Continuing the program of the 6th Session of the 15th National Assembly, on the morning of November 27, delegates discussed in the hall the draft Law on the Capital (amended) and the Government's reports on: Preliminary summary of the pilot organization of the urban government model in Hanoi and Da Nang cities and the results of 3 years of implementing the organization of urban government in Ho Chi Minh City.
Participating in the discussion at the hall about the draft Law on the Capital (amended), delegate Tran Thi Hong Thanh (Deputy Head of the National Assembly Delegation of Ninh Binh province) agreed with the necessity of promulgating, the purpose, viewpoints on building and the scope of amending the Law.
At the same time, it is believed that the draft content has relatively fully standardized 9 policy groups with many breakthrough and specific contents, inheriting, supplementing and developing more than the 2012 Capital Law.
However, according to the delegate, the Draft has not clearly shown the unique features of the capital's culture, has not clarified the connotation of "Cultural - Civilized - Modern"; the city of heritage, creativity and resources for developing the capital's culture. The solutions, measures, conditions and resources to ensure conservation, the responsibilities of the authorities at all levels in the capital and the central government for the conservation and restoration of relics and heritage have not been specifically stipulated in the draft Law, there have been no adjustments compared to the current Law on Cultural Heritage so that the capital has specific regulations and an earlier implementation roadmap, ensuring immediate handling of urgent issues in the conservation of heritage and culture of Hanoi due to obstacles from current regulations, mechanisms and policies. Therefore, the delegate suggested that it is necessary to review to clearly, fully and specifically stipulate the above contents.
Regarding the development of education and training in the capital (stipulated in Article 24), the delegate said that the Draft does not have specific regulations to remove difficulties in arranging schools and ensuring material conditions for comprehensive education of children's intelligence, physical strength, psychology and spirit, especially in core urban areas and new urban areas with high population density; has not overcome the gap in investment and development of education quality between inner-city, suburban and rural areas; there is no connection in education planning with the overall planning of the capital. The provisions in Clause 2, Article 24 of the draft Law only stop at principles and orientations, while the measures and conditions to ensure implementation, the authority and responsibility of the capital's authorities at all levels for implementation have not been specifically regulated. Therefore, it is necessary to study specific regulations to ensure feasibility.
Commenting on the regulations on linkage and development of the capital region stipulated in Chapter 5, delegate Tran Thi Hong Thanh said that the issue of linkage and development of the region in general is a difficult content, not yet clearly, specifically and synchronously legalized in our country's legal system. Meanwhile, the coordination of investment and development activities of socio-economic regions in general and the Capital Region in particular needs to be clear about the investment mechanism, financial mechanism, management and operation mechanism, clearly defining the specific responsibilities of each locality in the region.
Therefore, in order to develop effective and feasible regulations on linkage and development of the capital region in the law, delegates suggested that the drafting agency review and study more complete and specific regulations on a number of contents: Review Clause 1, Article 46 of the draft Law which is currently not consistent with Conclusion No. 45-KL/TW dated November 17, 2022 of the 6th Conference of the 13th Party Central Committee on the National Master Plan Orientation for the 2021-2030 period, with a vision to 2050.
At the same time, it is recommended to study, supplement, clarify and make more specific other specific regulations related to the Capital Region and the Red River Delta such as: authority on investment in regional projects, investment in other provinces by localities, investment incentives for projects in the Region, specific mechanisms and regulations on regional linkages in the fields of: technical infrastructure, environment, education, labor, population management, industrial production zoning, logistics, etc. to create a basis for effective and substantive regional linkages.
It is necessary to consider detailed regulations on coordination mechanisms for developing transport infrastructure and environmental protection; including research on developing urban railway lines connecting central urban areas of the capital and urban areas of neighboring provinces according to the TOD model (urban development model oriented towards public transport development) and the renovation, treatment and cleaning of the environment of rivers in the capital region; the planning and investment in the construction of advanced and modern waste treatment plants of localities in the region in a reasonable and effective manner...
In the afternoon, the National Assembly discussed in the hall the draft Law on Archives (amended). During the day, the National Assembly voted to pass the Law on Identification; the Law on Housing (amended); and the Law on Water Resources (amended).
