Difficult knots of Khanh Hoa real estate

Khanh Hoa province is making efforts to remove legal bottlenecks that have existed for many years regarding “residential land not forming residential units” and condotel apartments, in order to unblock the flow of real estate types.

After many years of efforts, up to now, Khanh Hoa province has eliminated "residential land not forming residential units" in 15 projects and is actively implementing it for other projects.

Mr. Nguyen Tan Tuan, Chairman of Khanh Hoa Provincial People's Committee, said that previously, such land allocation was not in accordance with regulations, so recently, the province had to "correct the mistake" according to the request of central agencies.

The Song Lo Tourism and Entertainment Area project was once licensed by Khanh Hoa province as "residential land not forming residential units".

Accordingly, for projects that have not been implemented or are in the process of implementation, Mr. Tuan said that the spirit is to solve temporary residence for people so that children can have conditions to go to school. As for projects transferred to secondary investors, Khanh Hoa is waiting for a separate resolution of the National Assembly, based on the conclusion of the Politburo on resolving outstanding issues after inspection and examination...

"With these projects, Khanh Hoa province must wait for the Central Government's opinion, and cannot immediately convert them to residential land when the infrastructure is only arranged for tourist apartments," Mr. Tuan informed.

Not only “residential land does not form residential units”, Khanh Hoa is also in trouble when handling condotel projects. Recently, on July 15, the National Assembly's Supervisory Delegation, led by Ms. Nguyen Thuy Anh, Chairwoman of the National Assembly's Social Committee, Deputy Head of the Supervisory Delegation, Head of Working Group No. 2, worked with the Khanh Hoa Provincial People's Committee on the implementation of policies and laws on real estate market management and social housing development in Nha Trang City from 2015 to 2023.

At the meeting, a representative of Lan Anh Company Limited reported that the Nha Trang City Central Project (Phan Chau Trinh Street, Nha Trang City) of the Company has been completed for 4 years, but up to now, the Department of Natural Resources and Environment of Khanh Hoa province has not yet answered the reason why it did not issue a certificate for the condotel apartment.

Mr. Cao Thanh Vu, Deputy Director of the Department of Natural Resources and Environment of Khanh Hoa province, said that current legal regulations are not clear about the conditions and criteria for granting certificates for non-residential projects. “This is very complicated, forcing us to consult the Provincial People's Committee and ask central agencies many times,” Mr. Vu stated the reality.

According to Mr. Vu, the reason for the Nha Trang City Central project's delay is that before Decree No. 10/2023/ND-CP dated May 20, 2023 of the Government on amending and supplementing a number of articles of the decrees guiding the implementation of the Land Law, the Department of Natural Resources and Environment had no basis to resolve. When applying Decree No. 10/2023/ND-CP to this project, there were also difficulties, because the project's objectives did not reflect the policy of selling or leasing for this type. In the coming time, the Department of Natural Resources and Environment will propose to the Provincial People's Committee to adjust the investment certificate and investment objectives, including the policy of selling apartments to have a basis for granting certificates for each apartment.

The Chairman of Khanh Hoa Provincial People's Committee said that, for tourist apartments, although Decree No. 10/2023/NQ-CP has been issued, Khanh Hoa province has great difficulties in granting assets on land (tourist apartments). Moreover, the granting of certificates for tourist apartments must also be consistent with the project's operating time.

“It is impossible for a 40-story building with 2,000 households to suddenly be converted to residential land. Because if that were the case, where would the cars be parked, how would the residents live, what about healthcare and markets…”, Mr. Tuan stated the reality.

It is known that the People's Committee of Khanh Hoa province has proposed that competent authorities pay attention and soon issue guiding documents so that the province can remove obstacles when granting certificates to real estate buyers in real estate business projects that are not housing development projects.
