The illegal occupation of apartment building D7-D10 needs to be promptly and thoroughly resolved.

Recently, at apartment building D7-D10, My Binh ward (Phan Rang - Thap Cham city), a business has brazenly occupied public land to illegally build and plant trees, turning this place into a private business area. The incident has caused outrage among the people, posed a potential risk to security and order, and affected the lives of hundreds of residents here.

According to the residents of D7-D10 apartment building, the situation of Phong Phat Investment and Trading Service Company Limited (Phong Phat Company) blatantly occupying the sidewalk and the common playground has lasted for more than 3 months, affecting the daily life of the residents. This enterprise previously arbitrarily changed the paint color of the first floor, now continues to occupy public land for illegal construction and business, causing dissatisfaction among residents living in D7-D10 apartment building. Mr. Le Manh Linh, a resident of D7-D10 apartment building, said: They arbitrarily built solid prefabricated houses, then planted all kinds of trees such as bananas, bamboo, sugarcane... right on the public yard. The children's playground and the common living space of the residents have now become a shabby business place, losing the urban beauty and posing a potential risk of fire safety.

Many pots, jars, baskets and many other items are scattered in the yard of apartment building D7 - D10.

According to the D7-D10 apartment building management board, the common yard of more than 1,000 square meters and the surrounding sidewalk are under the common use of the residents. The management board has repeatedly sent petitions to the authorities requesting a definitive handling of this situation, however, up to now, Phong Phat Company has continued its illegal construction activities. Mr. Ho Khai Duc, Head of the D7-D10 apartment building management board, said: We fully support the investment of enterprises to upgrade the utilities of the apartment building. However, the investment must comply with the law, cannot blatantly occupy public land, build without permission, affecting security and order, and especially the fire safety of the building.

Through working with the Provincial Center for Housing and Apartment Management, it was learned that Phong Phat Company was the winning bidder for the right to lease the ground floor area of ​​the apartment building with an area of ​​2,059m². The company's arbitrary occupation of the area outside the auctioned area is completely illegal. Mr. Nguyen Hai Nguyen, Director of the Provincial Center for Housing and Apartment Management, affirmed that Phong Phat Company's act of occupying public land was against regulations and the authorities had repeatedly drawn up records requesting correction. Mr. Nguyen Hai Nguyen added: We have repeatedly conducted inspections, drawn up records and requested Phong Phat Company to stop construction and return the original status. Most recently, on April 18, the Department of Construction Inspectorate also stepped in and drew up a record of violations. However, this enterprise still did not comply.

According to the inspection report dated April 18 by the authorities, Phong Phat Company has turned the common yard area of ​​the residents into a "mixed garden" with more than 60 pots, jars, and baskets containing various types of plants such as gourds, bananas, bamboo, papaya, squash, and flowers. Notably, this enterprise also arbitrarily renovated the land, removed bricks on the common area, built trellises for growing gourds, sugarcane, and iron frames occupying about 40 square meters. Not only stopping at planting trees, Phong Phat Company also brazenly constructed many illegal items on the apartment land, including: Construction of a cement floor, tiled floor with an area of ​​68.73 square meters; a prefabricated house with an iron frame, cement wall, ceramic tile floor, and corrugated iron roof with an area of ​​about 27 square meters.

According to the latest information, on the morning of April 24, the Provincial Department of Construction Inspectorate held a meeting to decide on administrative sanctions against Phong Phat Company and develop a plan to enforce the demolition of illegal construction works. Mr. Nguyen Van Moc, Chief Inspector of the Provincial Department of Construction, said that the unit is completing procedures to advise on the issuance of a decision on administrative sanctions against Phong Phat Company. The expected fine according to regulations ranges from 60 to 80 million VND.

It is known that the D7-D10 apartment building has a total of 240 apartments, with an investment of more than 130 billion VND from the Ninh Thuan Provincial Development Investment Fund. The apartment building has been in operation for more than 4 years and currently has more than 120 households living there. The situation of businesses blatantly occupying public land and illegally constructing not only causes outrage in the community, affecting the rights of hundreds of apartment residents, but also shows the lack of seriousness in law enforcement by businesses. We hope that the authorities will soon take drastic measures, strengthen inspections, and strictly handle violations, in order to ensure construction order and return the true public living space to the residents of the D7-D10 apartment building.
