Creating a transparent and attractive legal corridor in the strategic technology sector

Deputy Prime Minister Nguyen Chi Dung emphasized the need to build a clear and attractive legal corridor to promote high technology, digital transformation and innovation in Vietnam.

On the morning of August 14, Deputy Prime Minister Nguyen Chi Dung chaired a meeting to review the contents of draft laws submitted by the Ministry of Science and Technology to the National Assembly at the upcoming 10th Session.

Reporting at the meeting, Deputy Minister Pham Duc Long said that at the 10th Session of the 15th National Assembly, the Ministry of Science and Technology plans to submit to the National Assembly for consideration and approval four draft laws, including the Law on Digital Transformation; the Law amending and supplementing a number of articles of the Law on Intellectual Property; the Law on High Technology (amended) and the Law amending and supplementing a number of articles of the Law on Technology Transfer.

The time to complete and submit the National Assembly Law projects to the National Assembly by August 30 is an extremely big challenge.

In addition, the Ministry of Science and Technology was assigned to preside over the development of another Law project, the AI Law.

Presenting some new contents in the draft laws, Deputy Minister Pham Duc Long said that the Digital Transformation Law project proposes 6 policies: promoting comprehensive digitalization of the real world and virtual reality connection; "Digital Twin" and data from physical-digital infrastructure (IoT).

Accelerate the implementation of digital government and digital transformation of the operations of agencies in the political system. Manage and promote the development of the digital economy, especially the platform digital economy, the digital economy of industries and fields.

Manage and promote the development of digital society according to the definition of digital citizens and regulations on State policies in building and developing digital society.

The draft Law institutionalizes the Party and State's policy on infrastructure development for national digital transformation as stated in Resolution No. 57-NQ/TW. At the same time, it stipulates measures to ensure digital transformation activities such as: finance for digital transformation; statistics, measurement, monitoring (online), evaluation of digital transformation effectiveness; standard digital human resources; standards for digital transformation; data for digital transformation; digital space security.

Regarding the draft Law on High Technology (amended), the basic content includes 6 policies: Completing the concept and criteria of high technology; redesigning the system of policies and beneficiaries of priority policies, incentives, and investment support; encouraging the development of the high-tech ecosystem; supplementing regulations on models of high-tech zones and high-tech cities; supplementing and completing regulations on state management of high technology, management, inspection, supervision and efficiency assessment mechanisms; supplementing regulations on requirements for comprehensive digital transformation of high-tech activities.

The draft Law amending and supplementing a number of articles of the Law on Intellectual Property includes 5 policies: Supporting the creation and commercial exploitation of intellectual property rights to promote innovation; simplifying administrative procedures, facilitating the registration and establishment of intellectual property rights; improving the effectiveness of intellectual property rights protection activities; ensuring full implementation of Vietnam's international commitments on intellectual property protection in the integration process; updating new issues in intellectual property protection in the world in accordance with Vietnam's policies and socio-economic development level.

The draft Law amending and supplementing a number of articles of the Law on Technology Transfer basically focuses on state management, monitoring, statistics, and measuring the effectiveness of technology transfer.

Recognizing this as an opportunity to better summarize and synchronize the legal system on science and technology, Deputy Prime Minister Nguyen Chi Dung assessed that the Ministry of Science and Technology has made efforts to fulfill its tasks; emphasizing that it is necessary to ensure the urgency and quality of the draft laws.

The Deputy Prime Minister pointed out two main difficulties: the progress of implementation and the simultaneous development and amendment of many laws, leading to duplication and possible conflicts between regulations; it is important to note that first of all, the principles, ideas, and goals of law amendment must be clearly defined; the causes, basis for supplementation, and benefits must be assessed for impact.

“It is impossible for a provision to exist in both laws. It is even more impossible for a provision in one law to contradict a provision in another. Therefore, the review must be carried out very carefully,” the Deputy Prime Minister stated.

Assigning specific tasks, the Deputy Prime Minister requested the Ministry of Science and Technology to research and review to fully implement the viewpoints, directions, guidelines and policies of the Politburo; continue to carefully review the difficulties and bottlenecks in various fields in the past time, to propose appropriate and practical mechanisms and policies.

Analyze and evaluate current major trends in the world and refer to successful experiences of other countries. In the field of intellectual property, it is necessary to promote the handling of backlog cases; ensure full implementation of international commitments of which Vietnam is a member.

Deputy Prime Minister Nguyen Chi Dung also emphasized the need to amend mechanisms and policies to create a transparent, stable and attractive legal corridor for investment, production and business activities in the fields of high technology and strategic technology.

In technology transfer, it is necessary to carefully review incentive and support policies; existing problems, obstacles, and inadequacies; on that basis, consider and propose appropriate incentive and support policies, ensuring consistency and suitability in order to continue to improve incentive and support policies, promote research, development, transfer, and mastery of strategic technology, high technology, advanced technology, green technology, and environmentally friendly technology./.
