The draft Law dossier is eligible to be submitted to the National Assembly Standing Committee for consideration and comments.
Authorized by the Government to present a summary of the proposal on amending and supplementing a number of articles of the Law on Education, Minister of Education and Training Nguyen Kim Son said:
Draft Law amending and supplementing a number of articles of the amended and supplemented Law on Education 44/115. In addition, 14 articles only remove the name of the Ministry or adjust decentralization and delegation of authority according to Decree No. 190/2025/QH15; 10 articles are abolished because they have been transferred to the Law on Teachers; some technical adjustments (wording, structure) overlap with the articles that have been amended in content or belong to the above group.
Regarding the reduction and simplification of administrative procedures, the draft Law does not specify administrative procedures (on the components of the dossier, order, procedures, and authority to handle each administrative procedure) but only has framework regulations, aiming to orient policies and establish a legal basis for the Government and the Minister of Education and Training to specify details according to their authority.

However, the amended and supplemented provisions in the draft Law still have a direct impact on the amendment, supplementation and replacement of many current administrative procedures being implemented under the 2019 Law on Education.
Specifically, 69/126 administrative procedures affected by the 2019 Education Law will be reduced and simplified according to the provisions of the draft Law.
Regarding decentralization and delegation of power, the draft Law clearly demonstrates the spirit of decentralization and delegation of power in educational management, enhancing the initiative and autonomy of the Ministry of Education and Training, localities and educational institutions, in line with the Party and State's policy on modern, effective and efficient management.
Specifically: Decentralization from the National Assembly, the National Assembly Standing Committee to the Government (3 tasks); decentralization from the Government, the Prime Minister to the Ministry of Education and Training, the Minister (6 tasks); from the Ministry of Education and Training, the Minister and ministries, branches to the Provincial People's Committee, the Chairman of the Provincial People's Committee, the Director of the Department of Education and Training (12 tasks); from the Provincial People's Committee to the Department of Education and Training, the Director of the Department of Education and Training (2 tasks); from the Director of the Department of Education and Training to the principal/educational institution (1 task); and decentralization of authority at the district level (17 tasks).
The Minister also reported on some basic amendments and supplements related to: The national education system; regulations on diplomas and certificates; institutionalization of Party Resolutions on universalizing preschool education for children from 3 to 5 years old, implementing 9-year compulsory education; local educational materials; School councils in public preschools and general schools, etc.
The Draft Law also amends and supplements Chapter IV (Teachers) to "educational personnel" in the direction that specific regulations on teachers will be regulated in the Law on Teachers, the Law on Education will regulate the most general issues on educational personnel (4 groups of personnel: teachers, educational institution managers, educational management staff and support personnel in educational institutions)...

Reporting on the preliminary review of the draft Law amending and supplementing a number of articles of the Law on Education, Mr. Nguyen Dac Vinh, Chairman of the National Assembly's Committee on Culture and Society, said:
The Standing Committee of the Committee basically agreed with the necessity of amending and supplementing a number of articles of the Law stated in the Government's Submission. The draft Law has institutionalized the Party's policies and guidelines, is consistent with the Constitution, and basically ensures unity and synchronization in the legal system and compatibility with relevant international treaties. The draft Law dossier is complete according to regulations and meets the conditions for submission to the National Assembly Standing Committee for consideration and comments.
Mr. Nguyen Dac Vinh also pointed out some issues that the Standing Committee of the Committee requested the drafting agency to pay attention to. Accordingly, it is necessary to continue updating, reviewing, and institutionalizing the policies in the Resolution of the Politburo; reviewing regulations, comparing with relevant laws to ensure the consistency of the legal system and relevant international treaties to which Vietnam is a member.
The report summarizing the implementation of the current Law needs to supplement the summary of the limitations and shortcomings in the implementation of the Law, as a basis for proposing amendments and supplements to a number of articles of the Law; supplementing full explanations of the policies stipulated in the draft Law; supplementing draft documents detailing and guiding the implementation of the Law. Continue to review the regulations on decentralization and delegation of power; and organize state management of education at the commune level after implementing the two-level local government.
Regarding some major contents of the draft Law, the Standing Committee of the Basic Committee basically agreed; at the same time gave specific opinions on: the national education system; diplomas and certificates of the national education system; vocational high school diplomas; general education textbooks; high school graduation exams; school councils; teachers; tuition fees, costs of education and training services; authority, procedures for establishing or permitting establishment; permitting educational activities, suspending educational activities; merging, dividing, separating, dissolving schools...

Strengthening decentralization, delegation of power and ensuring equitable access to education
Appreciating the efforts of the drafting agency and expressing basic agreement with the major contents of the draft Law, members of the National Assembly Standing Committee also gave their opinions on a number of specific contents; focusing on requirements for the submission, textbooks, high school graduation exams, and education linkage, etc.
Welcoming the close coordination of the Ministry of Education and Training and the National Assembly's Committee on Culture and Social Affairs, National Assembly Chairman Tran Thanh Man requested the drafting agency to continue reviewing and closely following the spirit of the resolutions: Resolution No. 57-NQ/TW on breakthroughs in science and technology development, innovation and national digital transformation; Resolution 59-NQ/TW on international integration in the new situation; Resolution No. 66-NQ/TW on innovation in law-making and enforcement to meet the requirements of national development in the new era...; the draft Resolution of the Politburo on breakthroughs in modern national education and training development. The draft Law also needs to ensure consistency with related laws.

The National Assembly Chairman emphasized how to focus on strengthening decentralization and delegation of authority in education management. Policies must ensure fairness in access to education, connectivity in the education system; stream students and organize education levels in accordance with the labor market... Strengthen the socialization of education, so that more domestic and foreign private individuals can participate under the management of the state and the Ministry of Education and Training.
Along with that, perfecting the general education program and textbooks; implementing digital literacy, applying artificial intelligence (AI), digital transformation in education and training. Supplementing regulations on the legal value of vocational secondary school diplomas; supplementing provisions to secure diploma data according to the Law on Cyber Security; adding a roadmap for integrating AI, aiming at automatic diploma authentication, reducing administrative costs. Compulsory education can be expanded to junior high school from 2030; paying attention to policies to support ethnic minority children, such as teaching Vietnamese before grade 1...
Regarding textbooks and local educational materials, according to the National Assembly Chairman, this is an issue that has received great attention from society. He suggested that the drafting agency review and carefully study the implementation of this policy to make adjustments that ensure scientific, economical, effective, and appropriate to the actual situation.
Recalling some major, breakthrough policies from the 2025-2026 school year, such as: Law on Teachers; free tuition for preschool children and primary school students; investment in building schools for border communes... The National Assembly Chairman requested that it is necessary to propagate and mobilize parents to send their children to school, so that no one is left behind.
