This is one of the contents of Decree 125 regulating investment and operation conditions in the education sector issued by the Government on October 5.

Accordingly, the operating conditions of private specialized high schools are the same as those of high schools, and must have educational programs, teaching and learning materials, and a team of managers, teachers, and employees who meet the standards and tasks prescribed for specialized schools.

Decree 125 also stipulates a number of new contents related to the conditions for establishment and operation of preschool and general education facilities.

Accordingly, these conditions must be consistent with provincial planning and relevant local planning to comply with the provisions of the Law on Planning.

According to the Decree, preschool and general education institutions wishing to conduct educational activities must ensure basic conditions regarding land, facilities, equipment, educational programs; teaching staff, and management staff; and specific standards and requirements of a professional and technical nature will be implemented according to specialized documents in the field of education.

The Decree also adds the provision: “For inner-city areas of special-class urban areas, the school construction land area can be replaced by the construction floor area and must ensure that the construction floor area is not lower than the minimum average land area for one child/student as prescribed”.

According to the explanation of the Ministry of Education and Training, new urban areas and densely populated areas are facing school overload, while the land area for building educational facilities is increasingly limited. Therefore, the additional regulation aims to partly overcome these limitations in urban areas with high population density, especially Hanoi and Ho Chi Minh City.

The Ministry of Education and Training also said that to ensure the principle of the State treating investors equally, the Decree stipulates that the investment capital level for domestic preschool and general education institutions to operate is similar to the capital level for preschool and general education institutions with foreign investment to operate.

Specifically, the investment capital for private kindergartens and primary schools to conduct educational activities: “at least 30 million VND/child (excluding land use costs)…” for kindergartens and “at least 50 million VND/student (excluding land use costs)…” for primary schools. In the case of private schools that do not build new facilities but only rent or use existing facilities to carry out educational activities, the investment level must reach at least 70% of the prescribed investment level.

The specific regulation on this capital level ensures that educational institutions have sufficient financial resources to organize educational activities as well as maintain and develop school activities; is one of the important factors contributing to ensuring and improving the quality of preschool and general education; and enhancing the role and responsibility of investors when operating in the field of education.

This Decree takes effect from November 20, 2024, replacing Decree No. 46/2017/ND-CP of the Government regulating conditions for investment and operation in the education sector and Decree No. 135/2018/ND-CP of the Government amending and supplementing a number of articles of Decree No. 46.
