On April 30, General Secretary To Lam signed and issued Resolution No. 66-NQ/TW of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era. Ha Nam Newspaper respectfully introduces the full text of the resolution.

Resolution of the Politburo on innovation in law making and enforcement to meet the requirements of national development in the new era

Over the past time, our Party and State have had many innovative policies and strategies to improve the effectiveness of law-making and enforcement, achieving many important results.

The thinking and theoretical awareness of the socialist rule of law state are constantly being improved. Our country has formed a relatively synchronous, public, transparent, and accessible legal system that basically regulates all areas of social life; creating a legal foundation for socio-economic development, ensuring national defense, security, and international integration.

However, the work of building and enforcing laws still has many limitations and shortcomings. Some policies and orientations of the Party have not been institutionalized promptly and fully. The thinking of building laws in some areas is still inclined towards management. The quality of laws has not kept up with practical requirements. There are also overlapping, contradictory and unclear regulations that hinder implementation and are not favorable for promoting innovation, attracting and unlocking investment resources.

Decentralization and delegation of power are not strong enough; administrative procedures are still cumbersome. Law enforcement is still a weak link; there is a lack of timely and effective policy response mechanisms. Research and promulgation of policies and laws to regulate new issues are slow, and a favorable legal framework has not been created to promote new growth drivers.

In the context of the world undergoing epochal changes, in order for the country to firmly enter a new era - an era of breakthrough development, prosperity and strength under the leadership of the Party; along with implementing the revolution of streamlining the organizational apparatus, striving for "double-digit" economic growth, the work of building and enforcing laws must be fundamentally innovated, creating a strong driving force for the country's rapid and sustainable development. From the above situation, the Politburo requires the thorough implementation of the following contents:

I - GUIDING VIEWPOINT

1. Ensure the comprehensive and direct leadership of the Party in law-making; strengthen the Party's leadership in law enforcement. Strengthen control of power; prevent and combat corruption, waste, negativity, group interests, and local interests; prevent and stop all manifestations of profiteering and policy steering. Promote the role of supervision and social criticism of the Vietnam Fatherland Front, and the broad and substantial participation of people, organizations, and enterprises in law-making and law enforcement.

2. The work of building and enforcing laws is the "breakthrough of breakthroughs" in perfecting the country's development institutions in the new era; it is a key task in the process of building and perfecting the Vietnamese socialist rule-of-law state of the people, by the people and for the people, under the leadership of the Party.

3. Law-making must closely follow reality, "stand on the practical land of Vietnam", selectively absorb the quintessence of human values, ensure systematicity, seize all opportunities, pave the way, and unleash all resources; turn institutions and laws into competitive advantages, solid foundations, and strong driving forces for development, creating room to promote "double-digit" economic growth, improve people's lives, and ensure national defense, security, and foreign affairs.

4. Improve the effectiveness of law enforcement, focus on building a culture of law compliance, ensure respect for the Constitution and the law; closely link law making and enforcement.

5. Investing in policy and law making is investing in development. The State ensures and prioritizes resources to invest in facilities, modernize technical infrastructure, promote digital transformation, and have specific and outstanding regimes and policies for strategic research, policy making, law making, and the staff performing these tasks.

II - OBJECTIVES

1. By 2030

Vietnam has a democratic, fair, synchronous, unified, public, transparent, and feasible legal system with a strict and consistent implementation mechanism, ensuring a legal basis for the normal, continuous, and smooth operation of agencies after reorganizing the apparatus, removing obstacles arising from practice, paving the way for development creation, mobilizing all people and businesses to participate in socio-economic development so that by 2030, Vietnam will be a developing country with modern industry and high average income.

By 2025, basically complete the removal of "bottlenecks" caused by legal regulations. By 2027, complete the amendment, supplementation, and promulgation of new legal documents to ensure a synchronous legal basis for the operation of the State apparatus according to the 3-level government model. By 2028, complete the legal system on investment and business, contributing to making Vietnam's investment environment among the top 3 countries in ASEAN.

2. Vision to 2045

Vietnam has a high-quality, modern legal system, approaching advanced international standards and practices and suitable to the country's reality, strictly and consistently implemented, respecting, ensuring and effectively protecting human rights and citizens' rights; upholding the Constitution and the law becomes the standard of conduct for all subjects in society; modern national governance with a streamlined, efficient, effective and efficient State apparatus, meeting the requirements of rapid and sustainable national development, becoming a developed country with high income in the direction of socialism by 2045.

III - TASKS AND SOLUTIONS

1. Ensure the comprehensive and direct leadership of the Party in law-making work, and promote Party spirit in law-making and enforcement.

- Party committees at all levels must comprehensively and directly lead the institutionalization of the Party's policies and guidelines into laws and strengthen inspection and supervision of this work. Each cadre and party member must be exemplary and take the lead in implementing and complying with the law, spreading the spirit of respect for the Constitution and the law.

- Identifying the building and improvement of institutions and laws and the inspection and supervision of law enforcement as the central, continuous and regular tasks of central ministries and branches. Strictly implementing discipline, rules and regulations on power control, preventing and combating corruption, waste, negativity and "group interests" in building and enforcing laws.

The head of a ministry or ministerial-level agency must directly lead and direct the work of law-making, and be primarily responsible for the quality of policies and laws in the areas under his or her management; in conjunction with the work of evaluating, rewarding, and using cadres, and have sanctions and measures to deal with those who do not fully fulfill their responsibilities of leading and directing the work of law-making.

- Ministries, ministerial-level agencies and agencies of the National Assembly must structure at least one leader with legal expertise. Local Party committees must pay attention to assigning Party committee members in charge of judicial work and the structure of Directors of the Department of Justice participating in provincial Party committees; there must be a mechanism to mobilize and rotate cadres and civil servants of the Ministry and the justice sector to go to localities and work at central ministries and sectors to supplement practical experience.

2. Innovate thinking and orient the development of laws in a way that both ensures the requirements of State management and encourages creativity, liberates all productive forces, and opens up all development resources.

- The work of law-making must fully, correctly and promptly institutionalize the Party's policies and guidelines; stem from the overall interests of the country; turn institutions and laws into competitive advantages; resolutely abandon the mindset of "if you can't manage it, ban it"; promote democracy, respect, ensure and effectively protect human rights and civil rights; ensure the balance and rationality between the level of rights restriction and the legitimate interests achieved.

The provisions of the law must be stable, simple, easy to implement, and people and businesses-centered. The role of social ethics, professional ethics, and community self-management rules must be properly promoted in regulating social relations.

- Pay attention to and proactively research strategies and policies early, from practice and from world experience, contributing to enhancing predictability and improving the quality of law-making work. Ensure the process of building and promulgating legal documents is democratic, professional, scientific, timely, feasible and effective; clearly distinguish the process of building policies and the process of drafting documents; gradually implement the drafting of legal documents in a centralized and professional manner.

Activities of summarizing, surveying practices, studying international experiences, assessing policy impacts, and selecting policies must be carried out thoroughly, practically, and scientifically.

Strengthen policy communication, especially policies that have a major impact on society, people and businesses. Strictly implement the mechanism for receiving and explaining comments from affected subjects; do not make it difficult for people and businesses to design policies and build laws.

In addition to some codes and laws regulating human rights, civil rights, and judicial procedures that need to be specific, basically other laws, especially laws regulating development creation contents, only regulate framework issues, issues of principle under the authority of the National Assembly, while practical issues that frequently change are assigned to the Government, ministries, branches, and localities to regulate to ensure flexibility and suitability to reality.

- Develop and perfect the law on socialist-oriented market economy in the direction of building a favorable, open, transparent, safe legal environment with low compliance costs; thoroughly cut and simplify unreasonable investment, business and practice conditions and administrative procedures; promote creative startups, improve the investment and stable business environment.

Substantially guarantee the right to freedom of business, property ownership and freedom of contract; equality among enterprises of all economic sectors; the private economy is the most important driving force of the national economy.

Create a legal basis for the private economic sector to effectively access resources of capital, land, and high-quality human resources; promote the formation and development of regional and global private economic groups; and provide substantial and effective support to small and medium-sized enterprises.

Focus on building laws on science, technology, innovation and digital transformation, creating a legal corridor for new, non-traditional issues (artificial intelligence, digital transformation, green transformation, data resource exploitation, crypto assets...) to form new growth drivers, promote the development of new productive forces, new industries. Build breakthrough, superior, competitive mechanisms and policies for international financial centers, free trade zones, key economic zones...

Urgently amend and supplement legal documents to meet the requirements of implementing the policy of streamlining the political system's organizational apparatus, arranging administrative units, associated with maximum decentralization and delegation of power according to the motto "locality decides, locality does, locality is responsible" and restructuring new development spaces in each locality.

Develop and perfect laws on the organization and operation of judicial agencies and judicial support agencies in accordance with the goals and orientations of judicial reform. Promote the strong development of the legal service system, legal support, legal aid, and registration of security measures, so that people and businesses can easily access the law and manage legal risks. Prioritize legal support resources for the private economic sector.

Research on the establishment of a public lawyer institution and a conditional mechanism allowing civil servants to practice law; ensuring the recognition and enforcement of arbitration awards in accordance with international standards and practices.

Research to expand the scope and improve the effectiveness of applying simplified judicial procedures; combine non-judicial procedural methods with judicial procedural methods; have solutions to encourage and develop institutions for resolving disputes outside of court such as commercial arbitration, commercial mediation, etc.

3. Create breakthroughs in law enforcement, ensure that laws are implemented fairly, strictly, consistently, promptly, effectively and efficiently; closely link law making and enforcement.

- Promote the spirit of serving the people, the mindset of creating development, and acting for the common interests of the team of cadres, civil servants, and public employees; consistently implement the viewpoint that people and businesses are allowed to do anything that is not prohibited by law.

Prioritize ensuring effective law enforcement to promote socio-economic development, science, technology, innovation, digital transformation and other important areas of public life (food safety, environmental protection, security and safety in cyberspace...).

Promoting the role of the Vietnam Fatherland Front, social organizations, and socio-professional organizations in supervising law enforcement.

- Focus on building a culture of law compliance, ensuring that the Constitution and the law become the standard of conduct for all subjects in society. Diversify methods of policy communication, dissemination and legal education, especially through the application of digital technology; prioritize important content broadcast in time slots that attract a large audience on the national radio and television system.

- Focus on explaining the law and guiding the application of the law to ensure the vitality of legal documents. Regularly inspect, review, consolidate and systematize legal documents.

Strengthen dialogue, receive, listen to feedback, recommendations, promptly resolve difficulties and legal problems of individuals, organizations, businesses, and localities. Regularly evaluate the effectiveness of laws after promulgation, promote the application of technology and build a mechanism to promptly identify, handle comprehensively, synchronously, and quickly remove "bottlenecks" caused by legal regulations.

- Promote the work of preventing and warning against law violations along with strengthening supervision, inspection, examination, detection and strict and timely handling of law violations, especially acts of corruption, negativity, abuse of power, and lack of responsibility; at the same time, contribute to overcoming the disease of shirking responsibility and avoiding responsibility.

It is strictly forbidden to take advantage of the prevention and fight against corruption, waste and negativity for personal gain or to interfere with or obstruct the normal operations of agencies, organizations and individuals. Do not "criminalize" economic, administrative and civil relations; do not use administrative measures to intervene and resolve civil and economic disputes.

4. Improve the effectiveness of international cooperation and international law.

- Perfecting mechanisms and enhancing the capacity of Vietnamese agencies and organizations to ensure full implementation of international legal obligations, shaping the international legal order; actively participating in building international institutions and laws; effectively and flexibly utilizing the advantages from commitments of international treaties to which Vietnam is a member.

Properly handle arising international legal issues, especially international investment and trade disputes, to promptly protect national interests, legitimate rights and interests of individuals, organizations, enterprises, and Vietnamese State agencies.

- Implement a special mechanism to attract, select, train and foster highly qualified human resources with practical experience in international law and international cooperation in law, and international dispute resolution; develop a strategy to increase the presence of Vietnamese experts in international legal organizations and international judicial bodies.

- Expand international cooperation on law and justice; build and develop a network of foreign legal experts, including overseas Vietnamese, to support research and consultation on new issues in socio-economic development, science, technology, innovation and digital transformation.

5. Building breakthrough solutions to improve the quality of legal human resources

- Implement special and outstanding policies, apply appropriate remuneration and contract regimes to attract and improve the quality of human resources participating in tasks and activities of law making and law enforcement.

There are mechanisms and policies to extend the working time and not hold positions for a number of cadres and civil servants who have reached retirement age according to regulations but have high professional qualifications and profound practical experience in law-making.

Attract and recruit experts, legal scientists, jurists and good lawyers into the public sector.

Monthly support equal to 100% of salary according to current salary coefficient for those who directly and regularly do consulting work on strategy, policy research, and law making at a number of agencies and units.

- Improve the quality of law training, develop key and prestigious law training institutions; resolutely terminate the operation of law training institutions that do not meet the prescribed criteria and standards. Develop programs and organize specialized training courses on law making. Develop training standards for judicial and judicial support positions.

- Focus on investing in improving the quality of strategic and policy research facilities and legal research facilities of central agencies, including developing a project to upgrade the organization of strategic and policy research in the legal field under the Ministry of Justice to become a key national research facility and a policy and legal research center among the leading ASEAN countries.

6. Strengthen digital transformation, apply artificial intelligence and big data in law making and enforcement.

- Prioritize resources for building and developing information technology infrastructure, large databases, applying digital technology and artificial intelligence to serve innovation and modernization of law-making and law enforcement, ensuring "correctness, sufficiency, cleanliness, liveness", connectivity, ease of exploitation, ease of use, information security and state secrets. Timely and adequately allocate funds to build and immediately implement the Project on building a large database on law and the Project on applying artificial intelligence in the work of building, checking and reviewing legal documents.

- Apply digital technology and synchronize digital transformation in disseminating and educating the law, providing legal aid, and registering security measures; integrate the content of disseminating and educating the law into the "digital learning" movement. Have policies to promote the development of digital technology enterprises, providing digital services and utilities in the legal field.

- Apply special mechanisms and policies to create breakthroughs in science, technology, innovation and national digital transformation for digital transformation activities, application of artificial intelligence and big data in law making and enforcement.

7. Implement a special financial mechanism for law making and enforcement.

- Innovate the mechanism for allocating, managing and using the budget for law-making work on the principle of timeliness, accuracy, sufficiency and linking expenditures to the results and products of each task and activity. The head of the agency assigned with the task and activity of law-making has the right to take the initiative and be responsible before the law for allocating, managing and using the assigned funds.

- Ensure that spending on law-making is not less than 0.5% of the total annual budget expenditure and gradually increases according to development requirements. Establish a Fund to support the development of policies and laws guaranteed by the State Budget, combining legal socialized funding sources from domestic organizations and individuals, contributing to supporting and improving the quality of law-making work; ensuring efficiency, associated with public and transparent management, preventing and stopping all manifestations of profiteering and policy steering.

- Allocate appropriate and proportionate budget resources for law enforcement. Prioritize proportionate resources for dissemination, legal education, and legal aid for special, disadvantaged groups and ethnic minorities.

V - IMPLEMENTATION ORGANIZATION

1. Establish a Central Steering Committee on institutional and legal improvement headed by the General Secretary of the Party Central Committee. Participants include representatives of the National Assembly, the Government and relevant agencies.

2. The Party Committee of the National Assembly leads, directs, and perfects laws to meet the requirements of national development in the new era; strengthens supervision of implementation according to regulations.

3. The Government Party Committee shall lead and direct the development of an action program to implement the Resolution; coordinate with the National Assembly Party Committee to fully and promptly institutionalize the guidelines and policies stated in this Resolution; direct the Ministry of Justice to develop and submit to the 9th Session of the 15th National Assembly for promulgation a Resolution on a number of special mechanisms and policies to create breakthroughs in the development and organization of law enforcement.

4. The Vietnam Fatherland Front leads and directs the development of programs and plans to guide and mobilize people to implement the Resolution, promote the role of supervision, social criticism, participate in the development and enforcement of laws, and build a culture of law compliance.

5. The Central Propaganda and Mass Mobilization Commission shall preside over and coordinate with relevant agencies to guide the implementation of the Resolution; guide the strengthening of propaganda of the Resolution's contents.

6. Provincial and municipal Party Committees directly under the Central Government have specific programs and plans to strengthen leadership and direction in the work of building and enforcing laws in the locality.

7. The Party Committee of the Ministry of Justice performs the tasks of the standing agency of the Central Steering Committee on institutional and legal improvement; presides over and coordinates with the Central Internal Affairs Committee and relevant agencies to monitor, inspect and evaluate the implementation results of the Resolution, and periodically reports the results to the Central Steering Committee and the Politburo every 6 months.

This resolution is disseminated to the Party cell.
