Land without papers will be granted red books from January 1, 2025
The 2024 Land Law details cases where households and individuals using land without documents will be granted red books. Accordingly, the granting of specific red books to households and individuals using land without documents is based on different land use time frames.
The law divides groups of cases that are granted red books for land without documents, including: First, households and individuals using land before December 18, 1980, now confirmed by the People's Committee of the commune where the land is located that there is no dispute.
Second, households and individuals using land from December 18, 1980 to before October 15, 1993, are now confirmed by the People's Committee of the commune where the land is located to have no disputes.
Third, households and individuals using land from October 15, 1993 to before July 1, 2014, are now confirmed by the People's Committee of the commune where the land is located to have no disputes.
For the above cases, specific regulations on granting red books will be implemented differently.
Answering the question regarding the issuance of red books for land without documents before July 1, 2014, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that this provision was included in the law on the basis of practical grounds, meeting the requirements of land management. The issuance of red books must ensure the requirement of "no disputes". The process of issuing red books, especially in cases where there are no documents on land use rights, is based on actual land use, in which the history of land management is extremely important. More than anyone else, only officials who are directly involved with the people, directly control the local land fund, and manage land movements can grasp this.
“The law clearly stipulates the policy and conditions for undocumented land to be granted a red book: the land must be used stably, without disputes, and confirmed by the People's Committee at the commune level. Along with that, the implementation factor requires local authorities, the Fatherland Front, and even inspection and examination agencies to consider whether the implementation will cause difficulties for the people. In the guiding decree, the Ministry of Natural Resources and Environment will include the procedures for granting red books in cases of undocumented land to minimize difficulties and troubles for the people,” Deputy Minister of Natural Resources and Environment Le Minh Ngan informed.
In addition, according to Deputy Minister of Natural Resources and Environment Le Minh Ngan, people's awareness must also ensure that the proposal to issue red books is in accordance with the law, avoiding social conflicts during the policy implementation process. This is a very good policy that inherits previous Land Laws and is based on current practice.
Maintain the land price list plan to be issued annually
Regarding the land price list to be issued, effective from January 1, 2026, according to Deputy Minister of Natural Resources and Environment Le Minh Ngan, after careful assessment, through many meetings and analysis, the National Assembly has approved and maintained the plan as presented that the land price list will be issued annually.
Regarding the preparation of the basis for building a land price list in the context of removing the land price framework so that the policy can truly come into life, avoiding congestion, and at the same time, from the time the law is passed to the issuance of the new land price list (January 1, 2026), it will take nearly 2 years, Deputy Minister of Natural Resources and Environment Le Minh Ngan affirmed that there are specific regulations in the transition process.
Accordingly, in 2025, the land price table of the 2013 Land Law will still be used, with adjustments and supplements to ensure consistency with market land prices according to the land valuation principles of this law for application.
In order to prepare carefully and thoroughly for the new land price list from January 1, 2026, the law has stipulated that the land price list is determined by area and location. In particular, for areas and localities that have cadastral maps and land price databases, the land price list is determined by the land plot, according to the value of that land plot. Along with that, localities are encouraged to increase investment in funds, human resources, solutions... to build a land database according to policies and laws. Strive to complete this content by 2025.
