However, since the beginning of August 2024, there has been a document temporarily suspending the division of land due to the 2024 Land Law, so she has to wait for instructions on law enforcement. Ms. Huong said that due to urgent needs, her family has been waiting for an early document to guide the division of land. On March 14, after receiving a notice from the Branch of the Town Land Registration Office, her family immediately went to separate the land to transfer to her child.

Ms. Nguyen Thi Thuy in Minh Long ward shared: “My family has a 20m frontage plot of land and needed to separate 5m for my child, but it was stopped due to the 2024 Land Law. After a long wait, the plot has now been separated again, so I am very happy because it has solved the urgent needs of myself as well as many people in the town.”
Based on the guidance document of the Department of Agriculture and Environment, the branches of the land registration office in the province have sent notices and received land division and measurement files to the people. Accordingly, people in need have come to the branches of the land registration office to carry out administrative procedures for land division in large numbers.
At the Chon Thanh Town Land Registration Office Branch, on average, about 300 applications for land division are received each day. After receiving the applications, the branch staff measured, marked, and confirmed the boundaries in the field to ensure the land division is accurate according to regulations.
Deputy Director of the Chon Thanh Town Land Registration Office Pham Van Nam said: After the 2024 Land Law was promulgated and took effect from August 1, the Provincial People's Committee issued Decision No. 30/2024/QD-UBND dated October 15, 2024 stipulating the limits and conditions for land division in the province. After promulgation, the Provincial Land Registration Office as well as the branch found some problems and were not specific enough to be able to divide the land, so they temporarily stopped waiting for instructions from the Department of Natural Resources and Environment (now the Department of Agriculture and Environment). On March 13, 2025, the Department of Agriculture and Environment issued a document guiding according to Decision No. 30 of the Provincial People's Committee as well as Article 220 of the 2024 Land Law. Immediately after receiving the guidance document, the branch issued a notice to re-accept land division and measurement records from March 14.
After the suspension, the number of land division applications was very large. To speed up the progress, the branch leaders directed the unit to increase working hours in the evening and work overtime on weekends to resolve the backlog of applications for land division needs of the people in accordance with regulations. According to Mr. Nam, Decision No. 30 of the Provincial People's Committee as well as the guidance of the Department of Agriculture and Environment are very specific and detailed. However, due to many joint venture plots of land, landowners and investors from other localities, boundary confirmation is difficult.
Real estate market is recovering
Previously, after applying the 2024 Land Law, many people in the province were upset because they could not carry out land division due to legal problems. The reason is that at Point d, Clause 1, Article 220 of the 2024 Land Law stipulates: "Land division and land consolidation must ensure... water supply, drainage and other necessary needs in a reasonable manner". This is a rather general, very broad and vague content, causing units that carry out land change procedures for people to have no basis to implement. From this general regulation, implementing Decision No. 30 of the Provincial People's Committee, the Department of Agriculture and Environment has issued a document guiding agencies, units and localities to properly implement the regulations.
According to statistics, Binh Phuoc currently has 99.8% of households using electricity; urban areas have tap water and rural areas people use water from dug wells and drilled wells. Therefore, the Department of Agriculture and Environment has implemented guidance on some contents of the implementation of Decision No. 30. Accordingly, with the content: "Ensuring water supply, drainage and other necessary needs in a reasonable manner" as prescribed in Point d, Clause 1, Article 220 of the 2024 Land Law, which has been specifically stipulated in Article 3 of Decision No. 30, when implementing, the conditions and minimum area of each type of land specified in Articles 4, 5, 6 of Decision No. 30 shall be applied.

With the content: "In case the existing traffic road already has a water supply, drainage and electricity supply system, the land plot formed from the division and the remaining land plot must ensure water supply, drainage and electricity supply", according to the provisions of Point a, Clause 1, Article 4 and Clause 1, Article 5 of Decision No. 30, when implementing, the land plot before and after the division must be adjacent to the existing public traffic road, which is considered to ensure the conditions for water supply, drainage and electricity supply.
When implementing the separation and consolidation of plots to change land use purposes as prescribed in Point b, Clause 2, Article 220 of the 2024 Land Law, the area of land use purpose change shall not include the area of land use rights restriction (area of safety corridors for protection of roads, power lines, rivers, streams, etc., areas with planning and land types different from the area of land use purpose change). This restricted area shall continue to be used according to the purpose of use, duration of use, and form of use granted in the land use right certificate and shall be separated and consolidated with the area of land use purpose change.
According to households, the resumption of land division and consolidation not only resolves the backlog of applications due to the suspension of nearly 8 months but also opens a new development phase of the real estate market.
Ms. Thai Thi Huong in Dong Xoai city shared: In addition to the temporary suspension of land division, real estate transactions have also been "frozen" recently. However, after the land division was carried out again, a large number of backlogs were resolved. From here, a new transaction period will open, making real estate bustling again.
