The Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site consists of 6 chapters and 32 articles; effective from May 19, 2025.
The promulgated Ordinance is the highest legal document to date to institutionalize the Party and State's viewpoints and policies on long-term preservation and absolute safety protection of President Ho Chi Minh's body and management and protection of the Ho Chi Minh Mausoleum Relic Site.
The development of the Ordinance aims to complete the legal framework to best perform the task of long-term preservation and absolute safety protection of President Ho Chi Minh's body; promptly overcome limitations and shortcomings to strictly protect and effectively manage the Ho Chi Minh Mausoleum Relic Site in the new situation. At the same time, further promote the political, historical and cultural significance of the Ho Chi Minh Mausoleum Relic Site, contributing to the dissemination of the body, life, career, ideology, morality and style of President Ho Chi Minh.
Regarding the scope of the Ho Chi Minh Mausoleum Relic Site, the Ordinance clearly states that the Ho Chi Minh Mausoleum Relic Site is a complex of works and areas of special political, historical-cultural, national defense and security value, including: Ho Chi Minh Mausoleum and Ba Dinh Square; Monument to Heroes and Martyrs; K9 Relic Site; supporting works serving the long-term preservation and absolute safety protection of President Ho Chi Minh's body.
The scope and boundaries of the above-mentioned works and areas shall comply with Government regulations and relevant laws.
Regarding long-term preservation and absolute safety protection of President Ho Chi Minh's body, the Ordinance clearly stipulates: Long-term preservation and absolute safety protection of President Ho Chi Minh's body, including medical and technical activities for long-term preservation and absolute safety protection of President Ho Chi Minh's body; scientific and technological activities in long-term preservation and absolute safety protection of President Ho Chi Minh's body; inspection and assessment of the state of President Ho Chi Minh's body; the content of ensuring the security and safety of President Ho Chi Minh's body will be assigned to the Minister of National Defense for detailed regulations.
Regarding the management of works and areas in the Ho Chi Minh Mausoleum Relic Site, Section 1, Chapter III of the Ordinance stipulates the establishment of records for the management of works and areas; the management, operation, preservation, maintenance, and technical assurance of works; the maintenance and preservation of space, landscape, architecture, construction activities, and environmental protection in the Ho Chi Minh Mausoleum Relic Site.
The records of management of constructions and areas in the Ho Chi Minh Mausoleum Relic Site are determined to be confidential in accordance with the nature, type, and group of constructions and areas; and are stored, managed, and used in accordance with the provisions of the law on protection of state secrets and the law on archives. The Ho Chi Minh Mausoleum Command shall establish and manage records of constructions and areas in the Ho Chi Minh Mausoleum Relic Site.
Renovation, refurbishment, upgrading and construction investment must be carried out on the basis of detailed construction planning, respecting the original design, architecture and relevant legal regulations.
The protection objectives include the works and areas of the Ho Chi Minh Mausoleum Relic Site and political and cultural activities in the Ho Chi Minh Mausoleum Relic Site.
The specific scope of protection is implemented according to the provisions of specialized laws.
