A lot of work and very urgent time
Reporting at the meeting, Deputy Minister of Science and Technology Pham Duc Long said that at the 10th session of the 15th National Assembly , the Ministry of Science and Technology plans to submit to the National Assembly for consideration and approval four draft laws, including: the Law on Digital Transformation, the Law on Amending and Supplementing a Number of Articles of the Law on Intellectual Property, the Law on High Technology (amended), and the Law on Amending and Supplementing a Number of Articles of the Law on Technology Transfer.
In particular, the Digital Transformation Law project proposes 6 policies: (1) Promoting comprehensive digitalization of the real world and virtual reality connection; "Digital Twin" and data from physical-digital infrastructure (IoT); (2) Promoting the implementation of digital government and digital transformation of the activities of agencies in the political system; (3) Managing and promoting the development of digital economy, especially digital economy of platforms, digital economy of sectors and fields; (4) Managing and promoting the development of digital society according to the definition of digital citizens, regulations on State policies in building and developing digital society; (5) Institutionalizing the Party and State's policies on infrastructure development for national digital transformation stated in Resolution No. 57-NQ/TW; (6) Stipulating measures to ensure digital transformation activities such as: finance for digital transformation; statistics, measurement, monitoring (online), evaluation of digital transformation effectiveness; digital human resources; standards and regulations for digital transformation; data for digital transformation; and digital space security.
Regarding the draft Law on High Technology (amended), the basic content includes 6 policies: (1) Perfecting the concept and criteria of high technology; (2) Redesigning the system of policies and beneficiaries of priority, incentive and investment support policies; (3) Encouraging the development of the high-tech ecosystem; (4) Supplementing regulations on models of high-tech zones and high-tech cities; (5) Supplementing and perfecting regulations on state management of high technology, management, inspection, supervision and efficiency assessment mechanisms; (6) Supplementing regulations on requirements for comprehensive digital transformation of high-tech activities.
The next draft law is the Law amending and supplementing a number of articles of the Law on Intellectual Property, including 5 policies: (1) Supporting the creation and commercial exploitation of intellectual property rights to promote innovation; (2) Simplifying administrative procedures, facilitating the registration and establishment of intellectual property rights; (3) Improving the effectiveness of intellectual property rights protection activities; (4) Ensuring full implementation of Vietnam's international commitments on intellectual property protection in the integration process; (5) Updating new issues in intellectual property protection in the world in accordance with Vietnam's policies and socio-economic development level.
Regarding the draft Law amending and supplementing a number of articles of the Law on Technology Transfer, the basic content focuses on state management, monitoring, statistics, and measuring the effectiveness of technology transfer.
In addition, the Ministry of Science and Technology has been assigned to preside over the development of another law project, the AI Law. According to Deputy Minister Pham Duc Long, the time to complete and submit the draft laws is very short. The deadline for submitting to the National Assembly on August 30 is an extremely big challenge.
Review carefully for consistency and consistency
After listening to the report of the Ministry of Science and Technology and opinions from the Government Office, the Ministry of Justice, and relevant agencies, Deputy Prime Minister Nguyen Chi Dung said that this is an opportunity to better summarize and synchronize the legal system on science and technology. The Ministry of Science and Technology has made efforts to fulfill its tasks in the past time.
"We must ensure the urgency and quality of draft laws," the Deputy Prime Minister emphasized, pointing out two main difficulties: Implementation progress; simultaneously building and amending many laws can easily lead to duplication, and conflicts between regulations may occur.
According to the Deputy Prime Minister, first of all, it is necessary to clearly define the principles, ideas, and goals of amending the law; the causes, basis for supplementation, and benefits must be assessed.
"It is impossible for a provision to exist in both laws. It is even more impossible for a provision in one law to contradict a provision in another law. Therefore, the review work must be carried out very carefully," the Deputy Prime Minister especially noted.
The Ministry of Science and Technology is responsible for researching and reviewing to fully implement the viewpoints, directions, guidelines and policies of the Politburo; continuing to carefully review the difficulties and bottlenecks in various fields in the past time, to propose appropriate and practical mechanisms and policies.
At the same time, analyze and evaluate current major trends in the world and refer to successful experiences of other countries; organize seminars and conferences to listen to more opinions of domestic and foreign experts.
The Deputy Prime Minister suggested that in the field of intellectual property, it is necessary to promote the handling of backlog cases; ensure full implementation of international commitments of which Vietnam is a member; procedures for granting intellectual property rights...
Regarding high technology, the approach in management and development of high technology activities and strategic technology is consistent with the general development trend and enhances national competitiveness; amending mechanisms and policies to create a transparent, stable and attractive legal corridor for investment, production and business activities in the field of high technology and strategic technology.
The Deputy Prime Minister suggested promoting M&A and mergers and acquisitions of companies holding core technology to cooperate in research, access the value chain and commercialize immediately.
In technology transfer, it is necessary to carefully review incentive and support policies; existing problems, obstacles, and inadequacies; on that basis, consider and propose appropriate incentive and support policies, ensuring consistency and suitability in order to continue to improve incentive and support policies, promote research, development, transfer, and mastery of strategic technology, high technology, advanced technology, green technology, and environmentally friendly technology, etc.
Along with that is implementing maximum decentralization and delegation of power; cutting down and simplifying administrative procedures; ensuring effectiveness and efficiency in the process of law implementation; improving the effectiveness of state management of technology transfer activities.
