The leader of the Traffic Police Department (PC08, Ho Chi Minh City Police) informed that the Traffic Police had received a clip being shared on social media about the image of Quoc Co - Quoc Nghiep appearing with an electric motorbike running but not wearing a helmet, performing a head-to-head performance.

The incident of two circus artists Quoc Co - Quoc Nghiep has caused public opinion to compare with the case of lingerie model Ngoc Trinh being prosecuted and temporarily detained on October 19 for "disturbing public order". Previously, Ngoc Trinh posted many clips of herself riding a motorbike with both hands off the wheel, lying on the saddle, and sitting to one side while driving on social media, causing public outrage.

Lawyer Le Van Hoan (Ho Chi Minh City Bar Association) said that according to the Law on Cyber ​​Security, individuals and organizations using cyberspace are not allowed to provide or disseminate information on cyberspace with content that incites riots, disrupts security, or disturbs public order; are not allowed to call, mobilize, incite, threaten, or entice crowds to gather to cause trouble, resist law enforcement officers, obstruct the activities of agencies and organizations, causing instability in security and order; and other acts using cyberspace, information technology, and electronic means to violate the law on national security, social order and safety.

Therefore, according to lawyer Hoan, if individuals or organizations violate, depending on the nature and severity of the violation, they will be subject to disciplinary action, administrative sanctions or criminal prosecution; if causing damage, they must compensate according to the provisions of law.

“There are cases where the behavior may be similar but the purpose and motive are different, and most importantly, is the behavior performed and then recorded and posted on cyberspace intended to incite riots, disrupt security, disturb public order, call for, mobilize, incite, threaten, or entice crowds to gather to cause trouble?”, lawyer Hoan analyzed and said that the authorities need to verify and clarify the context, conditions, and legal framework of the clip recording to be able to conclude whether the behavior violates the law or not.

Model Ngoc Trinh was prosecuted and temporarily detained for 3 months after the incident of driving a motorbike with both hands free in Ho Chi Minh City, organizing the filming and posting of the clip online, causing a stir in public opinion.

Lawyer Hoan emphasized that the case of Quoc Co - Quoc Nghiep may be compared to the case of Ngoc Trinh by many people. However, as analyzed above, the authorities need to clarify whether there is a basis for handling or not, and if so, whether it is an administrative or criminal violation.

Regarding the case of two circus artists Quoc Co - Quoc Nghiep, lawyer Bui Duc Tuan (Ho Chi Minh City Bar Association) also affirmed that Article 30 of the Road Traffic Law strictly prohibits motorcyclists from letting go of both hands or riding with one wheel for 2-wheeled vehicles, with two wheels for 3-wheeled vehicles; other acts that cause disorder and traffic safety.

"The actions of Quoc Co and Quoc Nghiep, regardless of their purpose, violate the law. However, to determine administrative and criminal penalties, it is necessary to clarify the level of violation of security, order and social safety," said lawyer Tuan.

On October 19, the Ho Chi Minh City Police Department prosecuted and temporarily detained Tran Thi Ngoc Trinh (model Ngoc Trinh, 34 years old, from Tra Vinh) for 3 months for the crime of "disturbing public order".

Ho Chi Minh City police determined that model Ngoc Trinh did not have an A2 driver's license but still organized and performed with Tran Xuan Dong (indicted with Ngoc Trinh - PV) the act of driving a large-displacement motorbike with dangerous and offensive driving movements such as lying down, kneeling on the saddle, letting go of both hands to let the motorbike run on its own... performing on a public road in Thu Thiem Ward and Tang Nhon Phu B Ward (Thu Duc City, Ho Chi Minh City); causing negative impacts on the security and order situation in the locality.

At the same time, according to Ho Chi Minh City Police, Ngoc Trinh organized filming, editing and posting the above clips on social media accounts with a large number of followers, causing negative impacts and adversely affecting security and order in cyberspace.
