Overtime pay regime

Last school year, I was assigned to teach an average of 19 periods/week, then the school assigned me to teach 43 additional local education periods. May I ask, am I entitled to 43 overtime periods? Nguyen Thuy Anh (thuyanh***@gmail.com)

According to Circular No. 05/2025/TT-BGDDT dated March 7, 2025 of the Minister of Education and Training regulating the working regime for general education and university preparatory teachers, the average teaching period per week for junior high school teachers is 19 periods.

Joint Circular No. 07/2013/TTLT-BGDĐT-BNV-BTC dated March 8, 2013 on overtime pay regime clearly states the principle: The monthly salary is the basis for calculating overtime pay for teachers, including: Salary according to current grade, salary allowances and reserve difference coefficient (if any).

Only pay overtime wages in units or departments that lack teachers as approved by competent authorities. In cases where there is no shortage of teachers, payment is only made when someone is absent due to illness, maternity, schooling, or other duties and is assigned by competent authorities and needs another teacher to teach instead. The number of extra teaching hours for which overtime wages are calculated according to the provisions of this Joint Circular shall not exceed the number of overtime hours as prescribed by law.

To be considered for payment of overtime, please report to the school principal and request that the school confirm the shortage of subject teachers, or assign concurrent positions according to the approved plan.

On that basis, the school can carry out the procedure for paying overtime allowance if it meets the prescribed conditions. The method of calculating overtime wages is applied according to Article 4 of Joint Circular No. 07/2013/TTLT-BGDĐT-BNV-BTC.
