Building a new decree on safety management of dams and reservoirs

On the afternoon of July 31, Deputy Prime Minister Tran Hong Ha chaired a national online conference on the draft decree replacing Decree No. 114/2018/ND-CP, dated September 4, 2018 of the Government on the safety management of dams and reservoirs (Decree 114).

According to statistics, the country currently has 7,326 irrigation and hydroelectric reservoirs, with a total capacity of 69 billion m3. Of these, there are 6,723 irrigation reservoirs, 552 hydroelectric reservoirs, with a total storage capacity of about 54 billion m3, and a total installed capacity of 22,472 MW.

The draft decree replaces Decree 114 regulating the safety management of dams and reservoirs for dams with a height of 5m or more or reservoirs with a total capacity of 50,000 m3 or more and safety for downstream areas of the dam.

The draft decree consists of 4 chapters and 35 articles. It inherits some contents of Decree 114, Decree No. 62/2025/ND-CP and amends and supplements the main contents of Decree 114. The draft decree has amended and completed 32/35 articles; added contents on requirements for design and construction of dams and reservoirs; reservoir operation procedures; specialized hydrometeorological monitoring and forecasting; protection of dams and reservoirs; flood maps of downstream areas of dams and reservoirs and database systems on dams and reservoirs. In addition, this decree omits some regulations related to safety management of dams and hydroelectric reservoirs; inspection of acceptance of dams and reservoirs; scope of protection of dams and reservoirs. The draft also stipulates 14 administrative procedures, including adding 4 new procedures, amending 11 procedures, abolishing 5 procedures and cutting 1 procedure compared to current regulations.

Speaking at the conference, Deputy Prime Minister Tran Hong Ha said that in recent times, the management of dam and reservoir safety has involved many sectors and been regulated by many laws, revealing overlaps, inadequacies, passivity, and confusion. The issuance of a Decree replacing Decree 114 is very necessary to manage the safety of reservoirs, dams, and regulate water in a unified and centralized manner, overcoming the fragmentation. Therefore, the agency in charge of drafting the decree needs to synthesize and absorb comments from ministries, sectors, localities, and relevant agencies and units to complete the content and submit it to the Government for promulgation. When issued, the Decree must ensure a scientific basis and be highly convincing in order to operate and regulate reservoirs and inter-reservoirs in a synchronous manner. At the same time, it must manage and use water resources safely, economically, and effectively.
