On September 20, at the 26th session of the National Assembly Standing Committee giving opinions on the draft Law on the Capital (amended), National Assembly Chairman Vuong Dinh Hue stated that currently the content of the draft Law does not have many major issues with different opinions, mainly comments to further perfect the provisions in the draft.

Emphasizing that although the scale of the Law project is not large, consisting of 7 chapters and 59 articles, the National Assembly Chairman noted that this is a difficult Law project, of important nature, and of great significance to the development of the Capital in the coming time.

To continue perfecting the draft Law, National Assembly Chairman Vuong Dinh Hue requested that it is necessary to continue reviewing to fully institutionalize Resolution No. 15-NQ/TW dated May 5, 2022 of the Politburo on the direction and tasks of developing Hanoi Capital by 2030, with a vision to 2045; Resolution No. 30-NQ/TW dated November 23, 2022 of the Politburo on socio-economic development and ensuring national defense and security in the Red River Delta by 2030, with a vision to 2045...

At the same time, it is necessary to continue reviewing regulations related to urban governance, especially institutionalizing the roles, functions, tasks and powers of the Capital. In particular, it is necessary to pay attention to and aim to resolve a number of basic requirements on: Decentralization and delegation of powers; specific policies must be focused, key and breakthrough; ensure consistency with the principle of compliance with the Constitution and the legal system...

Regarding the provision on innovation, the National Assembly Chairman noted that Hanoi was honored by UNESCO as a creative city in the world network of creative cities. Meanwhile, creative cities are mainly related to creative design; and creative design is mainly based on craft villages. Therefore, the National Assembly Chairman suggested research and review to have appropriate regulations and institutions to develop craft villages and villages with crafts.

There is decentralization, delegation, priority but at the same time there must be responsibility

Concluding the session, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the National Assembly Standing Committee agreed with the need to amend the Law on the Capital and highly appreciated the preparation process of the Government, Hanoi City and ministries, especially the Ministry of Justice. The drafting agency, the reviewing agency - the Law Committee, and the coordinating review agencies (the Ethnic Council, the National Assembly Committees) also coordinated very closely in submitting the draft Law dossier to the National Assembly Standing Committee, ensuring completeness, compliance with the provisions of the Law on Promulgation of Legal Documents, and the progress of the law and ordinance building program approved by the National Assembly.

The National Assembly Standing Committee also basically agreed with the dossier and basic contents presented at the Session. At the same time, it noted that this is a particularly important law, with profound political and social significance, difficult in terms of technical content and difficult in terms of legislative techniques, so it is necessary to continue to coordinate to improve it in the coming time.

Regarding the tasks and requirements set forth to continue perfecting the draft Law on the Capital (amended), Vice Chairman of the National Assembly Nguyen Khac Dinh stated that it is necessary to closely follow the political and legal basis and practical requirements.

Emphasizing that this is a separate law regulating the capital city of Hanoi, which is both the administrative capital of the whole country and a special urban area of ​​the whole country, Vice Chairman of the National Assembly Nguyen Khac Dinh proposed to stipulate separate mechanisms, special incentives, and special advantages that are superior to the current legal system. At the same time, these are also regulations assigning great responsibility to Hanoi in the construction, development, management and protection of the capital. The Capital Law (amended) must still be placed within the overall relevant legal system. In addition to the Capital Law, Hanoi must still implement all relevant regulations of the legal system.

Regarding the application of the Capital Law, it is necessary to have specific, appropriate and convenient provisions for the application of the Capital Law in the legal system, but still ensure compliance with the basic principles in the Law on Promulgation of Legal Documents.

In addition, Vice Chairman of the National Assembly Nguyen Khac Dinh also noted that it is necessary to continue reviewing to complete the basic contents of: specific, special, and priority mechanisms and policies for Hanoi in the issue of decentralization, delegation, priority, and responsibility. At the same time, it is necessary to determine that each mechanism and policy has decentralization, delegation, priority, but at the same time must have responsibility; Clearly define the specific mechanism on the organization, staff, payroll, experts, and salaries assigned to Hanoi; Add specific contents in the development requirements for craft village design and innovation centers; craft villages; cultural industry; science, technology, engineering; innovation investment fund; Red River planning, etc.
