The problem of the inspection industry: "The cow is lost" but still not "concerned about building the barn"!

Continuing the 5th Session of the 15th National Assembly, the third working week took place from June 5-11. The focus was on the questioning activity - this is the content that the public is particularly interested in. The National Assembly spent 2.5 days (from June 6 to June 8) to conduct questioning on groups of issues: Labor, war invalids and social affairs; transportation; science and technology; ethnicity.

Talking to reporters on the sidelines of the parliament, National Assembly deputies said that voters and people are looking forward to practical solutions proposed by ministers and industry leaders to quickly resolve difficulties and obstacles for people and businesses in the current context.

Regarding the group of transport issues, National Assembly Delegate Ha Sy Dong (Quang Tri delegation) acknowledged: “It must be said that recently, voters and people are most concerned about the issue of vehicle inspection, a series of violations have occurred, causing public opinion to be upset. Through that, we can see the shortcomings in the management of the industry for a long time. Even when violations have been discovered and handled, there has not been any flexible and suitable solution to stabilize the situation and serve the needs of people and businesses. I think that the handling is very confusing. It is not as bad as the subsidy period, when going for vehicle inspection, we have to go at night, stand in long lines with no place, and even have to turn back... We need to pay attention to resources for this field. But currently, we have not seen the transport industry have a fundamental solution to plug the "loophole" of vehicle inspection. "The cow has been lost" but we still haven't "concerned about building a barn". I hope that the Minister of Transport will come up with specific solutions to remove the existing problems. Inadequacies in this field, there must be a promise to implement a roadmap to resolve them. In addition, it must be thoroughly handled, the apparatus must be clean, transparent, public, and healthy, and cannot be exploited to "distort" the provisions of the law, causing traffic accidents to occur.

Meanwhile, also concerned about the issue of vehicle inspection, National Assembly Delegate Phan Duc Hieu - Standing Member of the National Assembly's Economic Committee stated: “In my opinion, the problem of the vehicle inspection industry is related to the capacity to respond to policies. In general, up to now, the Government has done well in responding to policies. For example, we had a decree on tax simplification, extension, and deferral in the early stages of the COVID-19 pandemic... Therefore, I hope that, with the problem of the vehicle inspection industry this time, the Government will continue to promote that. When we have discovered a problem that has a great impact on society, the speed of response must be very fast. We have had a policy to automatically extend the registration period for vehicles that are due for inspection but because the service capacity does not meet the requirements, they will be "automatically" extended. But I see that, from the time of discussing the policy until now, it has probably been too long and the problem has not been "resolved". We can completely resolve this issue. be resolved quickly, even automatically.

National Assembly Delegate Phan Duc Hieu analyzed: “Currently, according to the draft, it will be handled in an “automatic” direction. As I understand it, if it is “automatic”, it means that people do not have to do any procedures. But if it is “automatic” but people have to register or do any procedures, it is not automatic. That means it will move from one procedure to another and there is a risk of moving from one bottleneck to another, without helping to solve the problem. I really hope that the Government has experience, the Government has done well in responding to policies during the COVID-19 period, many procedures to remove difficulties for businesses and people have been introduced promptly, then this time the Government will also have reasonable and timely solutions”.

Criminal proceedings should be taken against businesses that violate the payment of insurance for employees.

Also speaking to reporters on the sidelines of the National Assembly session, regarding the recent situation where many enterprises owe or evade social insurance payments, it will lead to the risk that employees will have difficulty ensuring social security after retirement and our social security policy system will have difficulty ensuring sustainability, National Assembly Delegate Pham Van Hoa (Dong Thap delegation) said: “When employees work for an enterprise, the enterprise must be responsible for paying social insurance for them by deducting a portion from their salary. Therefore, the fact that enterprises delay or evade social insurance payments has directly affected the lives and rights of employees when they resign.”

To overcome the above situation, Delegate Pham Van Hoa said that the Ministry of Labor, War Invalids and Social Affairs needs to advise the Government to take drastic actions to create all conditions for businesses to return to normal operations after the impact of the COVID-19 pandemic by reforming administrative procedures, supporting capital sources, creating land funds as well as finding markets for products and goods. These actions will contribute to businesses having more orders to maintain and develop production; and on the part of workers, they will have more jobs to stabilize their lives, contributing to reducing the unemployment rate.

In addition, according to Delegate Pham Van Hoa, the Ministry of Labor, War Invalids and Social Affairs needs to consult with the Government to propose sanctions to strictly handle businesses that violate the payment of insurance for employees, not only through administrative sanctions but also criminal sanctions. The authorities need to do this to use it as a form of deterrence for other businesses not to violate.

To limit the increase in workers withdrawing social insurance at one time, Delegate Pham Van Hoa said that the State needs to provide timely support to workers when businesses close or stagnate production and business.

Regarding this issue, National Assembly Delegate Nguyen Thi Viet Nga (Deputy Head of the National Assembly Delegation of Hai Duong Province) said that some solutions have been proposed to improve the inspection, examination and supervision of social insurance payments. However, it is very difficult or impossible for employees to inspect and supervise whether or not the enterprise is paying social insurance for them. Thus, the responsibility belongs to the authorities, first of all to the social insurance agency and the Ministry of Labor, War Invalids and Social Affairs can urge and monitor enterprises to pay insurance for employees.

According to Delegate Nguyen Thi Viet Nga, in reality, we have enough sanctions to deal with businesses that are late in paying or evading social insurance for their employees. However, this situation still occurs partly because the production, business and income of businesses are severely affected by the COVID-19 pandemic.

To support businesses to overcome difficulties, the Government and the National Assembly have had many solutions such as allowing businesses to postpone the mandatory social insurance payment period. The reason why businesses owe or avoid paying social insurance for employees is mainly because they do not really care about the rights of employees but only focus on the profits they earn. If this situation continues to occur and is a burning issue, we must have drastic and strong solutions in inspection work to increase sanctions for businesses that do not properly implement the rights of employees.
