On August 1, the Department of Natural Resources and Environment of Dong Nai province announced the results of the inspection of the current land use status and transfer conditions for 1,727 land plots of the Long Duc residential area project.
Residential area of over 16,000 people
Long Duc residential area project (Gem Sky World, Long Duc commune, Long Thanh district) with a scale of 92.2 hectares is invested by Ha An Real Estate Investment and Trading Joint Stock Company (Ha An Company, headquartered in Di An city, Binh Duong).
In September 2019, the People's Committee of Dong Nai province issued a decision to recognize the auction results of land use rights for a planned residential area of 92.2 hectares in Long Duc commune. In June 2020, the People's Committee of Dong Nai province approved the detailed planning at a scale of 1/500 of this residential area.
In September 2020, Dong Nai Provincial People's Committee continued to approve the environmental impact assessment report of the residential area project with a scale of 4,026 apartments and a population of 16,100 people.
To date, Ha An Company has been granted 4,032 certificates/4,032 land plots. Of which, 4,026 land plots with an area of 46.5 hectares of residential land, 4 land plots with an area of 5 hectares of land for the construction of educational and training facilities; the remaining 2 land plots are commercial, service land and land for the construction of medical facilities.
Recently, the Department of Natural Resources and Environment of Dong Nai province, together with departments, branches and localities, inspected the current status of land use and conditions for transferring land use rights at the Long Duc residential area project.

Transfer Eligibility
Field inspection results show that up to now, the entire technical infrastructure system, social infrastructure and service works of the project have been invested in and constructed and have been inspected and accepted by competent authorities according to regulations.
Specifically, regarding technical infrastructure, the construction of traffic works and technical infrastructure of the project has been inspected by the Department of Construction of Dong Nai province for acceptance of completed project items.
Fire prevention and fighting, traffic, electricity and water connections, wastewater treatment facilities, and environmental procedures at the project are inspected, accepted, and licensed by competent authorities.
Regarding social infrastructure and service works, the investor has invested in the complete construction of 7/11 green parks. For the remaining 4 parks adjacent to the two main gates of the project, only the landscape lawn has been implemented by the investor.
According to the detailed construction plan 1/500, the project has 3 educational facilities. Of which, the 1-2 inter-level school with an area of 3 hectares has been completed and put into operation. The remaining two kindergartens with a total area of about 2 hectares have been accepted by the Department of Construction.
In addition, the medical station project and the commercial center project with a total area of nearly 1.2 hectares have also been accepted.
Also according to the Department of Natural Resources and Environment of Dong Nai province, the decision to recognize the results of the auction of land use rights does not require the investor to complete the construction of the house before transferring.
At the same time, the Department of Construction of Dong Nai province determined that the project area is not within the scope of regulation and subject to application according to Decree No. 11/2013/ND-CP of the Government. Therefore, the project is not subject to the case of having to build a house before transferring.
Accordingly, the Department of Natural Resources and Environment of Dong Nai province announced that 1,727 land plots belonging to the Long Duc residential area project invested by Ha An Company are eligible for transfer.
Ha An Company was once fined 900 million VND.
In October 2023, Dong Nai Provincial People's Committee issued a decision to administratively fine Ha An Company VND 900 million for mobilizing capital in violation of regulations.
Previously, the Construction Department Inspectorate worked with Ha An Company regarding the illegal capital mobilization, showing signs of violating the law on real estate business at the Long Duc residential area project.
Ha An Company provides consulting, deposit, real estate brokerage agreements, real estate transaction contracts with customers for the company's products: townhouses, garden townhouses, semi-detached villas, single villas...
According to the report, the company has had consulting transactions and deposit agreements with 2,303 customers. The purpose is to raise capital to implement the project when it does not meet the conditions to put it into business.
According to the Department of Construction of Dong Nai province, this is an act of capital mobilization that is not in accordance with regulations, violating the law on real estate business.
