This afternoon, August 30, Deputy Prime Minister Tran Hong Ha chaired an online meeting on the drafting of a Decree regulating administrative sanctions for violations in the land sector. Permanent Vice Chairman of the Provincial People's Committee Ha Sy Dong attended the meeting at the Quang Tri provincial bridge.

Reporting at the conference, the representative of the Ministry of Natural Resources and Environment (MONRE) said that the draft Decree regulating administrative sanctions in the land sector consists of 4 Chapters and 36 Articles. Of which, Chapter I, general provisions; Chapter II administrative violations, forms, levels of sanctions and remedial measures; Chapter III authority to sanction administrative violations and Chapter IV implementation provisions.

The basic content of the draft Decree compared to previous regulations will increase the penalty level; add penalties for the act of converting the purpose of land types other than residential land to residential land; add remedial measures to force the transferee to take remedial measures in cases where the land cannot be returned.

The draft Decree also removes the penalty provisions for a number of acts such as: Changing the crop structure on rice-growing land in violation of regulations, using land for other purposes that must be registered but not registered; transferring land use rights in the form of dividing plots for sale in housing construction and business investment projects because the above contents are within the scope of regulation of other Laws. The draft Decree stipulates that the Chairman of the People's Committee at all levels and specialized inspectors shall handle administrative violations.

At the conference, the Ministry of Justice presented a report on the appraisal of the contents of the Draft Decree, focusing on the consistency of the contents of the Draft Decree with the Party's guidelines and policies and the State's policies; the constitutionality, legality, and consistency of the Draft Decree with the legal system.

In addition, the conference also focused on discussing some specific contents of the Draft Decree such as: regulations on violations, measures to implement remedial measures; penalty levels...

Concluding the Conference, Deputy Prime Minister Tran Hong Ha highly appreciated the contributions of central ministries, branches and localities. Based on the contributions of ministries, branches and localities, Deputy Prime Minister Tran Hong Ha assigned the Ministry of Natural Resources and Environment to absorb, supplement and complete the draft. Due to the fact that there are still many different opinions on the draft Decree, the Deputy Prime Minister requested the drafting agency to continue to collect comments and contributions, then submit them to the Government for consideration later.
