After Circular 29/2024 officially takes effect, centers and tutoring facilities will gradually complete business registration procedures to continue operating. Also in this circular, the Ministry of Education and Training clearly stipulates the extracurricular tutoring program, teachers need to pay attention.

Extracurricular tutoring program

Article 6 of Circular 29/2024 stipulates that organizations or individuals organizing extra teaching and learning activities outside of school that collect fees from students must register their business in accordance with the provisions of law.

At the same time, publicly announce on the electronic information portal or post at the location of the tutoring facility the subjects that are taught extra; the duration of extra teaching for each subject by grade level; the location, form, and time of organizing extra teaching and learning.

Centers also need to publicize the list of tutors and tuition fees before enrolling students in tutoring and learning classes.

In addition, extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subjects they teach.

Teachers who are teaching at schools and participate in extra-curricular teaching must report to the Principal or Director or head of the school about the subjects, location, form, and time of extra-curricular teaching.

Along with that, Article 4 of Circular 29/2024 clearly stipulates cases where teachers are not allowed to teach extra classes, including:

• Tutoring primary school students except for arts, sports and life skills.
• Teachers are not allowed to teach extra classes outside for money to their own students who are being taught at school.
• Public teachers are not allowed to participate in the management and operation of extra-curricular teaching but can still participate in extra-curricular teaching.

Based on the above content, it can be seen that extra-curricular tutoring does not strictly prohibit tutoring before the school curriculum. Instead, Circular 29/2024 only stipulates that extra-curricular tutors are not allowed to tutor regular students.

Regulations on tuition fees

The level of tuition fees for extra-curricular study outside of school is agreed upon between parents, students and the tutoring facility. The collection, management and use of tuition fees shall comply with the provisions of the law on finance, budget, assets, accounting, tax and other relevant regulations.

Thus, according to the regulations, there will be no regulations on the maximum or minimum level of tuition fees outside of school, but will be agreed upon between the two parties. The collection, management and use of tuition fees will be carried out in accordance with the provisions of the law on finance, budget, assets, accounting, taxes and other relevant regulations.

In case schools, tutoring facilities, organizations or individuals violate regulations on tutoring and learning, depending on the nature and severity of the violation, they will be handled according to the provisions of law.

At the same time, the head of an agency, organization or unit whose cadres, civil servants or public employees violate regulations on extra teaching and learning, depending on the nature and severity of the violation, shall be handled according to the provisions of law.
