How do Hanoi officials and civil servants enjoy additional income under the 2024 Capital Law?

Enjoy additional income based on ability and work efficiency

Pursuant to Clause 3, Article 15 of the 2024 Capital Law, which stipulates the recruitment, management and use of cadres, civil servants and public employees: Cadres, civil servants and public employees working in State agencies, political organizations, the Vietnam Fatherland Front, socio-political organizations and public service units whose regular expenditures are fully guaranteed by the State budget under the management of the City are entitled to additional income based on their capacity and work efficiency.

Thus, from January 1, 2025, cadres, civil servants and public employees working in state agencies, political organizations, the Vietnam Fatherland Front, socio-political organizations and public service units are guaranteed all regular expenses managed by Hanoi City and enjoy additional income based on capacity and work efficiency.

In addition, based on Point a, Clause 1, Article 35 of the 2024 Law on the Capital, which stipulates the use of financial resources and budget for the development of the Capital: The City People's Council is entitled to perform the following tasks and powers: Decide to use the remaining salary reform resources after ensuring sufficient resources to implement salary reform for the entire period of budget stabilization according to regulations of competent authorities and ensuring social policies, social security, and social welfare issued by the Central Government to implement additional income expenditure for cadres, civil servants, and public employees according to regulations in Clause 3, Article 15 of this Law; the total expenditure level shall not exceed 0.8 times the basic salary fund of cadres, civil servants, and public employees under the management of the City.

Thus, the City People's Council shall spend additional income for cadres, civil servants and public employees with the total expenditure not exceeding 0.8 times the basic salary fund of cadres, civil servants and public employees under the management of the City.

How to recruit and attract talented people?

Pursuant to Clause 1, Article 15 of the 2024 Capital Law on recruitment, management and use of cadres, civil servants and public employees: Cadres and civil servants working in communes, wards and towns are cadres and civil servants according to the provisions of the Law on Cadres and Civil Servants under the administrative payroll assigned annually to the district level, elected, recruited, managed and used according to the provisions of the law on cadres and civil servants.

Pursuant to Article 16 of the 2024 Capital Law, regulations on attracting and employing talented people and developing high-quality human resources. Accordingly, attracting and employing talented people are implemented as follows:

Vietnamese citizens with outstanding moral qualities, qualifications, abilities, practical experience, working in the country or abroad with special works, products, achievements, merits or contributions to the development of a field or industry of the Capital shall be considered for recruitment and accepted as civil servants or public employees; Vietnamese citizens who meet the criteria specified in Point a of this Clause shall sign contracts to perform professional or technical work or assume management and operational positions at public service units under the management of the City; Foreigners with high professional qualifications, extensive practical experience, whose works or products have been accepted, recognized, and applied with high efficiency shall be signed contracts to perform the tasks of construction, development, management and protection of the Capital; People who are selected, accepted or signed a labor contract as prescribed in points a, b and c, Clause 1, Article 16 of the 2024 Capital Law shall enjoy the regimes and policies prescribed by the City People's Council.

The City People's Council decides on the following policies on developing high-quality human resources in the Capital: Prioritizing the development of high-quality human resources, reaching regional and international levels in sectors and fields to meet the requirements and tasks of building, developing, managing and protecting the Capital in each period; Using the City budget to support investment in facilities and equipment of key national training facilities in the City; Using the City budget to support funding for training, fostering, improving professional skills at foreign training facilities for cadres, civil servants, and public employees working in agencies, organizations, and units under the City's management, and students of educational and training facilities in the City; Supporting the formation of national and regional centers for high-quality vocational training and practice in the City; Supporting tuition fees for vocational students at high-quality vocational training facilities in the City.

Additional revenue expenditures could be implemented from 2025 to the end of 2030.

Recently, on the afternoon of December 10, at the 20th Session, delegates of the Hanoi People's Council voted to pass the Resolution on Regulations on additional income for cadres, civil servants, and public employees working in State agencies, political organizations, the Vietnam Fatherland Front, socio-political organizations, and public service units whose regular expenditures are fully guaranteed by the State budget under the management of Hanoi City.

According to the submission of the Hanoi People's Committee, the source of funding for additional income is used from the remaining salary reform fund of the budgets at all levels after ensuring sufficient resources to implement salary reform for the entire period of budget stabilization according to regulations of competent authorities and ensuring social policies, social security, and social welfare issued by the Central Government.

The source of funding for additional income of agencies and units is equal to the basic salary fund (including salary according to rank and position) multiplied by the deduction level decided by the City People's Council. The remaining funding source for salary reform in 2023 transferred to 2024 (after using additional funds for the need to implement salary reform and bonuses according to Decree No. 73/2024/ND-CP) is 66,073 billion VND. The need for additional funding to implement salary reform each year is about 12,000 billion VND.

Thus, the remaining budget for implementing salary reform to spend on additional income at the rate of 0.8 times the basic salary fund can be implemented from 2025 to the end of 2030. In 2025, the deduction level to create a budget for implementing additional income is equal to 0.8 times the basic salary fund.

From the beginning of the next budget stabilization period, based on the remaining salary reform source after ensuring sufficient resources to implement salary reform for the entire budget stabilization period according to regulations of competent authorities and ensuring social policies, social security, and social welfare issued by the Central Government, the City People's Committee shall report and propose to the City People's Council to consider and decide on the level of deduction to create a source of funding to implement additional income expenditure for cadres, civil servants, and public employees under the city's management for the entire period and each year, but not exceeding 0.8 times the basic salary fund.

In case of any changes in salary reform sources that change the current deduction level, the City People's Committee shall report and propose the changed deduction level for the City People's Council to consider and decide at the nearest City People's Council meeting.

The additional income expenditure of agencies and units is implemented according to the following plan: using 0.5 times the basic salary fund to pay additional monthly income for all existing cadres, civil servants and public employees of the agency or unit who are eligible according to the salary coefficient of the current salary scale and position.

0.3 times the remaining basic salary fund to pay additional income at the end of the year for cadres, civil servants, and public employees of agencies and units that are annually evaluated and classified as having completed their tasks or higher. The head of the agency or unit is responsible for specifying the spending plan for cadres, civil servants, and public employees that are annually evaluated and classified to ensure the payment of additional income according to the principles of the Resolution and the provisions of the Law on the Capital.

This Resolution comes into force from January 1, 2025.

According to Director of Hanoi Department of Home Affairs Tran Dinh Canh, the resolution on the above content was built by the city to ensure objectivity, fairness, and work efficiency, without equalization, basically ensuring the consumer price index in the capital, helping to motivate and encourage the team of cadres, civil servants, and public employees to further improve work efficiency, contributing to the development of the city.

Speaking at the meeting, delegate Duong Hoai Nam (Long Bien district group) expressed his approval of the increased income for cadres, civil servants and public employees when implementing the Capital Law. At the same time, he said that this is a content that has a great impact on cadres, civil servants and public employees of the Capital. Because of the increased attention, the regime will increase the sense of responsibility, creating an exciting spirit among cadres, civil servants...

 

Among the breakthrough and outstanding policies for the development of Hanoi, the regulations on the model of the capital's government organization towards streamlining, professionalism, modernity, effective and efficient operation along with the civil service and civil servant regime; attracting and promoting talented people and developing high-quality human resources; promoting decentralization and delegation of power are the most important policy highlights. These policies, if implemented well and effectively, will be the lever, the driving force and the foundation for implementing policies on construction, development, management and protection of the capital.

If the government apparatus operates effectively, efficiently and modernly, it can attract and utilize all resources - not only state resources but also social resources to serve the development of the country. The team of cadres, civil servants, public employees and even part-time cadres play a very important role in implementing policies to develop the capital.

Policies and institutions have been very innovative and outstanding, meeting the requirements in the current development context, but to be put into practice and implemented effectively, there must be talented people and high-quality human resources. Therefore, policies to attract, promote talents and develop high-quality human resources are very necessary.
