On August 6th, the Office of the People's Committee of Nam Dinh province issued a Notice summarizing the conclusions of the Standing Vice Chairman of the People's Committee, Tran Anh Dung, following the provincial conference on the implementation of the 2024 Land Law and its guiding documents. This notice included many points directly related to individuals and organizations using land in the localities.

Based on the policy contents and new points of the 2024 Land Law and its implementing guidelines; and based on Plan No. 62/KH-UBND of the People's Committee of Nam Dinh province (issued on April 11, 2024), the Standing Vice Chairman of the People's Committee of Nam Dinh province requested relevant departments and agencies to focus intensely and urgently research and finalize the assigned regulations to ensure the Law is implemented promptly, minimizing delays and policy disruptions, facilitating state management, and protecting the rights of businesses and citizens.
The leaders of the People's Committee of Nam Dinh province noted that, regarding regulations on land recognition limits for residential land; land allocation limits for residential land; minimum area and conditions for land subdivision and consolidation; land allocation limits for agricultural land; limits for receiving transfers of agricultural land; and other types of documents for land users before October 15, 1993, applicable in Nam Dinh province, it is necessary to remove from the regulations any content that is not rigidly stipulated in laws, decrees, or circulars, or which, after consultation with many other localities, is not applied. This is to create convenience and avoid the 발생 of petitions and complaints from the people as has happened in the past.

With the development and issuance of detailed guidance documents for the 2024 Land Law, the leaders of the Provincial People's Committee assigned the Department of Natural Resources and Environment to finalize and submit to the Provincial People's Committee for promulgation in August 2024 several contents, including: regulations on the limit for recognizing residential land; the limit for allocating residential land; the minimum area and conditions for land subdivision and consolidation; the limit for allocating agricultural land; the limit for receiving transfers of agricultural land and other types of documents of land users before October 15, 1993, applicable in Nam Dinh province; and regulations on some specific points regarding compensation, support, and resettlement when the State recovers land in the province.
"The drafting process can apply streamlined procedures to ensure synchronization and bring the Land Law into practice as soon as possible," the document emphasizes the directive from the leaders of the People's Committee of Nam Dinh province.
Regarding regulations on land allocation limits and land area decisions for religious organizations and affiliated religious organizations in the province, the leaders of the Nam Dinh Provincial People's Committee have instructed the Department of Natural Resources and Environment to consult with other localities and seek opinions from the Ministry of Natural Resources and Environment to advise on the drafting of regulations to be submitted to the Provincial People's Committee as soon as possible.
Regarding regulations on compensation and resettlement support, a thorough assessment of the impact on affected individuals is necessary; there should be no policy gaps or situations where people are disadvantaged more than in the past when the State reclaims land.
Essentially, it is necessary to ensure that the total compensation and support for the people is equal to or higher than the current level, and to strengthen the application of other forms of support under the authority of the Chairman of the Provincial People's Committee as prescribed by law.
"It is especially important to carefully study the transitional provisions to ensure a harmonious and scientific policy transition process that does not affect the legitimate rights of those whose land is being expropriated," the leader of the Nam Dinh Provincial People's Committee emphasized.
The Standing Vice Chairman of the People's Committee of Nam Dinh province instructed the Departments of Construction and Finance to urgently finalize and submit to the Provincial People's Committee for promulgation the contents regarding compensation rates for damage to houses, buildings, and construction works attached to land when the State reclaims land, and compensation and support rates for crops and livestock, ensuring compliance with the law, and to submit them to the Provincial People's Committee for promulgation before September 15, 2024.
At the same time, the Department of Planning and Investment is tasked with advising the Provincial People's Committee to submit to the Provincial People's Council for promulgation a legal document stipulating the criteria for deciding on the implementation of bidding to select investors as prescribed in Clause 1, Article 126 of the Land Law and its implementing decrees.
Regarding the Provincial People's Council Resolution deciding to issue the first land price list to be published and applied from January 1, 2026, the Provincial People's Committee leadership assigned the Department of Natural Resources and Environment to advise the Provincial People's Committee to submit it to the Provincial People's Council in accordance with regulations; annually, promptly review and advise the Provincial People's Committee to submit to the Provincial People's Council for decision on adjusting, amending, and supplementing the land price list to be published and applied from January 1 of the following year.
The land price list in Decision No. 19/2023/QD-UBND dated July 21, 2023, of the Provincial People's Committee will continue to be applied until December 31, 2025; based on the actual situation and if necessary, the Department of Natural Resources and Environment is assigned to advise the Provincial People's Committee on adjusting the land price list in Decision No. 19/2023/QD-UBND to conform with the new Land Law and the actual land price situation in the province.
