The Ho Chi Minh City Inspectorate has just announced the conclusion of the inspection of the responsibility of the Director of the Ho Chi Minh City Department of Education and Training in implementing the law on inspection, receiving citizens, handling petitions, complaints and denunciations.

According to the Conclusion, regarding the implementation of the law on inspection, citizen reception, handling of petitions, complaints and denunciations, the Inspectorate of Ho Chi Minh City determined that the Director of the Department of Education and Training only received citizens 5 times and the total of 14 times of citizen reception by the Department's leaders in 2 years was not enough sessions as prescribed, and no notice of conclusion on citizen reception was issued.
The Department of Education and Training received 34 complaints under its jurisdiction but only accepted and resolved 3/34 complaints; received 76 denunciations, including 22 anonymous complaints and 31 duplicate complaints. The Department established a surprise inspection team related to 3 citizen complaints. The Department issued a notice of not accepting 13 complaints.
Regarding the responsibility of the Department of Education and Training in financial management and use, the Ho Chi Minh City Inspectorate concluded that the Department of Education and Training of Ho Chi Minh City still has limitations and shortcomings in monitoring, managing, compiling statistics and synthesizing financial disclosure at the Department and its affiliated units. This leads to many units not ensuring full implementation of financial disclosure in accordance with regulations.
The Department of Education and Training's issuance of an official dispatch guiding the collection framework for agreed fees for units under the department in the 2020-2021 school year is not within its authority.
The Department has not yet developed and submitted to competent authorities for promulgation of economic and technical norms for training sectors and educational and training services for which the State organizes bidding, orders, and assigns tasks from the budget.
Regarding collection and payment on behalf of others, the units have not ensured the principle of collecting enough to cover expenses (there is still a debt balance, not finalizing for each school year but continuing to collect over the years). In addition, the disclosure of plans and management of collection and payment for agreed collection and payment on behalf of others has not been fully ensured according to regulations.
The Department of Education and Training has not yet provided instructions on how to handle the collection and payment of more than VND590 million from the activities of the after-school cultural center to teach students at Cu Chi High School.
Some units under the Department still collect fees in cash and have not yet implemented non-cash payment methods for tuition fees and other fees. This is not strictly implemented in accordance with the spirit of Resolution 02 and Decision 241 of the Government.
In addition, the Department has not updated timely the data arising in monitoring, managing, statistics, and synthesizing the situation of receiving sponsorship and aid at its affiliated units. In fact, 5/7 randomly inspected units have not fully implemented the regulations. Ho Chi Minh City Inspectorate determined that there are still some schools that receive authorization from the parent representative committee to collect, manage, and use the parent fund.
Regarding budgeting and equipment management for exams, the Inspectorate concluded that the rental price of high-speed industrial paper shredders and high-speed black and white laser printers with double-sided printing... is 47.3-48% of the purchase price. The rental period of 2 months is almost equal to the purchase price of a new machine, showing that renting a machine needs to be carefully considered to ensure efficiency. The rental quantity increased by 1.3-2 times compared to the estimated purchase quantity, showing that the initial estimate of the purchase quantity for the exam was not close to reality.
Regarding the implementation of the arrangement of real estate facilities and management of public assets for leasing and association purposes, the Department of Education and Training also did not have any written opinions expressing its opinions on the projects of using public assets of its affiliated units, which is not in accordance with the direction of the Ho Chi Minh City People's Committee.
While waiting for approval of the project on using public assets, 7 schools were inspected in 2021 and 2022 as follows: signed contracts, appendices to extend lease contracts, and partnerships that have not been through bidding or auction, or have been through auction but did not re-auction at the end of the school year but continued to extend the contract (Le Quy Don High School, Nguyen Thi Dinh High School for the Gifted, Phu Nhuan High School, Tran Dai Nghia High School, Cu Chi High School); leased and partnered to perform ATM service activities (Ho Chi Minh City College of Economics and Technology), tea and cake shops, photocopying, renting classrooms and computer rooms (Nguyen Thuong Hien High School).
This responsibility belongs to the principal and related individuals during the period of the incident. In addition, the Finance and Planning Department of the Ho Chi Minh City Department of Education and Training is responsible for advising the department's leaders and reviewing the annual financial statements for the units.
Director of Department of Education and Training organizes review of collective and individual responsibilities
From the conclusion of the Ho Chi Minh City Inspectorate, the Chairman of the Ho Chi Minh City People's Committee basically agreed on the content and gave the following instructions: assigning the Director of the Department of Education and Training to organize a review of responsibilities within the collective leadership of the department, departments, principals of inspected units and collectives and individuals related to the content of the inspection conclusion according to their management authority. Along with that, propose directions to overcome and correct the shortcomings and violations mentioned in the inspection conclusion.
In addition, the Director of the Department of Education and Training must urgently review the inspection conclusion, re-count all the houses and land facilities that the Department and its affiliated units are managing and using to clearly classify the list of those that must be handled and rearranged and those that are not. From there, propose that the Ho Chi Minh City People's Committee continue to review the progress of implementing the house and land handling and rearrangement plan approved by the Ho Chi Minh City People's Committee;
The Director of the Department of Education and Training was also assigned to review the legal basis for leasing and association of affiliated units while waiting for approval of the project on using public assets; Carry out budget payment procedures for the collection and payment of 590 million VND at Cu Chi High School according to regulations... Issue documents to rectify the collection of tuition fees, collection of agreed fees, collection and payment on behalf of other units and other revenues at affiliated units.
