(NLDO) - Experts say that policy corruption is the most dangerous because it is very sophisticated, difficult to detect, and has a whole process and system.
On the afternoon of December 30, the Ho Chi Minh City Academy of Officials held a scientific workshop on controlling power, preventing and combating corruption and negativity in law-making: Theoretical and practical issues.
Promote decentralization and delegation of power
Speaking at the workshop, Dr. Tran Tuan Duy, Deputy Head of the Department of State and Law, Ho Chi Minh City Academy of Officials, emphasized that controlling power, preventing corruption and negativity in law-making is not only the task of state agencies but also the responsibility of the whole society.
Dr. Tran Tuan Duy said that this workshop will gather theoretical issues on power control, anti-corruption and negativity in law-making, and at the same time draw lessons from experience to propose practical and feasible solutions to improve law-making in Ho Chi Minh City in particular and the whole country in general in the coming time.

At the workshop, scientists and experts from many fields pointed out existing problems, opportunities and challenges in controlling power and preventing corruption and negativity in law-making. At the same time, they proposed practical solutions to contribute to perfecting the legal system in Vietnam.
Ms. Pham Phuong Thao, former Deputy Secretary of the City Party Committee and former Chairwoman of the Ho Chi Minh City People's Council, acknowledged that currently, some laws have a short "lifespan" and are outdated as soon as they are passed, so many investors see them as risky.

From there, Ms. Pham Phuong Thao said that it is necessary to improve the quality of draft legal documents; improve the quality of document drafting, so that there are fewer sub-law documents, and that legal documents issued are put into practice.
In addition, it is necessary to improve the quality of full-time National Assembly deputies to ensure the process of examining legal documents. In policy and law making, it is necessary to clearly decentralize and delegate power; avoid the mechanism of asking and giving; and have an address to take responsibility if decisions are wrong, causing delays and congestion.
Dr. Nguyen Minh Nhut, senior lecturer, former Head of the Department of Administrative Management, Ho Chi Minh City Academy of Officials, said that there are currently three main types of corruption. These are: corruption of assets; corruption of political power and corruption of policies. He analyzed that among the above types, corruption of policies is the most harmful because it is very sophisticated, difficult to detect, and has a whole process and system.
Therefore, it is necessary to promote the integrity of the subjects participating in policy making. In this case, integrity is not only a matter of moral education but must be legalized and sanctioned; those working in law making must be professional and have high qualities.
Building a "power cage" mechanism
Dr. Hoang Ngoc Anh, lecturer at the School of Training and Fostering Procuratorate Profession in Ho Chi Minh City, believes that controlling power in law-making is the premise and fundamental condition for preventing and combating corruption and negativity.
To improve the effectiveness of law-making, Dr. Hoang Ngoc Anh said that it is necessary to pay more attention to personnel work. Choosing the right person and assigning the right job is a prerequisite for the success of a legal project.
At the same time, strengthen dialogue activities in law-making work, dialogue to the end on issues with many different viewpoints in draft legal documents, avoid doing things for the sake of it, formalities, and subjectivity.

Meanwhile, Dr. Nguyen Hai Ho, Head of the Department of State and Law, Ho Chi Minh City Academy of Officials, said that it is necessary to plan a national strategy on controlling power, preventing and combating corruption and negativity in the work of law-making in the coming time. Continue to perfect the prevention mechanism (building a mechanism to "cage power"; "control power"), ensuring that "it is impossible", "not daring", "not necessary" for corruption in the work of law-making.
At the same time, build an inter-sectoral mechanism to limit local and group interests in law-making; assign tasks, responsibilities, and responsibilities to preside over and coordinate from policy planning, drafting advice, policy impact assessment, policy development implementation, and inclusion of policies in legal documents.
According to Dr. Nguyen Hai Ho, it is necessary to study the Party's regulations on controlling power, preventing and combating corruption and negativity in various fields, especially Regulation 178 on controlling power, preventing and combating corruption and negativity in law-making work.
In addition, it is necessary to determine legal responsibilities, including imposing sanctions associated with legal consequences that the law-making entity must bear if violations occur and vice versa, and to provide appropriate rewards, apply a mechanism for maintaining integrity in law-making work; train and build a team of talented and virtuous legal document drafting experts.
