Concentrate maximum resources, determined to implement the Law projects on schedule

The Government highly appreciates the ministries and agencies that presided over and participated in the drafting of the Law projects for actively and proactively researching and seriously implementing to complete the assigned tasks at the 5th Session of the National Assembly.

In Resolution No. 95/NQ-CP, the Government highly appreciated the ministries and agencies that presided over and participated in the development of the Law projects for actively and proactively researching, reviewing, having professional methods, coordinating early and remotely with the agencies of the National Assembly, creating high consensus, and seriously implementing to complete the assigned tasks at the 5th Session of the National Assembly.

The Government requires Ministers and Heads of ministerial-level agencies to directly direct the work of law-making, focus on directing and allocating resources to overcome material, financial and human resource shortcomings to meet the requirements on progress and quality of projects and draft legal documents. In particular, ministries and branches need to strengthen discipline and order in law-making work in accordance with the Government's direction to overcome shortcomings in current legal regulations that are not suitable to reality and not feasible, and strengthen decentralization and delegation of authority in conjunction with inspection, supervision, handling of violations and emulation and rewards.

Heads of agencies and units shall proactively review current legal regulations in Laws, Ordinances, Decrees and Circulars to overcome practical difficulties and shortcomings, and handle conflicts and overlaps. Amended and supplemented regulations must be clear and specific, ensuring the harmony of interests of the State, enterprises and people; for new contents, it is necessary to carefully assess the conditions of facilities, human resources and other necessary conditions as well as the implementation roadmap to have appropriate regulations to ensure feasibility.

Ministers and heads of ministerial-level agencies must concentrate the highest resources and be determined to implement the Law projects submitted to the National Assembly at the 6th Session on schedule, especially difficult, complicated and impactful Law projects. The drafting agencies need to thoroughly grasp the policy of decentralization and delegation of power to local authorities to unlock institutional resources and promote socio-economic development during the law-making process; need to comprehensively summarize and evaluate the implementation of current legal regulations to propose issues that need to be amended and supplemented, creating favorable conditions, suitable to reality, with a roadmap suitable to the conditions, culture and traditions of Vietnam. During the law-making process, the drafting agency needs to closely coordinate with relevant ministries and agencies to discuss and reach consensus on issues with different opinions; Seriously study and absorb opinions from organizations, associations, experts, and scientists to perfect the content of draft laws, create high consensus, and improve the quality of draft laws submitted to the National Assembly in 2023.

The Government highly appreciates the Ministries and ministerial-level agencies for proactively developing and preparing the following contents: Proposal to develop the Law on Teachers; Draft Law on Archives (amended); Proposal to develop the Law on Chemicals (amended); the development of a draft Law on amending and supplementing laws with provisions related to investment and budget to remove difficulties and obstacles of public investment projects.

Clearly define the subjects and contents of state management of private archives.

Regarding the draft Law on Archives (amended), the Government requested the Ministry of Home Affairs to complete the policy on private archives in the direction of: clearly defining the subjects and contents of state management of private archives; the mechanism for the State to purchase, sell, and use private archives for a limited time; the model, operating conditions, and responsibilities of private archives organizations; ensuring the harmony of interests of the State, individuals, and enterprises. Research and complete regulations on archival service activities to ensure the principles of unity and fairness; supplement regulations to enhance the responsibility of enterprises participating in archival service business activities, ensuring security and safety in archival activities.

The Government approved 5 policies in the Proposal to build the Law on Teachers.

Regarding the proposal to develop the Law on Teachers, the Government agreed to approve the proposal of the Ministry of Education and Training on the necessity of promulgating the law and 05 policies in the Proposal to develop the Law on Teachers, including: (1) Identification of teachers; (2) Standards and titles of teachers; (3) Recruitment, use and working regime of teachers; (4) Training, fostering, rewarding and honoring teachers; (5) State management of teachers.

The Government assigned the Ministry of Education and Training to research and fully institutionalize the Party's policies on teachers; summarize and thoroughly review current laws to ensure consistency and unity. In the process of drafting the Law, it is necessary to overcome current shortcomings in state management of teachers to design policies in the direction of strong decentralization and delegation of power to localities, with standards and criteria appropriate to the role and job position of teachers, with appropriate incentive, reward and honor policies; study more international experience, organize seminars to solicit opinions from experts, scientists, and policy communication to increase persuasiveness when passing policies, ensuring feasibility in the implementation process when the law is promulgated.

The proposal to draft the Law on Teachers is to draft a new, difficult law with a wide scope and great impact, with many important policies related to many laws, requiring priority policies on resources and implementation. Due to the short time expected to submit to the Government and the National Assembly for approval, the Ministry of Education and Training has proactively arranged financial and expert resources to draft the law, ensuring the right progress and improving the quality of the draft Law when submitted to the Government.

Integrated chemical management throughout the entire life cycle

Regarding the Proposal to develop the Law on Chemicals (amended), the Government basically agrees with 04 policies in the Proposal to develop the Law as proposed by the Ministry of Industry and Trade, including: (1) Sustainable development of the chemical industry into a modern, fundamental industry; (2) Synchronous management of chemicals throughout the entire life cycle; (3) Management of hazardous chemicals in products; (4) Improving the effectiveness of ensuring chemical safety.

The Ministry of Industry and Trade is studying and perfecting policy contents in the direction of increasing decentralization and decentralization of management to local authorities, complying with the laws of competition and market supply and demand, and comprehensively amending the 2007 Chemical Law to manage according to the chemical life cycle, ensuring safety and environmental protection in the business, use, consumption, storage and preservation of chemicals.

Regarding the drafting of laws amending and supplementing laws related to investment and budget to remove difficulties and obstacles of public investment projects, the Government assigned the Ministry of Planning and Investment to preside over and coordinate with the Ministry of Finance, the Ministry of Justice and relevant ministries and agencies to propose the content of the Proposal to draft laws amending and supplementing laws related to investment and budget to remove difficulties and obstacles of public investment projects, and report to the Government Standing Committee before July 10, 2023.
