The Ministry of Home Affairs has just responded to people's questions about policies for officials and civil servants when streamlining the apparatus.
Accordingly, Ms. Hai Yen wondered, Ms. Hai Yen's father was born in December 1975, is a civil servant who worked in an area with particularly difficult socio-economic conditions, and paid social insurance from November 1998 to the end of February 2020. In total, Ms. Yen's father worked in an area with particularly difficult conditions for nearly 22 years.
Since March 2020, Yen's father has been "relocated". In this restructuring, Yen's father is expected to be in the group of streamlined cadres.
Ms. Yen asked, what allowances and subsidies will her father receive if he works in a particularly difficult economic area as above, and what will the benefit level be if he retires early when the apparatus is reorganized according to the provisions of Decree No. 178/2024/ND-CP of the Government?
Regarding this issue, the Ministry of Home Affairs said: "Clause 6, Article 5 of Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in the implementation of organizational arrangement of the political system clearly stipulates how to determine salary to calculate policies and regimes".
According to Clause 6, Article 5 of Decree No. 178/2024/ND-CP (amended and supplemented in Clause 3, Article 1 of Decree No. 67/2025/ND-CP), the current monthly salary to calculate policies and regimes when leaving work during the process of restructuring the apparatus is the salary of the month immediately preceding the leave.
In which, salary includes: Salary level according to rank, level, position, title, professional title or salary level according to agreement stated in labor contract; salary allowances and salary reserve difference coefficient (if any) according to regulations of law on salary.
Salary allowances here include: Leadership position allowance; seniority allowance beyond the framework; seniority allowance; preferential allowance by profession; responsibility allowance by profession; public service allowance; allowance for party work, political and social organizations; special allowance for armed forces.
The above allowances do not include regional allowances or special allowances in areas with particularly difficult socio-economic conditions.
Therefore, Ms. Yen's father can base on his specific case to determine the regime and policy when leaving work due to organizational reorganization.
