According to the newly issued decision, which will take effect from April 20, 2025, the rice-growing land area permitted for construction must be concentrated and have a minimum area of 50 hectares.
Regarding construction area, the total land area for construction is regulated at a maximum rate of no more than 0.1% of the total area of rice-growing land allowed for construction, but in no case must it exceed 500m2.
Notably, the decision allows constructions to be built at one or more different locations in the rice-growing area, but the total area must not exceed the regulations. These constructions must also comply with the National Technical Regulation on Construction Planning QCVN 01:2021/BXD and other relevant legal regulations.
Regarding the purpose of use, the constructed works must serve one of the purposes specified in Clause 6, Article 3 of Decree No. 112/2024/ND-CP on rice-growing land. These purposes must all be directly related to agricultural production activities.
The decision also sets out strict requirements for the protection of rice-growing land. Specifically, the land plot or rice-growing area permitted for construction must have been granted a valid land use right certificate or be eligible for a certificate according to the provisions of law.
Another important point is that when dismantling or moving the construction, it must not destroy the necessary conditions for the land to return to its original rice-growing purpose. Compensation and support when dismantling construction works will be carried out in accordance with the provisions of law at the time of implementation.
To ensure effective implementation, the People's Committee of Thanh Hoa province assigned the Department of Agriculture and Environment to preside over and coordinate with the Department of Construction and relevant units to organize, monitor and inspect the implementation of the Decision. The People's Committees of districts, towns and cities are required to strengthen the management and supervision of the use of land areas for construction works and must be responsible to the Provincial People's Committee if there is any violation of the law in the area under their management.
The People's Committees of communes, wards and towns are responsible for disseminating and popularizing the Decision to organizations, individuals and users of rice-growing land in the management area, and at the same time managing, inspecting, supervising and establishing records to monitor the use of land area to build works directly serving agricultural production.
