Do Luong are all in very good locations: facing the main road, at a three-way intersection, so the land value is high, generating high profits...

Coordinate land claim

Mr. Nguyen Trong Hoan, Chief of Office of Nghe An Department of Education and Training, said that the Department is ready to coordinate with schools and localities to reclaim the land. For example, at Nghe An Province Ethnic Boarding High School, after receiving the information, the Department established a working group to propagate and mobilize. The case has now been brought to court, so we have to wait for the final verdict.

The dormitory building behind the Nghe An Province Boarding High School for Ethnic Minorities cannot be implemented because there is still one household that has not returned the land to the school.

According to Mr. Hoan, for many months now, nearly 800 students of Nghe An Province's Ethnic Boarding High School have had to live in crowded temporary dormitories. This has greatly affected their accommodation and study.

"Meanwhile, if the dormitory project is not implemented in time, there is a risk of capital recovery. At that time, not only the students but also the school will be affected. I hope that the teachers and related people who were previously helped by the school during difficult times will soon return it to the school," said Mr. Hoan.

Regarding the case of Phu Son Primary School, a leader of Tan Ky district said that the district is assigning relevant departments to coordinate with Phu Son commune to handle and return the land to the school.

"This is the school's land, it must be returned to the school, no individual can own it. It is possible that the family will have to support the assets that have been built, but the land must be returned. The commune and school's cutting off of land for protection in advance is beyond their authority. During the handling process, whoever was wrong in the past must take responsibility," he said.
