The reason for land reclamation is that the enterprise terminates the investment project activities in Decision No. 1655/QD-UBND dated September 19, 2022 of the Provincial People's Committee (including content violating Point i, Clause 1, Article 64 of the 2013 Land Law, now Clauses 8 and 9, Article 81 of the 2024 Land Law).

According to the decision on land recovery, the State does not compensate for land and assets attached to land as prescribed in Clause 3, Article 101 and Clauses 1 and 2, Article 105 of the 2024 Land Law.

Trung Nguyen Coffee Joint Stock Company is responsible for implementing the Land Reclamation Decision; handing over land and documents on land use rights to the competent authorities and persons specified in the Land Reclamation Decision; fully performing financial obligations regarding land and related financial obligations (if any) as prescribed by law.

The Provincial People's Committee assigned the People's Committee of Loc An commune, Bao Lam district to be responsible for receiving and strictly managing the assigned land area according to the provisions of the law on land and other relevant laws, not allowing encroachment or occupation of land in the assigned land area; regularly organizing inspections, detecting, preventing and promptly handling violations of the law on land according to regulations according to their authority.

The People's Committee of Bao Lam district is responsible for organizing the enforcement of the land recovery decision according to the provisions of Article 39 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government; allocating funds or proposing the allocation of funds to enforce land recovery according to the provisions of law in case Trung Nguyen Coffee Joint Stock Company does not comply with the land recovery decision; monitoring, detecting, preventing and promptly handling violations of the law on land management and use in the locality according to its authority (stipulated in Point a, Clause 1, Article 241 of the 2024 Land Law), ensuring compliance with the provisions of law.

In addition, the Provincial People's Committee also assigned the Department of Agriculture and Environment to preside over and coordinate with relevant agencies and units to organize the on-site handover of the recovered land area to the People's Committee of Loc An commune, Bao Lam district for management according to regulations; establish procedures to revoke the Land Use Right Certificates issued to Trung Nguyen Coffee Joint Stock Company; direct the updating and correction of land databases and cadastral records according to regulations.

The Provincial Tax Department (now the Regional Tax Department XIII) is responsible for inspecting, reviewing and collecting financial obligations that Trung Nguyen Coffee Joint Stock Company must fulfill (if any) from the date of issuance of this Decision and before according to regulations.
