The National Assembly listened to the Presentation and the report on the review of the Electricity Law project (amended).

BTO - Continuing the program of the 8th Session, 15th National Assembly, on the afternoon of October 21, under the direction of Vice Chairman of the National Assembly Nguyen Duc Hai, the National Assembly listened to the Presentation and report on the review of the Electricity Law project (amended).

According to the Government's Submission, the draft Electricity Law (amended) aims to perfect legal regulations on electricity, institutionalize the Party's viewpoints, policies and guidelines, and legalize the State's orientations and policies on innovation of mechanisms and policies, and develop a synchronous, interconnected, modern and effective energy market, in line with the socialist orientation.

Chairman of the Committee for Science, Technology and Environment Le Quang Huy - National Assembly Delegate of Binh Thuan province presented the report on the review of the Electricity Law project (amended).

Reviewing this content, Chairman of the Committee for Science, Technology and Environment (SC&ET) Le Quang Huy - National Assembly Delegate of Binh Thuan province stated that the SC&ET basically agrees with the necessity of promulgating the Electricity Law (amended). The draft law dossier is basically qualified to be submitted to the National Assembly for consideration and comments at the 8th Session. The Committee requested the drafting agency to provide additional information and supplement relevant documents; continue to review the draft Law to ensure its consistency with the 6 approved policies; study and fully institutionalize the Party's policies, ensuring the consistency and unity of the legal system.

Some opinions agree with Submission No. 520/TTr-CP on comprehensively amending the current Electricity Law. However, some other opinions believe that in the current context, along with the Government's proposal to pass this Law project under the one-session process, it is not necessary to comprehensively amend the Electricity Law but should only focus on truly urgent issues whose impacts have been carefully assessed, as a basis for implementing the immediate goal of ensuring national energy security.

Regarding electricity trading activities towards promoting a transparent, fair, efficient competitive electricity market and electricity prices according to market mechanisms (from Article 60 to Article 88, Chapter V), the Committee for Science, Technology and Environment found that the provisions in Clause 2, Article 61 on the competitive electricity market are unclear and recommended a review to ensure specificity and consistency; there are no regulations on the "term electricity market" and "spot electricity contracts", which should be reviewed to ensure consistency with the Commercial Law. The Committee recommended that additional information be studied in the electricity trading contract for domestic use and the content of electricity trading activities be clarified; additional provisions on the principles of price determination and responsibilities of the parties in the electricity service contract; additional criteria for determining retail electricity prices to ensure fairness and transparency in the competitive electricity market.

In addition to the issues of concern to the National Assembly deputies, the Committee on Science, Technology and Environment proposed a number of key contents for discussion and consultation. Specifically, the institutionalization and concretization of the Party's policies and guidelines; The consistency, unity and feasibility of the provisions in the draft Law. The contents specify 6 policies: Planning and investment in electricity development; Development of renewable energy and new energy; Conditions for electricity operation, electricity operation licenses; Management of electricity trading activities and electricity prices; Management and operation of the electricity system, economical use of electricity, management of electricity demand and adjustment of electricity load; Safe use of electricity after the meter and ensuring the safety of dams and hydroelectric reservoirs. Do the concretization of the 6 policies solve the practical difficulties of the electricity industry today? At the same time, the Government's proposal to submit to the National Assembly for consideration and approval according to the 1-session process at this Session.
