Regulations on inspection, review, systematization and processing of legal documents

The Government has just issued Decree No. 79/2025/ND-CP regulating the inspection, review, systematization and processing of legal documents.

This Decree details Articles 63 and 64 and measures to organize and guide the implementation of the Law on Promulgation of Legal Documents (hereinafter referred to as the Law) on inspection, review, systematization and processing of legal documents.

Do not take advantage of document checking and processing for personal gain.

Decree No. 79/2025/ND-CP clearly stipulates that the inspection and handling of documents must ensure the following principles: Ensuring comprehensiveness, objectivity, publicity, transparency; correct authority, order, and procedures; combining inspection by competent agencies and individuals with self-inspection by agencies and individuals issuing documents; ensuring coordination between relevant agencies.

Ensure not to take advantage of document inspection and processing for personal gain, causing difficulties for the operations of agencies and persons with the authority to issue documents and interfering in the document processing process illegally.

Ensure not to obstruct or cause difficulties for the competent inspection agency, person, or inspection agency during the process of inspecting documents. Promptly inspect when there is a basis for inspecting documents and promptly handle illegal documents.

Ensure compliance with legal regulations on state secret protection in the inspection and processing of documents containing state secret content. Violations during the inspection and processing of documents shall be considered and handled according to the nature and severity of the violation in accordance with legal regulations.

Documents subject to inspection

The Decree stipulates that documents subject to inspection include:

1. Legal documents stipulated from Clause 3 to Clause 14, Article 4 of the Law; legal documents stipulated from Clause 3 to Clause 14, Article 4 of the Law with contents falling within the scope of state secrets as determined by competent persons.

2. Documents showing signs of containing legal norms but not issued with the correct authority, form, order and procedures as prescribed by law, including:

a- Documents of the National Assembly Standing Committee, the President, the Presidium of the Central Committee of the Vietnam Fatherland Front, the Council of Judges of the Supreme People's Court, the Chief Justice of the Supreme People's Court, the Chief Procurator of the Supreme People's Procuracy, the State Auditor General; the Government, the Prime Minister; Ministers, heads of ministerial-level agencies, local authorities at provincial and district levels, and local authorities in special economic-administrative units.

b- Documents of Government agencies; Standing Committee of People's Council, Chairman of People's Council, Chairman of People's Committee at all levels; Chairman of People's Council, Chairman of People's Committee in special administrative-economic units; organizations belonging to or directly under ministries, ministerial-level agencies, Government agencies; specialized agencies under People's Committees at provincial and district levels, special administrative-economic units (or equivalent); local authorities at commune level.

3. Documents guiding the application of legal documents of competent agencies and individuals specified in Clause 1, Article 61 of the Law.

The Decree clearly states 5 contents of document inspection including:

Authority to issue documents.

Content and form of the document.

Procedures for drafting and issuing documents.

Basis for issuance, format, presentation techniques.

Comply with legal regulations on determining state secrets and the level of confidentiality of state secrets in documents containing content within the scope of state secrets.

Legal basis for determining illegal documents

According to the Decree, the legal basis for determining an illegal document is a legal document that ensures the following conditions:

a- Has higher legal effect than the document being examined.

b- In effect at the time of issuance of the inspected document or not yet in effect at the time of issuance of the inspected document but has been approved or signed for issuance and will be in effect before or at the same time as the inspected document.

The Decree also clearly states: The legal basis for determining that a document has errors in the basis for issuance, format, and presentation techniques is the legal document of the competent authority or person regulating this content and ensuring the conditions specified in Point b above.

The Decree takes effect from April 1, 2025.

Regulations on the organization of enforcement of legal documents

The Government issued Decree No. 80/2025/ND-CP on the organization of implementation of legal documents.

This Decree details Clause 3, Article 59 of the Law on Promulgation of Legal Documents on the responsibility for organizing the implementation, monitoring, summarizing, and concluding the implementation of legal documents, reporting, and providing information on the organization of implementation, and monitoring the implementation of legal documents (collectively referred to as the organization of law enforcement).

This Decree stipulates measures to implement the Law on Promulgation of Legal Documents on the Organization of Law Enforcement, including: Procedures for developing and promulgating plans for implementation and monitoring the implementation of legal documents; procedures for guiding the application of legal documents, providing professional guidance on the implementation of legal documents; collecting information on the implementation of legal documents; inspecting the organization of law enforcement; responsibilities and state management of the organization of law enforcement.

Responsibility for law enforcement

Regarding the responsibility for organizing law enforcement, the Decree stipulates that the Government organizes the enforcement of the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the National Assembly Standing Committee, orders and decisions of the President.

Ministries and ministerial-level agencies organize the enforcement of laws related to sectors and fields nationwide. Organizations under ministries and ministerial-level agencies advise on state management or assist the Minister or Head of a ministerial-level agency in performing state management according to sectors and fields, and advise the Minister or Head of a ministerial-level agency in organizing the enforcement of laws related to sectors and fields under the state management functions of the ministry or ministerial-level agency.

Government agencies organize the enforcement of laws in their assigned sectors and fields. Legal organizations in government agencies preside over, advise, and assist heads of government agencies in organizing the enforcement of laws in their assigned sectors and fields.

People's Committees at all levels organize law enforcement in their localities. Specialized agencies and other administrative organizations under People's Committees at all levels advise and assist People's Committees in organizing law enforcement related to state management functions in sectors and fields in their localities.

State management of law enforcement organization

The Decree stipulates that the Government, within the scope of its tasks and powers, shall uniformly manage the State in organizing law enforcement.

The Ministry of Justice assists the Government in performing state management of law enforcement, with the following tasks and powers: Developing and perfecting laws on law enforcement; directing, monitoring, guiding, training, fostering professional expertise, inspecting and urging ministries, ministerial-level agencies, government agencies, and provincial People's Committees on law enforcement work; building and operating the Information System for receiving and handling feedback and recommendations on legal documents; guiding the management, exploitation, and use of the Information System for receiving and handling feedback and recommendations on legal documents in accordance with the provisions of law; synthesizing and reporting to the Government on law enforcement; building material facilities, perfecting the organization, and allocating resources to implement law enforcement.

Ministries and ministerial-level agencies, within the scope of their functions and tasks, have the following tasks and powers: Coordinate the implementation of the task of developing and perfecting laws on law enforcement; direct, monitor, guide, train, foster professional skills, inspect and urge ministries, ministerial-level agencies and provincial People's Committees on law enforcement related to sectors and fields; coordinate the management, exploitation and use of the Information System for receiving and processing feedback and recommendations on legal documents; synthesize and report on law enforcement related to sectors and fields nationwide; build material facilities, improve organization and allocate resources to implement law enforcement related to sectors and fields nationwide.

Government agencies, within the scope of their functions and tasks, have the following tasks and powers: Coordinate the implementation of the task of developing and perfecting laws on law enforcement; synthesize and report on law enforcement in assigned sectors and fields; build material facilities, improve organizations, and arrange resources to implement law enforcement in assigned sectors and fields.

People's Committees at all levels, within the scope of their functions and tasks, have the following tasks and powers: Coordinate the implementation of the task of developing and perfecting laws on law enforcement; direct, monitor, guide, train, foster professional skills, inspect and urge specialized agencies, other administrative organizations, and lower-level People's Committees on law enforcement in the locality; coordinate the management, exploitation and use of the Information System for receiving and processing feedback and recommendations on legal documents; synthesize and report on law enforcement in the locality; build material facilities, improve the organization, and arrange resources to implement law enforcement in the locality.

The Decree takes effect from April 1, 2025.

Rename Vietnam Oil and Gas Group to Vietnam National Industry and Energy Group

Deputy Prime Minister Ho Duc Phoc signed Decision No. 733/QD-TTg dated April 9, 2025 of the Prime Minister on renaming the Vietnam Oil and Gas Group to the Vietnam National Industry and Energy Group. The Decision clearly states: Agree to rename the Vietnam Oil and Gas Group according to the Group's proposal, specifically as follows:

Full name: Vietnam National Industry and Energy Group.

Business type: Single member limited liability company.

Trading name: Vietnam National Industry and Energy Group.

International transaction name: Vietnam National Industry - Energy Group.

Abbreviation: PETROVIETNAM, abbreviated as PVN.

Vietnam National Oil and Gas Group (Petrovietnam) inherits all rights, obligations and responsibilities of Vietnam Oil and Gas Group as prescribed in the 2022 Petroleum Law and current legal documents; Agreements, documents, agreements and Contracts signed with relevant parties as prescribed by law.

The above Decision takes effect from April 9, 2025.

Conclusion of the Government Standing Committee on the results of inspection and supervision by the Inspection Teams to review and remove difficulties and obstacles related to key traffic projects scheduled to be completed in 2025 to achieve the target of 3,000 km of expressway

The Government Office has just issued Notice No. 168/TB-VPCP concluding the Government Standing Committee's conclusions on the results of inspections and urging of inspection teams to review and remove difficulties and obstacles related to key traffic projects scheduled to be completed in 2025 to achieve the target of 3,000 km of expressways.

The concluding announcement stated that the 13th National Party Congress set a target of completing 5,000 km of expressways by 2030. The Prime Minister launched the emulation movement "500 days and nights of emulation to complete 3,000 km of expressways" to complete 3,000 km of expressways by 2025 - this is an especially important political task that must be completed.

Currently, the competent authorities, investors, and contractors of the projects are reviewing and building detailed construction schedules for the projects, having creative solutions to speed up the progress to compensate for the delayed construction volume (such as changing the loading method, resolving procedures for granting material mines, site clearance, etc.), and are committed to ensuring the completion of the project on schedule.

The National Assembly and the Government have approved a growth target of over 8% in 2025 and double-digit growth in the period 2026 - 2030. To achieve this growth target, it is necessary to promote public investment, focusing mainly on transport projects. Investment in transport infrastructure development will contribute to achieving multiple goals: disbursing public investment capital, opening up new development spaces, urban areas, industrial parks, and service areas for localities, creating jobs for people and businesses, increasing land value, facilitating investment promotion, reducing logistics costs, and increasing the competitiveness of goods and the economy. Therefore, it is necessary to accelerate, make breakthroughs, and have solutions to urge and promote investment in the context of changing growth targets.

Appoint a Deputy Minister in charge of each project.

The Prime Minister has established 7 Inspection Teams to review and remove difficulties and obstacles related to key transport projects scheduled to be completed by 2025 to achieve the target of 3,000 km of expressways. Through the results of the 7 Inspection Teams of the Deputy Prime Ministers, the projects have had more positive changes.

On behalf of the Government, the Prime Minister commended the provinces of An Giang, Tien Giang, Ben Tre, Dong Nai, Dong Thap, and Vinh Long for actively handling procedures for granting mines for projects in the region. The Prime Minister requested relevant agencies to continue promoting and implementing tasks until the projects are completed and put into use, ensuring the goal of opening the North-South expressway from Cao Bang to Ca Mau by 2025.

The Prime Minister requested the Ministry of Construction and relevant ministries and branches to assign a Deputy Minister in charge of each project, proactively and promptly inspect and resolve problems. Ministries, localities and contractors must immediately handle bottlenecks and take appropriate measures; promptly report to competent authorities to resolve problems beyond their authority; all for the benefit of the nation and people; attach importance to the fight against waste, corruption and negativity in the implementation process.

Localities must mobilize the entire political system to complete the work of site clearance and material supply, not to continuously "slip" the completion progress as committed and determine this as a criterion for evaluating cadres. When implementing compensation, support and resettlement, it is necessary to flexibly apply policies so that people are not disadvantaged, ensuring that new housing is better than or equal to the old housing; paying attention to people's livelihoods; special subjects must have special policies; the ultimate goal is to ensure a prosperous and happy life for the people in accordance with the policies of the Party and the State.

Projects in the Southwest and Southeast regions need to complete roadbed work before the rainy season.

Regarding the group of projects that are still facing many difficulties and whose progress has not met the set plan (including 10 projects/291km planned to be completed in 2025 (Ministry of Construction 1 project/18km; localities 09 projects/273km) and 2 projects Huu Nghi - Chi Lang and Dong Dang - Tra Linh striving to be completed in 2025:

The Prime Minister requested localities and investors to urgently coordinate to handle problems related to site clearance, relocation of technical infrastructure and increasing the capacity of material mines as reported by the Ministry of Construction.

Investors, consultants, and contractors update the construction progress, clearly identify the "critical" road (must have solutions to compensate for the delayed volume, reserve time in case of unfavorable weather conditions, especially for projects in the Southwest and Southeast regions that need to complete the roadbed before the rainy season); increase human resources, construction machinery and equipment, and financial resources to organize construction in 3 shifts and 4 teams to ensure the completion of projects by 2025 according to the set plan, with the following specific tasks:

a- Provinces with a large volume of site clearance such as Dong Nai (Bien Hoa - Vung Tau), Khanh Hoa (Khanh Hoa - Buon Ma Thuot), Tuyen Quang (Tuyen Quang - Ha Giang), Binh Duong (Ho Chi Minh City Ring Road 3), Quang Tri (Van Ninh - Cam Lo) focus on directing completion before April 15, 2025 and must not delay the progress.

b- The provinces of Dong Nai, Khanh Hoa, Dak Lak, Lang Son, Binh Duong, and Long An coordinate with Vietnam Electricity Group (EVN) to complete the relocation of high-voltage power lines without affecting the construction progress.

c- Da Nang City (Hoa Lien - Tuy Loan project) and Ha Giang province (Tuyen Quang - Ha Giang project) speed up licensing procedures, increase capacity of quarries, to be completed no later than April 15, 2025.

d- Long An Province (Ho Chi Minh City Ring Road 3) speeds up the implementation of the interchange with Ben Luc - Long Thanh Expressway to ensure synchronous exploitation of 20km of Ben Luc - Long Thanh project on April 30, 2025 (expected April 19, 2025).

d- Tuyen Quang, Ha Giang (Tuyen Quang - Ha Giang project), Dong Thap (Cao Lanh - An Huu project) provinces proactively coordinate with the Ministry of Finance in supplementing capital for the project to complete in 2025.

e- Lang Son (Huu Nghi - Chi Lang) and Cao Bang (Dong Dang - Tra Linh) provinces direct investors to resolutely implement to ensure completion in 2025.

g- Ho Chi Minh City and the provinces of Dong Nai, Binh Duong (Ho Chi Minh City Ring Road 3 project), Dong Thap (An Huu - Cao Lanh), Tuyen Quang (Tuyen Quang - Ha Giang) review the progress, take the initiative in material sources, have appropriate and effective technical solutions, do not delay the project completion progress; be responsible to the Government and the Prime Minister for the implementation results.

h- Localities coordinate with the Investor to confirm the actual damage to houses due to the impact of construction to pay compensation to ensure the legitimate rights of the people, comply with regulations, avoid complaints and lawsuits that cause insecurity and disorder in the area. In addition, strictly handle according to the provisions of law against opposing subjects that cause insecurity and disorder.

i- Localities should strengthen propaganda and mobilize people to accompany, share, support, and create conditions for units to take advantage of good weather to construct "3 shifts, 4 shifts"; throughout holidays and Tet holidays; in the spirit of "eating quickly, sleeping quickly", "overcoming the sun, overcoming the rain, not losing to storms" to complete on schedule; at the same time, requiring construction units to have reasonable construction solutions to limit the impact on people's lives and health during overtime construction at night.

The Government Office has just issued Document No. 2976/VPCP-CN dated April 9, 2025 conveying the direction of Prime Minister Pham Minh Chinh on inspection activities for oversized and overloaded vehicles.

The document stated: Considering the report of the Ministry of Construction in Official Dispatch No. 1024/BXD-KHCNMT&VLXD dated March 26, 2025 on the press's reflection on the congestion in the inspection of oversized and overloaded vehicles, Prime Minister Pham Minh Chinh assigned the Ministry of Construction to continue to direct and support inspection facilities to perform well the inspection of road motor vehicles in general and oversized and overloaded vehicles in particular, to avoid congestion in inspection activities, causing difficulties for people and businesses./.
