Taiwan (China) initiates anti-dumping investigation on cement clinker from Vietnam

Taiwan (China) is the key consumer market for Vietnamese oyster products. Chili exports to Taiwan (China) market increased dramatically by 640%.

According to the Department of Trade Remedies (DTR), Ministry of Industry and Trade, on August 12, 2024, the Department received information that Taiwan (China) had officially initiated an anti-dumping investigation on cement and clinker originating or imported from Vietnam.

Accordingly, the investigated goods: Cement and clinker are classified according to the import commodity codes of Taiwan (China) 2523.29.90.00.2 and 2523.10.90.00.3; The requesting party is the Taiwan Cement Manufacturers Association (China); Initiation date August 8, 2024; Anti-dumping investigation period from July 1, 2023 to June 30, 2024; The alleged dumping margin for Vietnam is 16.99%.

The plaintiff named 7 Vietnamese enterprises. In addition to these 7 enterprises, there are other enterprises that also export the investigated goods to Taiwan (China).

Investigation procedure: Taiwan (China) investigation agencies include the Ministry of Finance (MOF) and the Ministry of Economic Affairs (MOEA). Of which, MOF is the competent authority to investigate dumping behavior, MOEA is the authority to investigate the damage to the domestic production industry.

Accordingly, MOF will select the investigation sample to calculate the dumping margin. The selected Vietnamese exporting enterprises are considered as mandatory defendants and must participate in the case, answer the Investigation Questionnaire and provide information as requested by MOF. These enterprises are taxed separately depending on the information and data provided.

Within 20 days from the date of issuance of the notice of initiation, all 7 enterprises named and other unnamed manufacturing and exporting enterprises must submit confirmation of participation for the purpose of sampling. Enterprises concerned but not submitting confirmation of participation will be assessed dumping margins based on the information of the Requesting Party or other available information.

MOF and MOEA will coordinate the investigation according to their authority, issue preliminary conclusions, final conclusions, on-site examinations, and hearings to verify information for decision-making on dumping behavior, injury to domestic production and causal relationship. Within 20 days from the date of initiation, enterprises shall send written comments or provide information on goods and contents of the initiation notice to the address: The Customs Administration (MOF), No.13, Tacheng St., Taipei City 103205, Taiwan.

The Trade Defense Department recommends that the Association and manufacturing and exporting enterprises: Carefully study the Request Document, Initiation Notice and related instructions and regulations; Submit the confirmation form in accordance with the prescribed content and deadline; Cooperate fully and comprehensively to answer the Investigation Questionnaire(s), provide information as requested by the Investigation Agency; Regularly provide information and exchange information with the Trade Defense Department to receive timely support.
