Mr. Dinh Xuan Duong, Chairman of Xuan Khang Commune People's Committee at the illegal construction site that has just been demolished.
According to the petition sent to Thanh Hoa Newspaper, Mr. Le Dinh Dung's household in Dong Hon village arbitrarily built a wood drying kiln with an area of about 18 square meters and a 12 meter long surrounding wall on the land managed by the People's Committee of Xuan Khang commune. The encroachment and illegal construction of Mr. Dung's household violated the law on land management, seriously affected the environment, generated noise, and especially obstructed the drainage system of households in the neighboring residential area.
Faced with the above situation, on October 7, 2021, people in Dong Hon village sent a petition to the People's Committee of Xuan Khang commune and the People's Committee of Nhu Thanh district requesting intervention to handle the matter. On the same day, the People's Committee of Xuan Khang commune inspected, verified the violation and drew up a record of administrative fines for Mr. Dung's household. At the same time, Mr. Dung's family was required to restore the original status of the encroached land. Although he had paid a fine of 2.5 million VND, Mr. Dung's household did not dismantle the illegal construction and continued to maintain illegal wood drying activities. On November 15, 2021, people continued to file a petition to reflect the incident. On November 26, 2021, the People's Committee of Nhu Thanh district issued a document requesting the People's Committee of Xuan Khang commune to completely handle the incident. Then, on December 20, 2021, after checking and confirming the violation of Mr. Dung's household, the police of Nhu Thanh district requested the People's Committee of the commune to supervise and request the household to dismantle the violating construction...
Despite the instructions of the authorities at all levels, Mr. Dung's family still did not comply with the demolition, and even continued to expand the wood drying activities, making public opinion even more indignant. Most recently, on February 10, 2025, the people of Dong Hon village once again sent a petition to the authorities at all levels asking for intervention. Mr. Nguyen Quang Cuong, in Dong Hon village - representative of the households who submitted the petition, said: "The fact that Mr. Dung's family encroached on public land and built illegally is completely clear, has been inspected and punished. However, the violations still persist, have not been completely handled, and are even getting more serious."
According to Mr. Cuong, the act of encroaching on land is strictly prohibited. In particular, public land managed by the State must not be used for the wrong purpose or illegally occupied. Mr. Dung's household arbitrarily built a construction on land managed by the People's Committee of Xuan Khang commune, which is a violation of land law. In this case, the violator does not voluntarily take remedial measures, the local government has the right to forcibly dismantle the illegal construction according to the process.
Speaking with Mr. Dinh Xuan Duong, Chairman of Xuan Khang Commune People's Committee, he said: "The violation has lasted since 2021. Immediately after receiving the petition, the Commune People's Committee conducted an inspection and dismantled the violating construction. There is currently a wood sawing machine that has not been relocated, the household has committed to completing the relocation before April 30, 2025, returning the land to the commune for management."
Mr. Nguyen Huy Chung, Deputy Head of the Department of Agriculture and Environment of Nhu Thanh district, confirmed: "The People's Committee of the commune has taken action to dismantle the violating constructions, but the handling has not been thorough. In the near future, the district will establish an inspection team and request the commune to thoroughly handle the violations, ending the situation of people having prolonged petitions."
