On October 27, the Ministry of Labor, War Invalids and Social Affairs issued Official Dispatch 4594/LĐTBXH-ATLĐ on the proposal for Lunar New Year and National Day holidays in 2024.

Accordingly, the Ministry of Labor, War Invalids and Social Affairs reports to the Prime Minister the plan for Lunar New Year and National Day holidays in 2024 for cadres, civil servants, public employees and employees of administrative agencies, public service agencies, political organizations, socio-political organizations (hereinafter referred to as civil servants and public employees) and employees in enterprises who are not civil servants and public employees (hereinafter referred to as employees) as follows:

Proposal for Lunar New Year and National Day holidays in 2024 for cadres, civil servants and public employees

The proposed Lunar New Year and National Day holiday schedule in 2024 for cadres, civil servants, public employees and employees of administrative agencies, public service agencies, political organizations and socio-political organizations is as follows:

* Lunar New Year holiday 2024

- Option 1: take 5 days off as prescribed, including 2 days off before Tet and 3 days off after Tet

Civil servants and public employees will have Lunar New Year holiday 2024 from Thursday, February 8, 2024 to Wednesday, February 14, 2024 (ie December 29, year of the Cat, to January 5, year of the Dragon) .

Thus, with this plan, during the Lunar New Year holiday, civil servants and public employees will have 07 days off (including 05 days off for Lunar New Year and 02 days off in lieu of weekly days off as prescribed in Clause 3, Article 111 of the Labor Code).

- Option 2: take 5 days off as prescribed, including 1 day off before Tet and 4 days off after Tet.

Civil servants and public employees will have Lunar New Year holiday 2024 from Friday, February 9, 2024 to Thursday, February 15, 2024 (ie December 30, year of the Cat to January 6, year of the Dragon) .

Thus, with this plan, during the Lunar New Year holiday, civil servants and public employees will have 07 days off (including 05 days off for Lunar New Year and 02 days off in lieu of weekly days off as prescribed in Clause 3, Article 111 of the Labor Code and 02 days off weekly).

- Proposed plan: The Ministry of Labor, War Invalids and Social Affairs proposes the Lunar New Year holiday according to plan 1.

Reason: both options have the same number of days off, but option 1 ensures harmony between the time off before and after Tet (this option is agreed upon by all relevant ministries and agencies).

* National Day holiday 2024

- Option 1: take 2 days off as prescribed, including September 2 and 1 day immediately after September 2. Civil servants and public employees are off from Saturday, August 31, 2024 to Tuesday, September 3, 2024.

Thus, with this plan, on the occasion of the 2024 National Day holiday, civil servants and public employees will have 4 days off (including 2 National Day holidays and 2 weekly days off).

- Option 2: take 2 days off as prescribed, including September 2 and 1 day immediately before September 2. Civil servants and public employees are given 4 consecutive days off from Saturday, August 31, 2024 to Tuesday, September 3, 2024.

Thus, with this plan, on the occasion of the National Day holiday in 2024, civil servants and public employees will have 04 days off (including 02 National Day holidays, 01 weekly day off and 01 compensatory day off for the weekly day off as prescribed in Clause 3, Article 111 of the Labor Code).

- Proposed plan: The Ministry of Labor, War Invalids and Social Affairs proposes the 2024 National Day holiday according to plan 1.

Reason: Both options have 4 consecutive days off from Saturday, August 31, 2024 to Tuesday, September 3, 2024, but option 1 has the advantage of reducing administrative procedures and not having to arrange compensatory weekly days off as prescribed in Clause 3, Article 111 of the Labor Code (this option is agreed upon by all relevant Ministries and agencies).

Proposed Lunar New Year and National Day holiday schedule in 2024 for employees

Based on actual conditions and holiday schedules for civil servants and public employees, employers arrange Lunar New Year and National Day holidays for employees in enterprises that are not civil servants and public employees as follows (employers are encouraged to apply Lunar New Year holidays for employees as prescribed for civil servants and public employees):

- Lunar New Year holiday 2024:

+ Choose 01 day before Tet and the first 04 days after Tet or 02 days before Tet and the first 03 days after Tet or 03 days before Tet and 02 days after Tet.

+ Notify employees of the Lunar New Year holiday plan at least 30 days before implementation.

- National Day holiday 2024:

The employer decides to give the employee 2 days off (September 2 and 1 day before or after).

- If the weekly day off coincides with the Lunar New Year holiday or National Day holiday, the employer shall arrange a compensatory weekly day off for the employee on the next working day as prescribed in Clause 3, Article 111 of the Labor Code.
