According to lawyer Nguyen Thanh Cong (of the Ho Chi Minh City Bar Association), military service is a citizen’s duty, honor, and responsibility. Studying and training in the army is a good condition for young people to cultivate the necessary qualities and personalities to meet the requirements of defending the Fatherland and building the country.

According to Decree 27/2016/ND-CP, citizens who perform military service will not receive a salary, but will receive a one-time discharge allowance, job creation allowance, travel allowance, and travel allowance for discharged non-commissioned officers and soldiers.

"Because receiving salary requires a labor contract, which means that the labor relationship and salary payment between the employer and the employee arise. As for citizens doing military service according to the 2015 Law on Military Service, military service is the honorable duty of citizens serving in the People's Army.

This is the responsibility of every citizen towards the Fatherland to contribute to protecting the independence, sovereignty, unity, and territorial integrity to build and develop the country. When young people meet the conditions prescribed by law, they must participate in performing military service," lawyer Cong analyzed.

According to regulations, the term of service in peacetime for non-commissioned officers and soldiers is 24 months. After being discharged from the army, non-commissioned officers and soldiers will receive job creation allowances , travel allowances, and one-time social insurance benefits... according to Article 7 of Decree 27/2016/ND-CP.

Accordingly, non-commissioned officers and soldiers upon discharge from the army will receive a one-time discharge allowance, with each year of military service being subsidized equal to 2 months of basic salary according to Government regulations at the time of discharge.

If there are odd months, it is calculated as follows: less than 1 month is not entitled to demobilization allowance; from 1 month to 6 months, the allowance is equal to 1 month of basic salary. From 6 months or more to 12 months, the allowance is equal to 2 months of basic salary.

As for non-commissioned officers and soldiers who have served in the army for 30 months, when they are discharged from the army, they will receive an additional 2 months of their current military rank allowance. If they are discharged before the 30-month period, they will receive an additional 1 month of their current military rank allowance for the time they have served in the army from the 25th month to under 30 months.

Non-commissioned officers and soldiers who have completed their military service as prescribed by the Law on Military Service, upon discharge from the military, will receive a job creation allowance equal to 6 months of the basic salary as prescribed by the Government at the time of discharge.

Non-commissioned officers and soldiers upon discharge from the army will have a farewell meeting organized by their direct management unit before discharge, with a cost of 50,000 VND/person. The unit will see them off and take them back to their place of residence according to regulations or provide train or car fare (common type) and travel allowance from the unit to their place of residence.

Thus, according to Article 3 of Decree 73/2024/ND-CP, the current basic salary is 2,340,000 VND/month. Citizens participating in military service after completing 2 years of service, citizens receive a job creation allowance equal to 6 months of basic salary of more than 14 million VND.

As for non-commissioned officers and soldiers who have served for 2 years, after being discharged from the military, they will receive a one-time discharge allowance equal to 2 months of basic salary, about 4.6 million VND. In addition, after completing their military service, citizens will receive a number of other payments such as: insurance benefits, travel allowances, etc.

Military service is treated with many benefits.

Article 49 of the Law on Military Service 2015 stipulates the policies and regimes for citizens during the period of military service registration. For citizens working at agencies and organizations during the period of military service registration, military service health examination and check-up, they will be paid full salary, travel expenses and current allowances.

For citizens who come to register for military service, medical examination and check-up, they are guaranteed food and accommodation during the registration, medical examination and check-up period, and round-trip travel expenses.

In addition, non-commissioned officers and soldiers upon discharge are also treated with many policies and regimes according to Article 8 of Decree 27/2016, that is, before joining the army, if they were studying or had a call to study at schools belonging to vocational education institutions or universities, their results will be reserved and they will be accepted to study at those schools.

In addition, vocational training is also supported upon discharge. If before enlistment, you were working at a state agency, political organization, or socio-political organization, upon discharge, you will be accepted back, assigned a job, and guaranteed an income no lower than before enlistment.

In case an agency or organization has been dissolved, the direct superior agency or organization is responsible for arranging suitable employment.

If the direct superior agency or organization has been dissolved or there is no direct superior agency or organization, the Department of Labor, War Invalids and Social Affairs with relevant state agencies at the same level will resolve employment.
