Conditions for using agricultural land to build works directly serving agricultural production are: the land in use has an area of ​​500m2 or more or 50ha for rice fields (including one plot or many adjacent plots of land with the same land user); construction works have a scale of 1 floor, maximum height of 5m, no basement is allowed; does not affect irrigation works, dike works, intra-field traffic, adjacent agricultural land area and does not violate the existing road boundary according to the planning approved by the competent authority; semi-permanent structure, easy to dismantle (brick wall or lightweight material wall; brick column or steel column, iron column; lightweight material roof) and does not fall under the case of land use purpose change prescribed in Article 121 of the 2024 Land Law.

The land area for construction of works to directly serve agricultural production is specifically regulated as follows: Land from 500m2 to 5,000m2 can be built on a construction not exceeding 25m2; land from 5,000m2 to 10,000m2 can be built on a construction not exceeding 50m2; land from 10,000m2 or more can be built on a construction not exceeding 75m2; the minimum rice-growing land area is from 50ha to 200m2. For agricultural production land, construction can be built on 1 location in the land area, rice-growing land can be built on 2 locations in the land area. Construction works directly serving agricultural production include: Serving preliminary processing and preservation of agricultural products; warehouses for agricultural materials, machinery, and labor tools; displaying and introducing agricultural products.

The decision takes effect from May 1, 2025.
