According to the policy, Le Delta Joint Stock Company is the investor of the Project.

The project is implemented in Phuc Son and Lam Cot communes, Tan Yen district, Bac Giang province with a scale of 123.94 hectares of land. The total investment capital of the project is 1,836 billion VND.

The Deputy Prime Minister requested the Ministry of Planning and Investment to be responsible for the assigned contents of project investment policy appraisal and to perform state management of industrial parks in accordance with the Investment Law and relevant laws.

Relevant ministries and branches are responsible for the content of project investment policy appraisal within their functions and tasks according to the provisions of the Investment Law and relevant laws.

The People's Committee of Bac Giang province is responsible for the accuracy of information, reported data, and appraisal contents according to the provisions of law; responsible for the project's conformity with the planning approved by competent authorities; and accepts the opinions of the Ministries.

Check and determine whether the investor meets the conditions for land lease at the time of land lease, paying attention to the conditions on financial capacity; in case the investor does not ensure that he/she meets the conditions for land lease at the time of land lease, there must be timely solutions in accordance with the provisions of law; ensure conditions for permission to change the purpose of land use during the land lease process, and allow permission to change the purpose of land use to implement the project.

Ensure conditions for permission to change land use purpose during the land lease process, permission to change land use purpose for project implementation; comply with regulations on compensation and resettlement support when the State reclaims land; ensure land allocation and lease for small, narrow plots of land managed by the State (if any) meeting the criteria prescribed in Clause 1, Article 14a of Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government detailing the implementation of a number of Articles of the Land Law (supplemented in Clause 11, Article 1 of Decree No. 148/2020/ND-CP dated December 18, 2020 of the Government amending and supplementing a number of Decrees detailing the implementation of the Land Law); Ensure that no proposal is made to change the purpose of using rice-growing land in areas that need strict protection according to the planning and plans approved by competent authorities and that there is a plan to increase the efficiency of other rice-growing land to compensate for the rice-growing land proposed to change its purpose of use to non-agricultural land according to the provisions of Article 134 of the Land Law; in case it is determined that there is public property, it must be handled according to the provisions of the law on public property, ensuring that no state property is lost.

The People's Committee of Bac Giang province directs relevant agencies to synthesize the location and area scale of the project into relevant planning and plans, including the 5-year provincial land use plan for 2021 - 2025, annually and submit to competent authorities for approval, ensuring compliance with the planning of Bac Giang province, the Decision approving the investment policy of the Project; monitor and evaluate the implementation of industrial park land targets of Bac Giang province according to the national land use plan until 2025 allocated in Decision No. 326/QD-TTg dated March 9, 2022 of the Prime Minister on the allocation of national land use planning targets for the period 2021 - 2030, with a vision to 2050 and the 5-year national land use plan for 2021 - 2025 and other relevant documents; Responsible for reviewing and ensuring the progress of land allocation to implement the project in accordance with the land use plan of Bac Giang province and Tan Yen district approved by competent authorities.

At the same time, the People's Committee of Bac Giang province directed the Management Board of Industrial Parks of Bac Giang province and relevant agencies to review and ensure that the area where the Project is implemented is in accordance with the requirements for protecting and promoting the value of cultural heritage and the conditions prescribed by the law on cultural heritage; guide, inspect and supervise investors in implementing the approved and adjusted construction planning of Phuc Son Industrial Park; ensure that the land use structure and environmental safety distance of the industrial park meet the National Technical Regulations on construction planning and other relevant legal provisions; ensure that the location and scale of the project implementation area are in accordance with the project investment policy approved by competent authorities.

The People's Committee of Bac Giang province requests the Investor to: (i) during the project implementation process, report to the competent state agency if it discovers minerals with a higher value than minerals used as common construction materials for handling in accordance with the provisions of the law on minerals; (ii) accept the opinions of the Ministries and the People's Committee of Bac Giang province...

Le Delta Joint Stock Company must ensure to contribute sufficient equity capital to implement the project according to the committed schedule; fully meet the conditions specified in Clause 2, Article 4 of Decree No. 02/2022/ND-CP when carrying out industrial park infrastructure business activities.
