Quang Yen is home to long-standing shipyards, along the Bach Dang, Chanh, and Hot rivers. The owners of these shipbuilding and repair establishments have developed techniques for building and repairing fishing boats, from the brown sails of ancient times to modern wooden and iron ships today. However, due to many reasons, the number of establishments that remain and are licensed to operate is not much, estimated at about 30 large and small establishments.
According to Mr. Nguyen Van Thinh, the owner of a shipbuilding facility in Quang Yen, the difficulty and also our violation according to current regulations is mainly the fact that the premises and production area are not enough, not up to standard, and the factory is not in the planning... These are difficulties that we, the professionals, are very aware of and really want to overcome in order to be able to do business long-term, however, it is not easy because there are still many procedures, including procedures that the government does not remove, so we cannot overcome.
It can be seen that in recent times, Quang Yen has attracted many large industrial and urban projects; the economic and spatial development planning of Quang Yen has also shifted from agriculture to industry and services. Therefore, the area of agricultural land and agricultural services has been narrowed, including the area of new fishing boat building and repair workshops, giving way to dynamic projects. From here, many new fishing boat building and repair facilities have had their land revoked, their land leases have expired but have not been re-granted. There are many facilities whose land leases have expired or are still in their land leases but have been notified of land revocation. Some facilities have land use right certificates but the land is garden land for growing perennial crops and have not been converted to non-agricultural production and business land for the purpose of building new fishing boat building and repair workshops. This situation has led to many new fishing boat building and repair facilities operating spontaneously and illegally, not meeting the conditions to be granted a license for a qualified facility to build new fishing boats or convert fishing boats.
It is worth mentioning that the current situation of Quang Yen in managing facilities for building and converting fishing vessels is also the common situation of many localities in the province. In a recent inspection conducted by the Department of Agriculture and Environment, it was found that at the time of inspection, the inspection team of 29 facilities for building, converting and repairing fishing vessels in the localities of Quang Yen, Tien Yen, Dam Ha, Hai Ha and Van Don, only 9 of which were licensed to operate, the remaining 20 were not qualified to operate. The violations committed by the facilities for building, converting and repairing fishing vessels were mainly the expiration of the land lease term or the remaining land lease term but there was a notice of land revocation; not converting from perennial garden land to non-agricultural production and business land; not having a double crane or a single crane with a total tonnage of at least 25 tons; not fully recording according to the forms of the quality management system standards; not having a business registration certificate; No records of waste treatment and collection...
The violation of not having records, contracts, plans for handling and collecting waste and waste from fishing vessel construction and repair activities is a common violation that fishing vessel construction and repair facilities all commit. According to the Department of Agriculture and Environment, this violation has not properly implemented the regulations on classification, collection, transportation, burial, and disposal of ordinary solid waste as prescribed in Article 81 of the Law on Environmental Protection 2020 and Article 16 of Decree No. 38/2015/ND-CP dated April 24, 2015 of the Government and violated the provisions of Article 15, Article 26 of Decree No. 45/2022/ND-CP dated August 25, 2022 of the Government; Circular No. 36/2015/TT-BTNMT dated June 30, 2015 of the Ministry of Natural Resources and Environment on hazardous waste management.
The above situation shows that localities need to strengthen planning and construction management, land use management, not to allow more fishing vessels to arise in the area without written approval from competent authorities, and resolutely handle cases of intentional violations. From another perspective, localities need to arrange planning locations for new building, conversion and repair facilities for fishing vessels to ensure convenience for facilities to operate stably and long-term. On the part of state management agencies, the core is the Department of Agriculture and Environment, which needs to coordinate with the People's Committees of localities with seas to guide facility owners to carry out procedures so that the construction, conversion and repair of fishing vessels comply with legal regulations. Above all, the owners of new building, conversion and repair facilities need to fully comply with legal regulations appropriate to the type of shipbuilding (on planning, land, fisheries, environmental sanitation, etc.) to ensure compliance with legal regulations. Only then can Quang Ninh develop sustainable and high-value fisheries, contributing to the goal of preventing and combating IUU fishing.
