Elon Musk believes that OpenAI and CEO Sam Altman have put commercial interests above the public interest.

Musk claimed that he was lured and deceived by Altman and current OpenAI President Greg Brockman into co-creating the company with the promise that "it would be safer and more open than the profit-driven tech giants." After investing, Musk felt betrayed because Altman, along with other co-founders, and Microsoft established a network of OpenAI subsidiaries and operated for profit.

Musk's lawsuit asks a federal court in California to rule that OpenAI's license to Microsoft to use its AI models is invalid. He argues that OpenAI's large language models should be outside the scope of the partnership with Microsoft.

Previously, at the end of February, Musk also submitted a similar lawsuit but later withdrew it.

The lawsuit also accuses Microsoft of participating in this by seeking to profit, enticing OpenAI to use and then become dependent on its cloud computing system.

Sam Altman, OpenAI and Microsoft have yet to comment on the lawsuit.
