Chairman of the People's Committee of Quang Nam province Le Van Dung made this request at a working session with the Quang Nam Province Business Association, which took place on the afternoon of August 12, to resolve difficulties, problems, and recommendations of businesses.

To help businesses overcome difficulties, Mr. Bao proposed establishing a district-level compensation and clearance task force and a provincial-level task force to monitor and report to the Provincial People's Committee on each specific project on a weekly and monthly basis.
At the same time, Mr. Bao also recommended that for projects with advance compensation money larger than the deposit but delayed due to local fault in handing over the site and not the investor's fault, the deposit should continue to be suspended and the progress should be extended.
For project groups that are forced to adjust investment approval due to the province's request to adjust to create resettlement land fund, or adjust progress due to local delay in handing over the site, which is not the investor's fault, it is allowed to adjust investment approval in advance and make a deposit before the land allocation decision is made.

According to Mr. Bao, previously, to resolve difficulties in allocating land for the entire project at once according to the investment policy and orienting project phases according to site clearance progress, the Department of Planning and Investment instructed investors to phase real estate projects into phases in accordance with the land allocation progress.
However, up to now, very few projects have been able to do this. Because projects must be phased according to the approved 1/500 planning, not phased according to the progress of site clearance and land allocation, while this is the main reason for multiple land allocations in projects.
“Therefore, the Provincial People's Committee should consider promptly handling each project in a planned manner. At the same time, it is necessary to reach agreement among relevant departments, agencies, and sectors, and submit to the Provincial People's Committee for promulgation of regulations on land division, transfer, change registration, and issuance of sub-books from block books to qualified enterprises,” Mr. Bao proposed.
Project must be phased from the early stages
Vice Chairman of Quang Nam Provincial People's Committee Tran Nam Hung said that project phasing is very normal, but it must be done right from the beginning of the project.
Up to now, the projects that have been implemented and are still in progress cannot be divided into investment phases. This also cannot adjust the investment policy, because there is not enough legal basis.
Regarding the proposal of enterprises on granting individual red books by block, according to current legal regulations, Mr. Hung said that no enterprise has been granted individual red books.
According to Mr. Hung, if enterprises have paid but the money is still in the temporary account, they have not yet paid into the budget to fulfill their financial obligations. For the current land price, if it is newly established, we need to wait for more time.

“Both the old and new land laws require the completion of infrastructure in accordance with the approved 1/500 detailed planning. The province has calculated a plan. For group 1, which are enterprises that have fulfilled their financial obligations and completed their infrastructure, the handling direction is that the province will accept the money that enterprises deposit into the temporary holding account as collateral. If the enterprises commit to fully implement and pay, the State will issue the certificate. The provincial People's Committee will report to the Provincial Party Committee Standing Committee on this issue,” said Mr. Hung.
The second group is enterprises that have fulfilled their financial obligations but have not completed the approved 1/500 infrastructure, then the enterprises will not be allowed to separate the land plots and issue certificates. If this group of enterprises has completed 80% of the infrastructure, the Provincial People's Committee will report to the Provincial Party Committee Standing Committee and present a plan to issue certificates.

Chairman of Quang Nam Provincial People's Committee Le Van Dung recommended that enterprises and sectors focus on researching and implementing regulations, especially the new Land Law.
Mr. Dung requested that the parties need to implement in the fastest, most responsible, most effective, legal way and not make things difficult for each other. At the same time, unnecessary administrative procedures must be cut down but still ensure compliance with regulations.
