Prime Minister: Remove bottlenecks to achieve double-digit growth target

The Prime Minister requested that draft laws must be both manageable and transparent to mobilize social resources to serve the country's development needs.

On December 4, chairing the Government's special meeting on law-making in November 2024 to consider 6 proposals for law-making and 1 draft ordinance, Prime Minister Pham Minh Chinh requested to continue reviewing and detecting remaining problems and shortcomings in the system of legal documents, proposing amendments, supplements, and removing "bottlenecks" to achieve the target of double-digit growth in the coming time.

Attending the meeting were Permanent Deputy Prime Minister Nguyen Hoa Binh; Deputy Prime Ministers Tran Hong Ha, Le Thanh Long, Ho Duc Phoc, Bui Thanh Son; Ministers, Heads of ministerial-level agencies, Heads of Government agencies.

At the meeting, the Government reviewed and discussed 7 important contents including: Draft Ordinance on Management and Protection of President Ho Chi Minh Mausoleum Relic Site and 6 proposals to develop laws: Law amending and supplementing a number of articles of the Law on Organization of the Government; Law amending and supplementing a number of articles of the Law on Local Government; Law on Atomic Energy (amended); Law amending and supplementing a number of articles of the Law on Execution of Criminal Judgments; Law on Execution of Temporary Detention, Temporary Imprisonment and Prohibition from Leaving Place of Residence; Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy.

Regarding the Draft Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site, opinions agreed and highly appreciated the preparation work of the Ministry of National Defense; at the same time, it was believed that the draft ordinance has fully institutionalized the Party's policies and viewpoints on the special political task of long-term preservation and absolute safety protection of President Ho Chi Minh's body for visiting and management and protection of the Mausoleum Relic Site.

Regarding the proposal to develop a Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy, delegates agreed to add regulations on energy management for the group and general corporation model, especially in the field of controlling gasoline loss rates; consider adjusting and strengthening the responsibility of localities in checking compliance with standards, regulations, and energy consumption rates of local enterprises...

Along with that, build a fund tool to promote the use of energy economically and efficiently; supplement and clarify regulations on tax support and financial support for investment activities in solutions for the use of energy economically and efficiently, projects to upgrade and renovate production lines, and expand production scale using energy-saving technology.

In order to overcome the limitations and shortcomings of the current Law on Atomic Energy, the Government has drafted the Law on Atomic Energy (amended) to promote the development of atomic energy applications, attach importance to nuclear energy, equipment manufacturing, international cooperation and human resource training; ensure the safety and security of radioactive sources, radiation equipment, nuclear equipment and nuclear materials; manage radioactive waste, spent nuclear fuel, spent radioactive sources...

Regarding the Law amending and supplementing a number of articles of the Law on Government Organization, Government members enthusiastically discussed to clarify the relationship between the Government and the political system; authority, responsibility, and relationship between the Government, the Prime Minister and Ministers, Heads of sectors, agencies in the Government system and with local authorities.

In the draft Law amending and supplementing a number of articles of the Law on Local Government, delegates proposed models of urban and rural government organization, aiming to promote autonomy, self-reliance, and self-strengthening, ensuring the goal of maintaining independence, sovereignty, and territorial integrity, and making people increasingly prosperous and happy...

Participating in the discussion and conclusion of each draft ordinance, proposing the development of laws, concluding the meeting, Prime Minister Pham Minh Chinh requested ministries, branches and agencies to seriously absorb the opinions of Government members and delegates, complete the proposals, draft laws and ordinances according to regulations; at the same time, continue to review and detect problems and inadequacies in the system of legal documents, propose amendments, supplements and remove "bottlenecks" to achieve the target of double-digit growth in the coming time.

Prime Minister Pham Minh Chinh requested Ministers and Heads of sectors to directly lead, direct, invest time and resources in the work of building laws in a timely, effective and high-quality manner with the highest sense of responsibility; continue to summarize practices to build policies, assess the policy impacts of laws to ensure they are close to reality, and remove bottlenecks, difficulties and obstacles from practice.

Considering that institutions, mechanisms and policies are also the driving force and resources for development, but the institutions themselves are the bottleneck of bottlenecks, the Prime Minister requested that draft laws and draft resolutions be drafted to institutionalize the Party's guidelines and policies related to various fields, contributing to unblocking and mobilizing resources for national development, especially in the coming period when we set a double-digit growth target so that by 2030 our country will be a developing country with modern industry and high average income, and by 2045 it will become a developed country with high income.

Emphasizing the need for innovation in thinking in law-making, Prime Minister Pham Minh Chinh requested that draft laws must be both manageable and transparent to mobilize resources in society, serving the requirements of national development. In particular, the law only regulates issues of principles, standards, criteria, and procedures, while for specific issues, depending on the actual situation, with rapid changes and developments, the Government, ministries, and branches will provide guidance to meet the requirements of the new situation, bringing about efficiency in the process of organizing and implementing the law.

Prime Minister Pham Minh Chinh directed to review and resolutely eliminate the request-grant mechanism, avoid creating a negative ecosystem, pay special attention to the work of preventing and combating negativity, corruption, and group interests in the process of building laws and ordinances; review and not criminalize economic relations and civil relations, protect the legitimate rights and interests of people and businesses.

For draft laws and resolutions, the Prime Minister requires that the expressions be concise, easy to understand, easy to implement, easy to check, easy to monitor, not descriptive, too wordy, ensuring brevity, succinctness, sharpness, clarity of meaning, authority, and responsibility. Along with that, decentralization and delegation of authority, coupled with resource allocation, improving the implementation capacity of all levels, strengthening monitoring and inspection tools, strengthening post-inspection, reducing pre-inspection; the Government, ministries, and sectors only focus on state management, strategy building, and planning.

Prime Minister Pham Minh Chinh also requested to minimize administrative procedures, reduce compliance costs for people and businesses, apply science and technology, digital transformation, and reduce direct transactions because this can easily lead to negativity and petty corruption. In addition, it is necessary to continue to collect opinions from affected subjects, relevant agencies, scientists, professionals, experts, refer to international experience, and do a good job of communication and policy, especially with new issues.

Along with law-making, the Prime Minister proposed to urgently implement the laws and resolutions passed by the National Assembly at the 8th Session and a number of laws passed by the National Assembly at the 7th Session; continue to review issued laws to perfect the legal system; continue to tighten discipline, order, and control power in law-making.

The Prime Minister pointed out that Ministers and heads of sectors not only need to spend time developing laws for their sectors but also give opinions to other sectors in the political system, especially agencies under the Government; prioritize human resources, facilities, leadership and direction for this work; during the implementation process, it is necessary to detect bottlenecks and obstacles, "where there are obstacles, there must be solutions", "at which level, the level must proactively resolve the problem, if it exceeds the authority, it must be reported"./.
