According to the conclusion of the inspection of the responsibility for state management of planning and implementation of construction planning of the Ho Chi Minh City People's Committee (period from 2015-2022), this unit recommended that Ho Chi Minh City collect 802 billion VND in arrears from projects with land use fee debts.
Collecting hundreds of billions of dong in land use debt from real estate projects
In particular, the social housing project - Van Gia Phuc commercial housing project (District 6) was granted a construction permit by the Department of Construction but recorded the number of floors (excluding the attic floor on the roof) as not in accordance with regulations.
The project did not arrange the kindergarten area according to regulations and the investor has not yet fulfilled financial obligations regarding land with an amount of more than 159 billion VND.
At the Richstar Residence project (Tan Phu district) implemented by Nova Richstar Company (a subsidiary of Novaland), the Government Inspectorate said that the Ho Chi Minh City People's Committee adjusted the planning but did not calculate additional land use fees.
Instead, the city allowed Novaland to temporarily pay 1,083 billion VND for 8 projects in the area, of which the estimated amount for Richstar Residence alone is 242.5 billion VND.
However, this calculation is considered to lack legal basis. The enterprise has not yet fulfilled its financial obligations for the project, with the estimated land use fee of about 446 billion VND.
These are projects that have been handed over but have not completed financial obligations, so people have not been granted pink books; if they complete financial obligations according to the conclusion, people will be granted ownership papers.
In Binh Chanh district, the commercial service center and housing project in Lot F (Tan Tuc town) and An Ha residential area (Pham Van Hai commune) were also named when Western City Company Limited (Lot F project) and Nhut Thanh Joint Stock Company (An Ha project) have not paid the total estimated land use fee of more than 197 billion VND.
Project built without permit
Regarding construction planning, the Government Inspectorate pointed out that at the Tan Thang Sports and Residential Complex project (Tan Phu district), with the commercial name Celadon City, Gamuda Land (a Malaysian enterprise) built a mezzanine floor on the 16th floor apartments that was not in accordance with the construction permit. However, this design was still appraised by the Ministry of Construction and the Ho Chi Minh City People's Committee locally adjusted the detailed planning.
Regarding the construction permit for apartment block A1 under the project's detailed planning adjustment project, the Department of Construction issued the permit but could not determine the construction boundary of the footing. In addition, the investor built 1 to 2 basements in areas A1, A5 and A6 of the project, which were not in accordance with the approved detailed planning.
At the commercial and service apartment project of Gotec Vietnam Co., Ltd. (District 6), the Department of Construction also issued a license that violated regulations on the number of floors. At the same time, the investor arbitrarily added a kitchen to the design of some commercial and service apartments and has not fulfilled its financial obligations for 20% of social housing as prescribed.
Project delays waste capital
The Government Inspectorate pointed out that many projects in Ho Chi Minh City have not been implemented (suspended projects) or are behind schedule.
Typical examples include Binh Quoi - Thanh Da urban area (426.93ha), Tay Bac - Cu Chi urban area (about 6,000ha), Saigon Safari park (about 456ha), Binh Trieu station (about 41ha), Xuyen Tam canal (6.7km long)... According to the Government Inspectorate, slow-progressing projects waste capital, causing traffic jams and prolonged flooding.
