The National Assembly voted to pass a Resolution on the 2024 Law and Ordinance Development Program and adjustments to the 2023 Law and Ordinance Development Program.
The Resolution stated that since the beginning of the 15th National Assembly's term, despite facing many difficulties due to the impact of the COVID-19 pandemic and the complicated and unpredictable developments of the world and regional situation, and many new issues arising, the National Assembly, the National Assembly Standing Committee, the Government and relevant agencies and organizations have made efforts to overcome difficulties and challenges, seriously implementing Conclusion No. 19-KL/TW of the Politburo on the orientation of the Law-making Program for the 15th National Assembly term and legislative tasks according to Plan No. 81/KH-UBTVQH15 of the National Assembly Standing Committee, achieving many positive results.
The work of law-making continues to have many innovations, creativity, practicality, efficiency, promoting democracy, increasing the rule of law, promoting responsibility with the spirit of proactive legislation, early and remote participation. A large number of laws, ordinances, and resolutions have been submitted to the National Assembly and the National Assembly Standing Committee for consideration and approval, completing the entire legislative program, ensuring the requirements on progress and quality.
The positive results achieved in legislative work have significantly contributed to the synchronous completion of development institutions, enhanced assurance of human rights and citizens' rights, effectively serving the requirements of socio-economic development, ensuring national defense, security, international integration, and continuing to build and perfect the socialist rule-of-law state of Vietnam.
However, in the work of establishing and implementing the law and ordinance building program, there are still some shortcomings and limitations that need to be urgently overcome to further improve the quality and effectiveness of law building work in the coming time.
Regarding the adjustment of the 2023 Law and Ordinance Development Program, the Resolution supplements the 2023 Law and Ordinance Development Program as follows: Submit to the National Assembly for comments at the 5th session (May 2023), and approve at the 6th session (October 2023) the draft Law on Forces Participating in Protecting Security and Order at the Grassroots Level.
Submit to the National Assembly for comments at the 6th session (October 2023): Law on National Defense Industry, Security and Industrial Mobilization; Law on Roads; Law on Road Traffic Order and Safety; Law on the Capital (amended); Law on Organization of People's Courts (amended); Law on Amending and Supplementing a Number of Articles of the Law on Property Auction.
Submit to the National Assembly Standing Committee for comments and approval of the draft Ordinance on litigation costs.
Regarding the law and ordinance making program in 2024. The resolution, at the 7th Session (May 2024), submitted to the National Assembly for approval 9 laws and 1 resolution, including: Law on Social Insurance (amended); Law on Archives (amended); Law on National Defense Industry, Security and Industrial Mobilization; Law on Roads; Law on Road Traffic Order and Safety; Law on the Capital (amended); Law on Organization of People's Courts (amended); Law on amending and supplementing a number of articles of the Law on Guards (according to the procedure at a session); Law on amending and supplementing a number of articles of the Law on Property Auction and Resolution of the National Assembly on the law and ordinance making program in 2025, adjusting the law and ordinance making program in 2024.
At the same time, the National Assembly will submit 9 draft laws for comments, including: Law on Notarization (amended); Law on Trade Unions (amended); Law on Cultural Heritage (amended); Law on Geology and Minerals; Law on People's Air Defense; Law on Urban and Rural Planning; Law on Juvenile Justice; Law on amending and supplementing a number of articles of the Law on Pharmacy; Law on amending and supplementing a number of articles of the Law on Technical Standards and Regulations.
At the 8th session (October 2024), the National Assembly will pass 9 laws: Law on Notarization (amended); Law on Trade Unions (amended); Law on Cultural Heritage (amended); Law on Geology and Minerals; Law on People's Air Defense; Law on Urban and Rural Planning; Law on Juvenile Justice; Law on amending and supplementing a number of articles of the Law on Pharmacy; Law on amending and supplementing a number of articles of the Law on Technical Standards and Regulations.
At the same time, submit to the National Assembly for comments two draft laws: Law on Gender Transition and Law on Employment (amended).
The Resolution requires the National Assembly Standing Committee, the Government, agencies, organizations and individuals participating in the law-making process to uphold responsibility, strengthen discipline and order; ensure strict implementation of the law and ordinance-making program; not propose to add projects to the program close to the National Assembly session, except in cases of real necessity and urgency, requiring timely implementation of the Party's guidelines and policies, conclusions and directions of the Politburo and the Secretariat; and thoroughly overcome the situation of submitting project dossiers and drafts not on time as prescribed.
If necessary, the Standing Committee of the National Assembly shall report to the National Assembly for consideration of organizing additional sessions or extending the regular meeting time of the National Assembly, dividing the sessions into sessions to consider giving opinions, and passing many laws and resolutions to meet practical requirements.
Agencies, organizations and individuals assigned to preside over drafting must seriously and substantially summarize law enforcement, assess policy impacts, collect and absorb opinions from agencies, organizations, individuals and affected subjects, ensuring practicality and effectiveness.
Drafting must have high requirements on quality, closely follow and promptly institutionalize the Party's policies and guidelines, meet practical requirements; comply with the requirements in Conclusion No. 19-KL/TW of the Politburo and the principles of drafting and promulgating legal documents. Carefully review relevant documents to detect and handle inconsistent regulations; ensure that there are no conflicts, overlaps, or loopholes that could lead to corruption, negativity, and the insertion of "group interests" and "local interests" in proposing, drafting, and promulgating policies and laws.
