On the morning of October 9 in Hanoi, the Central Council for Coordination and Dissemination of Legal Education organized the 2024 “Business and Law” forum with the theme “Joining hands to solve legal issues, contributing to creating a favorable investment and business environment for enterprises”. This is a practical event in response to Vietnamese Entrepreneurs Day (October 13, 2024) and Vietnamese Law Day (November 9, 2024).
The forum was held online, connecting with 63 localities. Comrade Le Thanh Long, member of the Party Central Committee, Deputy Prime Minister, Chairman of the Central Council for Coordinating the Dissemination and Education of Law, attended and chaired at the Central bridge. Attending at the bridges were representatives of provincial and municipal leaders and departments; representatives of Business Associations (DN) and entrepreneurs in the localities.

The forum was held with 2 discussion sessions, focusing on 2 main topics that are of particular interest to the business community, namely: legal issues regarding procedures for investment projects using land and solutions; legal issues regarding taxes and solutions.

Recently, the Government has submitted to the National Assembly for approval four important laws on land, housing, real estate business, and credit institutions, and proposed that the National Assembly postpone the effective date of four laws related to land and real estate from August 1, 2024 to create a legal corridor to promote the development of investment and business activities. In the first 9 months of 2024, the Government held 9 thematic meetings on law-making; the Government issued 122 Decrees, 215 Resolutions, the Prime Minister issued 1,129 Decisions, 35 Directives, and held 3 Steering Committee meetings on reviewing and handling legal issues and problems. These specific actions, along with the strong direction of the Government and the Prime Minister in the work of building and perfecting policies and laws, have significantly contributed to promoting socio-economic development in recent times. |
Delegates focused on discussing and identifying shortcomings due to conflicts and incompatibilities between legal documents in construction investment activities and difficulties in regulations and implementation; procedures and preparation time for investment projects; the current time for carrying out licensing procedures is prolonged, slowing down the investment process, causing impacts and difficulties for businesses.

Regarding tax legal issues and solutions, the discussion focused on difficulties in value-added tax refunds that need to be amended and supplemented with regulations to make policies transparent and ensure value-added tax refunds according to the principles of risk management and timely tax refunds for businesses within the time limit prescribed by the law on tax administration.
At the event, delegates also mentioned the necessity of amending the Law on Corporate Income Tax in the context of enterprises tending to do business in multiple industries and fields.

Along with exchanging and correctly identifying existing legal issues in the production and business activities of enterprises related to the above two topics; the speakers also provided effective directions and solutions to solve legal issues in both aspects: perfecting the law and improving the effectiveness of law enforcement; at the same time, clearly identifying directions to amend, supplement or develop new legal documents, encouraging enterprises to innovate and promote development.
Delegates also discussed and deepened the following contents: The role of institutions to encourage innovation, creativity, and unlock resources to help businesses develop quickly and sustainably; the rule of law to create a transparent, favorable, safe, and equal investment and business environment; the interaction between state agencies and the business community to listen, remove difficulties, and resolve legal issues to serve development and breakthroughs; the issue of law enforcement and compliance by businesses to ensure national and ethnic interests.
It is known that this is the second time the forum has been organized, an activity under the Inter-sectoral Legal Support Program for Small and Medium Enterprises for the period 2021-2025, contributing to the effective implementation of the Project "Organizing policy communication with great impact on society in the process of building legal documents for the period 2022-2027".
This activity aims to innovate legal support activities for enterprises in the spirit of Resolution No. 41-NQ/TW, dated October 10, 2023 of the Politburo on building and promoting the role of Vietnamese entrepreneurs in the new period (Resolution No. 41-NQ/TW) and Resolution No. 66/NQ-CP, dated May 9, 2024 of the Government promulgating the Government's Action Program to implement Resolution No. 41-NQ/TW, listening to feedback from the business community, promptly grasping and identifying legal problems, difficulties and obstacles in the implementation process; thereby, proposing solutions to remove them, creating a favorable environment for investment, production and business of enterprises.
In Thanh Hoa, the whole province currently has more than 21,000 operating enterprises. In the first 9 months of 2024, the whole province established 2,400 new enterprises, ranking 8th in the country and leading the North Central provinces in the number of newly established enterprises. Along with guiding enterprises to comply with and implement the Central Government's legal policies, in order to create a favorable and open business environment for enterprises to develop, Thanh Hoa province has also issued its own development support mechanisms; at the same time, through organizations and associations, it has surveyed, grasped, and synthesized recommendations and problems of enterprises regarding shortcomings in policy implementation, thereby recommending the Central Government to amend and issue regulations suitable to reality, creating a favorable environment for enterprises to develop production and business. |
