Two major airlines sued for selling “window seats” that… don’t have windows

According to Reuters , the lawsuit against United Airlines was filed in San Francisco and the lawsuit against Delta Air Lines was filed in Brooklyn. The plaintiffs asked the airlines to pay millions of dollars in compensation to more than one million passengers of each airline.

According to the lawsuit, on some aircraft such as the Boeing 737, Boeing 757 and Airbus A321, there are rows of seats that are supposed to have windows but are actually blocked due to the installation of air conditioning systems, electrical lines or other technical components.

However, Delta Air Lines and United Airlines do not disclose this when selling tickets, even though they charge tens or sometimes hundreds of dollars for a "window seat," unlike competitors Alaska Airlines and American Airlines, which clearly warn.

Passengers said they chose the "window seat" not only to enjoy the scenery but also to reduce anxiety when flying, limit airsickness, give priority to young children or take advantage of natural light.

"If we had known that the 'window seat' did not have a window, we would not have chosen it, much less paid extra," the United Airlines lawsuit states.

The content of the Delta Air Lines lawsuit is similar.

Delta is headquartered in Atlanta, while United Airlines is headquartered in Chicago. Revenue from additional services such as seat selection, checked baggage, seat upgrades, airport lounges, etc. is a big source of revenue for airlines that help keep base fares lower.

According to attorney Carter Greenbaum, the fact that passengers can consult information from third-party websites cannot be considered an "excuse" for airlines to hide the fact that airplane seats actually have windows.

"A company cannot sell a false product and expect customers to discover it through a third party," he stressed.

The plaintiff in the Delta Air Lines lawsuit is Nicholas Meyer of Brooklyn, while the United Airlines lawsuit is being filed by Marc Brenman of San Francisco and Aviva Copaken of Los Angeles. Ms. Copaken said United Airlines refunded the seat selection fee for two flights with windowless seats, but refused to refund the fee for the third flight.

The lawsuits are pending. Neither airline has yet responded to a request for comment.
