Mr. Thuy asked, is his unit allowed to reduce the price of medical examination and treatment services (to charge lower than the price stipulated in the Resolution of the Provincial People's Council) to participate in bidding and sign contracts with customers?

On this issue, the Ministry of Finance has the following opinion:

Pursuant to the provisions of the law on prices, prices of medical examination and treatment services are implemented in accordance with the provisions of the law on medical examination and treatment.

Pursuant to the provisions of the Law on Medical Examination and Treatment No. 15/2023/QH15, the Ministry of Health is responsible to the Government for performing state management of medical examination and treatment (Clause 2, Article 5); regulating specific prices for medical examination and treatment services on the list paid by the Health Insurance Fund, specific prices for medical examination and treatment services paid by the state budget, specific prices for medical examination and treatment services not on the list paid by the Health Insurance Fund but not medical examination and treatment services upon request for medical examination and treatment facilities under the Ministry of Health and other Ministries (Clause 5, Article 110).

The Provincial People's Council shall prescribe specific prices for the above-mentioned medical examination and treatment services for State medical examination and treatment facilities in the management area within the scope of decentralized authority, but shall not exceed the corresponding prices for medical examination and treatment services prescribed by the Minister of Health (Clause 6, Article 110).
