From 2026, apply zero emission level to imported, manufactured and assembled 4-wheel vehicles

From January 1, 2026, imported, manufactured and assembled four-wheeled passenger and cargo vehicles with engines will officially apply zero emission standards.

According to Decision No. 19/2024/QD-TTg dated November 15, 2024 of the Prime Minister stipulating the roadmap for applying emission standards to imported and manufactured and assembled motor vehicles, from January 1, 2026, the emission standard (TCKT) of 0 will be officially applied to four-wheeled passenger vehicles with engines and four-wheeled cargo vehicles with engines imported and manufactured and assembled.

Explaining this regulation, the Ministry of Transport said that four-wheeled passenger and cargo vehicles with engines were not previously regulated in the 2008 Road Traffic Law. These types of vehicles operate within a narrow range, and are being piloted under the direction of the Government and the Prime Minister.

Up to now, the Law on Road Traffic Order and Safety in 2024 has stipulated that this type of vehicle is one of the types of motor vehicles. Thus, in the coming time, four-wheeled motorized passenger and cargo vehicles may develop.

Due to the nature and technical requirements for this type of vehicle being lower than that of automobiles, it is not appropriate to apply the same TCKT level as automobiles for testing and certification. However, if a low TCKT level is applied, the risk of outdated technology, fuel consumption and environmental pollution will flood into Vietnam.

To prevent this risk and implement the Party and State's policy on green energy conversion in transportation, the Prime Minister has decided to apply a zero-emissions tax rate for these types of vehicles from January 1, 2026, aiming to orient the transition to using electricity and green energy that do not emit pollutants.

A four-wheeled motor vehicle is a motorized road vehicle that runs on an engine, has a passenger structure, two axles and at least four wheels. The vehicle has a design speed of no more than 30 km/h, and no more than 15 seats (including the driver's seat).

A four-wheeled motor vehicle is a motor vehicle with two axles, four wheels, and the engine and cargo bed mounted on the same chassis (similar to a truck with a load capacity of less than 3,500 kg).

Thereby, contributing to the goal of reducing greenhouse gas emissions in transportation towards net zero emissions by 2050 according to Vietnam's commitment at the 26th Conference of the Parties to the United Nations Framework Convention on Climate Change (COP26).

Similarly, three-wheeled motorbikes and three-wheeled motorbikes manufactured, assembled and imported also have a roadmap to apply a TCKT rate of 0 from January 1, 2026. The Ministry of Transport said that according to the provisions of Resolution No. 05/2008/NQ-CP dated February 4, 2008 of the Government, new motorbikes and three-wheeled motorbikes are not granted circulation permits except for three-wheeled motor vehicles for the disabled.

Therefore, the regulations on the roadmap for applying the TCKT level from 2008 to present do not stipulate the application of the TCKT level to motorbikes and three-wheeled motorbikes. Also from 2008 to present, this type of vehicle has not been tested, certified, or licensed for circulation.

The 2024 Law on Road Traffic Order and Safety does not stipulate any prohibition or restriction on motorbikes and three-wheeled motorbikes; Clause 1, Article 34 of the Law stipulates that motorbikes and three-wheeled motorbikes are one of the types of motor vehicles. Therefore, it is possible that this type of vehicle will be allowed to circulate and develop again when Resolution No. 05/2008/NQ-CP expires.

As with four-wheeled motor vehicles, to prevent the risk of outdated technology and environmental pollution, the Prime Minister decided to apply a 0% TCKT rate to three-wheeled motorbikes and three-wheeled motorbikes from January 1, 2026.

Decision 19/2024/QD-TTg still maintains some regulations on the roadmap for applying TCKT levels for some types of vehicles. For example: New imported cars and manufactured and assembled cars continue to apply TCKT Level 5 from January 1, 2025.

Newly imported two-wheeled motorbikes and locally manufactured and assembled motorbikes will continue to apply TCKT Level 2 from January 1, 2025 to June 30, 2027; TCKT Level 4 will apply from July 1, 2027.

Newly imported two-wheeled motorcycles and manufactured and assembled motorcycles will continue to apply Level 3 emission standards from January 1, 2025 to June 30, 2026; Level 4 emission standards will apply from July 1, 2026.

Used imported cars continue to apply TCKT Level 4 from January 1, 2025.
