On August 6, the Office of the Nam Dinh Provincial People's Committee issued a Notice of Conclusion by the Standing Vice Chairman of the Provincial People's Committee, Tran Anh Dung, after the provincial conference on the implementation of the 2024 Land Law and guiding documents, including many points directly related to individuals and organizations using land in localities.

Based on the policy contents and new points of the 2024 Land Law and the documents guiding its implementation; based on the Implementation Plan No. 62/KH-UBND of the Nam Dinh Provincial People's Committee (issued on April 11, 2024), the Standing Vice Chairman of the Nam Dinh Provincial People's Committee requested departments and branches to focus on and urgently study, complete and develop assigned regulations to soon put the Law into practice, minimize delays and policy interruptions, facilitate State management as well as ensure the rights of businesses and people.
The leaders of Nam Dinh Provincial People's Committee noted that, regarding the regulations on land recognition limits; land allocation limits; minimum area and conditions for land plot separation and consolidation; agricultural land allocation limits; agricultural land transfer acceptance limits, and other types of documents of land users before October 15, 1993 applied in Nam Dinh province, it is necessary to remove and not include in the regulations the contents that laws, decrees, and circulars do not strictly stipulate or that, through reference to many other localities, are not applied in order to create convenience and avoid the emergence of petitions and recommendations from people as in the past.

With the development and promulgation of detailed guidance documents on the 2024 Land Law, the leaders of the Provincial People's Committee assigned the Department of Natural Resources and Environment to complete and submit to the Provincial People's Committee for promulgation in August 2024 a number of contents, including: regulations on the limit of recognition of residential land; limit of residential land allocation; minimum area and conditions for land plot separation and consolidation; limit of agricultural land allocation; limit of receiving agricultural land transfer, other types of documents of land users before October 15, 1993 applied in Nam Dinh province; regulations on a number of specific points on compensation, support, and resettlement when the State reclaims land in the province.
"The construction process can apply simplified procedures and processes to ensure consistency and early implementation of the Land Law" - the document emphasized the direction of the leaders of Nam Dinh Provincial People's Committee.
With the regulations on land limits and decisions on land areas allocated to religious organizations and affiliated religious organizations in the province, the leaders of Nam Dinh Provincial People's Committee assigned the Department of Natural Resources and Environment to consult other localities and get opinions from the Ministry of Natural Resources and Environment to advise on the development and submit to the Provincial People's Committee as soon as possible.
With regulations on compensation and resettlement support, it is necessary to carefully assess the impact on affected subjects; there should be no policy gaps or people being disadvantaged more than before when the State reclaims land.
Basically, it is necessary to ensure that the total compensation and support for people must be equal to or higher than the current level, and to increase the application of other forms of support under the authority of the Provincial People's Committee Chairman according to the provisions of law.
“It is especially necessary to carefully study the transitional provisions to ensure a harmonious and scientific policy transition process that does not affect the legitimate rights of people whose land is recovered,” the leader of the Nam Dinh Provincial People's Committee emphasized.
The Standing Vice Chairman of the Nam Dinh Provincial People's Committee assigned the Departments of Construction and Finance to urgently complete and submit to the Provincial People's Committee for promulgation the contents on unit prices for compensation for damage to houses, houses, and construction works attached to land when the State recovers land and unit prices for compensation and support for crops and livestock in accordance with the provisions of law, and submit to the Provincial People's Committee for promulgation before September 15, 2024.
At the same time, the Department of Planning and Investment is assigned to advise the Provincial People's Committee to submit to the Provincial People's Council to issue legal documents stipulating criteria for deciding to conduct bidding to select investors according to the provisions of Clause 1, Article 126 of the Land Law and guiding decrees.
Regarding the Resolution of the Provincial People's Council deciding to issue the first land price list for announcement and application from January 1, 2026, the Provincial People's Committee leaders assigned the Department of Natural Resources and Environment to advise the Provincial People's Committee to submit to the Provincial People's Council in accordance with regulations; annually, promptly review and advise the Provincial People's Committee to submit to the Provincial People's Council to decide to adjust, amend and supplement the land price list for announcement and application from January 1 of the following year.
The land price list in Decision No. 19/2023/QD-UBND dated July 21, 2023 of the Provincial People's Committee shall continue to be applied until December 31, 2025; based on the actual situation and if necessary, the Department of Natural Resources and Environment shall advise the Provincial People's Committee to decide to adjust the land price list in Decision No. 19/2023/QD-UBND above, to comply with the new Land Law and the actual situation of land prices in the province.
