According to the resolution on site clearance for projects in the area recently approved by the Kon Tum Provincial People's Council, the Provincial People's Council requires clearly defining the responsibilities of each level, each sector, each locality and investors in each specific project to take drastic actions, ensuring that public investment projects and business investment projects are implemented and completed on schedule.

At the same time, Kon Tum Provincial People's Council requested to review and immediately rectify the situation of slow site clearance for key projects under the province's authority and responsibility; resolutely transfer and replace cadres and civil servants assigned to perform this task but avoid it, fear mistakes, and fear responsibility.

The specific solution is to seriously consider the responsibility of the heads of localities and relevant agencies for not completing compensation and site clearance work on schedule as planned. Focus on completing and promptly issuing documents regulating compensation and site clearance under the authority of localities when the 2024 Land Law comes into effect.

According to the People's Committee of Kon Tum province, in the first 6 months of 2024, the province has compensated and cleared 32.4% of 12/37 projects. Of which, about 55.34 hectares have been compensated for two organizations and 246 households of the province's key projects.

Reporting to voters of Kon Tum province, Mr. Nguyen Ngoc Sam, Vice Chairman of Kon Tum Provincial People's Committee, said that frankly speaking, compensation and site clearance work is still slow and congested, causing great obstacles to project progress.

Some projects have not been implemented or are very slow, such as: Investment project to build, renovate and upgrade Provincial Road 676 connecting Kon Plong district, Kon Tum province with Son Tay and Son Ha districts, Quang Ngai province; Project on the main road in the West of Kon Tum city; Project to build and expand the business premises of units under Division 10, Corps 3 in Hoa Binh commune, Kon Tum city"...

Mr. Sam said that the main reasons that have not been resolved include: Compensation and site clearance work is very complicated and sensitive, involving many subjects, agencies, policies, and interests of the victims, easily leading to complaints, lawsuits, loss of security and order, etc. existing from history, determining the origin of the land, the management and handling process of competent authorities is not strict, and does not ensure the law.

Legal regulations are incomplete, inconsistent, and not suitable for the reality of each region and locality (conversion of natural forests, protective forest land, special-use forest land, land prices, planning, assets of state-owned companies, etc.).

According to the Vice Chairman of Kon Tum Provincial People's Committee, the procedures prescribed by law take a long time, such as: Land recovery notice, compensation plan, and site clearance, which take from 3 to 6 months.

Contributing capital for land use rights to implement earthworks is difficult and inappropriate; Choosing a specific land valuation consultant is very difficult due to low cost, high responsibility, etc.

In addition to the above causes, there is also a lack of responsibility of investors and agencies such as: not being resolute, not proactively coordinating flexibly to resolve and remove these obstacles; local authorities, in addition to performing their duties, have not done a good job of propaganda, mobilization, dialogue, verification of land origin, etc., especially after violations were discovered by inspection and examination, affecting and slowing down the progress of compensation and site clearance work.
